Background I have been asked by Counsel for Georgia LLC to address a the development of the state of knowledge of asbestos health cffects and the control of asbestos dust and associated Federal asbestos safety standards b Pacific's response to this developing body of knowledge in its production of joint compound products from 1965-77 including compliance with Federal regulatory requirements efforts to find an asbestos substitute and issuance of appropriate user precautions FI Qualifications I am a Professor Emeritus of Environmental Health Engineering in the Bloomberg School of Public Health of the Johns Hopkins University and President Morton Corn and Associates Inc. a consulting firm that works out of my home in Queenstown Maryland Environmental health engineering is a discipline concerned with the evaluation of air water soil and materials in our environment and the interventions to improve them if they are found to be unhcalthy or to pose a human health risk I received a Bachelor's degree in Chemical Engineering from Cooper Union School of Engineering in 1955 a Master of Science degree in Industrial Hygiene and Sanitary Engincering from Harvard University in 1956 and a Doctor of Philosophy degree in Industrial Hygiene and Sanitary Engineering from Harvard University in 1961. The subject of my doctoral dissertation was the adhesion and entrainment of particles from surfaces This contribution to basic science is relied on today by engineers and scientists who are dealing with indoor air quality concerns From October 1975 until January 1977 I served as Assistant Secretary of Labor for Occupational Safety and Health I have provided consultation services to many private and governmental organizations including the United States Atomic Energy Commission the United States Public Health Service the United States Bureau of Mines the World Health Organization the United States Department of Energy the United States General Services Administration the United States Environmental Protection Agency the National Institute of Environmental Health Sciences Harvard University School of Public Health the American Petroleum Institute Pennsylvania State University and the Brookings Institution As a consultant to the United States Environmental Protection Agency EPA I served on its Science Advisory Board SAB from 1977 to 1984. The SAB reviewed the Agency's Health Assessment document for asbestos Included in the awards I have received is the Cummings Award which is given once a year by the American Industrial Hygiene Association for outstanding contributions in the field of industrial hygiene My Cummings Award Lecture was on Asbestos and Public Health Corn M. Asbestos and Disease An Industrial Hygienist's Perspective Am Ind Hyg Assoc J. 47 515-23 1986 I have published more than one hundred reviewed articles fifteen or more chapters in books and edited three books In 1994 I received the Smyth Award of the American Academy of Industrial Hygiene an annual award for outstanding contributions to industrial hygiene In 2000 I was elected a Director on the Board of the American Industrial Hygiene Association and served for three years In June 2001 I received the Meritorious Achievement Award of the American Conference of Governmental Industrial Hygienists It is presented once a year for outstanding term contribution to the field of occupational health and industrial hygiene I have measured asbestos in glass steel and insulation manufacturing facilities during the 1950's 1960's 1970's and have designed ventilation systems to capture potentially toxic dusts and gases from processing operations I taught graduate courses at Johns Hopkins University and the University of Pittsburgh in the subject areas of industrial hygiene air pollution industrial ventilation aerosol technology and risk assessment I have conducted extensive rescarch on airborne asbestos concentrations in buildings as it relates to occupants and to workers who work with or near containing materials and have published many of these studies See e.g. Mlynarek S. My fee for professional consulting services including expert consultation and testimony in litigation is 4000 per day or 500 per hour I have been accepted as an expert in various federal and state courts to testify in asbestos property damage cases and in other litigation A list of materials I used in developing this report is included as Appendix B. III Discussion A. Historical Perspective In 1955-56 I studied at Harvard University for the Master of Science degree in Industrial Hygiene and Sanitary Engineering The subject of asbestos as a potentially harmful airborne dust in the occupational environment was taught by Professors Phillip Drinker and Charles Williams two eminent industrial hygienists We were instructed on the properties of asbestos dust as they related to its health effects how to sample and evaluate asbestos concentrations in air and how to control the dust The textbook was Industrial Dust by P. Drinker and T.F. Hatch McGraw Book Company New York 1954. In brief we were informed that fi Inhaled asbestos dust was potentially cytotoxic if inhaled by workers at high concentrations over long periods of years It could cause diffuse fibrosis of the lung It was a pneumoconiotic dust Those workers at highest risk were in milling and mining operations for the ore and in manufacturing operations for products that utilized the asbestos fiber The health effects of asbestos and the types of workers at risk were first addressed in a seminal report from The United Kingdom in 1930. Report on effects of asbestos dust and dust suppression in the asbestos industry London His Majesty's Stationary Office 1930 An epidemiological study in the United States confirmed these findings in U.S. workers Lanza A.J. McConnell W.J. and Fehnel J.W Effects of the inhalation of asbestos dust on the lungs of asbestos workers Public Health Report 50 1-12 1935 In 1938 the United States Public Health Service performed an epidemiological study in two U.S. textile mills Dreessen S.C. Dallavalle J.M. Edwards T.I. Miller J.W. and Sayers R.R A Study of Asbestosis In The Asbestos Textile Industry Public Health Bulletin No. 241. Washington D.C. United States Public Health Service This study referred to as the Dreessen report had a profound influence on the concentration of permissible airborne asbestos dust in the workplace both in the U.S. and abroad The report concluded that if the airborne concentration of asbestos dust in workplace air could be maintained below 5 Million Particles Per Cubic Foot of Air MPPCF there would be little or no lung disease in the exposed worker population At Harvard we were instructed on the appropriate methodologies to sample and analyze airbome dust to determine if the asbestos concentration was 5 mppcf or less We also learned control methods to reduce the concentration to 5 mppcf It was believed that this was a safe level to avoid asbestosis * Some of the views expressed here can be found in Com M Asbestos and disease an industrial hygienist's perspective Amer Ind Hyg Assoc J. 47 515-523 1986 A device called the midget impinger was used to sample asbestos in workplace air The methodology specified counting both particles and fibers greater than a specified size At a later date scientific research indicated that the fibers were the disease agent Subsequently measurement methodology changed and airbome dust concentrations were expressed as fibers greater than a specified length per cubic centimeter of air cc The Dreessen Report recommendation of 5 mppcf permissible dustiness was utilized by the U.S. Navy and Maritime Commission as a guideline during World War II It was also adopted by the American Conference of Governmental Industrial Hygienists ACGIH as a Maximum Allowable Concentration MAC in 1947 and later as a Threshold Limit Value TLV in 1951. Many states adopted the TLV as a workplace standard In terms of the later measurement technique which assessed only fibers after 1971 in the United States 5 mppcf is equivalent to approximately 30 fcc asbestos dust This high level of dustiness was associated with workers in mining milling and manufacturing operations My experience with asbestos continued after I left Harvard resulting in the following understandings There was not concern during the 1950's and 1960's for workers utilizing asbestos products or intruding upon asbestos products placc Concem for those workers arose only after public and medical community consensus developed accepting inhaled asbestos as a human carcinogen This occurred in 1964 as a result of a seminal international conference on asbestos held at the New York Academy of Sciences in 1964. Annals of the New York Academy of Sciences Biological Effects of Asbestos Vol 1965 Scientific findings presented at this meeting also suggested that the 5 mppcf guideline was not sufficiently protective and that insulators workers who used asbestos products were at high risk of asbestos disease U.S. asbestos usage increased until the mid nineteen seventies At peak consumption approximately 800,000 to 1,000,000 tons per year were used in over 4,000 commercial products approximately 97 % of this was chrysotile and 1 % was crocidolite In the industrial hygiene community assessment of exposures of product users with the exception of insulators did not commence until the mid nineteen seventies The vast majority of product users were exposed at concentrations below the TLV of 5 mppef 30 cc Time Weighted Average TWA TWA permissible exposure for 8 hours per day 40 hours per week 50 weeks per year for 45 years of exposure The Occupational Safety and Health Administration OSHA the regulatory agency created by the Occupational Safety and Health Act of 1970 commenced work in early 1971 and promulgated a 12 cc TWA Permissible Exposure Limit PEL for asbestos The PEL was to protect against asbestosis and to reduce the risk ofcancer It was applicable to exposure for 8 hours per day 40 hours per week 50 weeks per year for 45 years In 1972 OSHA reduced the PEL to 5 cc and designed the standard so that a 2 cc PEL would automatically take effect in 1976. It is important to understand that in the period 1971-1976 the first priority of OSHA and the occupational health community re asbestos was to reduce the exposures of those highly exposed workers in mining milling and manufacturing and insulators who had been of the understanding that they were protected by the 5 mppcf guideline After 1976 when the PEL dropped to 2 cc the focus changed to include workers exposed at concentrations at or below 2 cc Exposure assessments of workers exposed at lower concentrations began to appear in the literature for examples the first brake exposure assessment article appeared in 1976 Rohl A.N. Wolff M.S. and Weisman .: Asbestos exposure during brake lining maintenance and repair Envir Res 12 110-128 1976 Drywall construction workers in 1979 Fischbein A. et al Drywall construction and asbestos exposure Am Ind Hyg Assoc J. 40. 402407. 1979 Carpenters electricians metal workers and painters in 1983 Paik N.W. et al Worker exposure to asbestos during removal of sprayed material and renovation activity in buildings containing sprayed material Am Ind Hyg Assoc J. 44 428-432 1983 Millwright and maintenance worker exposure in 1992 McKinnery W.N. and Moore R.W Evaluation of airbome asbestos fiber levels during removal and installation of valve gaskets and packing Am Ind Hyg Assoc J. 53 531-532 1992 The first report of asbestos worker home asbestos leading to family member exposure and subsequent adverse health effects mesothelioma was by Newhouse and Thompson Newhouse M.L. and Thompson H Mesothelioma ofpleura and peritoneum following exposure to asbestos in the London area Brit J. Ind Med 22. 261-269 1965 who presented at the 1964 New York Academy of Sciences meeting This casc control study included family and workers at a London textile mill that utilized crocidolite asbestos The authors could not find any occupational exposure for nine of 76 mesothelioma cases 7 female 2 male They concluded that the female exposures were from laundering heavily contaminated clothing the male exposures were concluded to be from childhood and from family members who worked in the factory A transmission mechanism was not clear It was not until the 1970's that consensus was reached on the occurrence of disease in family members from exposure to home asbestos However none of these studies offered insight into the airborne asbestos concentrations to which family members were exposed or the duration of exposure See Report to Congress on Worker's Home Contamination Studyconducted under the Worker's Family Protection Act 29 U.S.C. 671a U.S. Department of HHS PHS CDC NIOSH Sept. My understanding is that workers in the Newhouse and Thompson study brought home very heavily contaminated clothing clothing coated with crocidolite asbestos fiber Airborne levels of asbestos in the Turner and Newill factory in which the study was conducted are thought to have been in excess of 30 mppcf I was a doctoral student at the London School of Hygiene and Topical Medicine University of London the institution in which Drs Newhouse and Thompson worked I knew them both during the 1961-1962 period when they were conducting this study With the lowering of the OSHA PEL to 2 cc TWA in 1976 there was also concern for the exposure of school and building occupants to asbestos that might become airborne from place containing materials ACM such as sprayed structural steel fireproofing thermal insulation sprayed acoustic ceiling material floor tile air blower vibration dampers and other ACM products in buildings The Environmental Protection Agency EPA issued a guidance document addressing this concern in 1979 U.S.E.P.A Containing Materialisn School BuildingsA Guidance Document Part I. OPTS Washington D.C. 1979 This concern was debated throughout the 1980's Three additional EPA guidance documents were published which progressively reduced the concemi for the health of building occupants until in the final guidance document published in 1990 in which the EPA concluded the risk to building occupants from airborne asbestos was very low if it existed at all and that the best policy was to manage the asbestos place U.S.E.P.A. Managing Asbestos Place A Building Owner's Guide to Operations and Maintenance Programs for Asbestos- Containing Materials PTS Washington D.C. 1990 It was not possible to quantitatively estimate the carcinogenic risk of inhaled asbestos until the methodologies of quantitative risk assessment QRA were developed I served on the National Academy of Sciences Committee that developed those methodologies National Academy of Sciences Risk Assessment in the Federal Government Managing the Process National Academy Press Washington D.C. 1983 In 1986 OSHA promulgated an asbestos PEL of 0.2 cc TWA accompanied by an asbestos QRA that supported this standard This was the first OSHA standard that specifically addressed the potential asbestos cancer risk from inhaled asbestos In 1994 OSHA lowered the PEL to 0.1 cc TWA using the same QRA to justify the new standard The sequential lowering of the standard with time extended concern to populations exposed at even lower concentrations The basis for the QRA is the technique of lincar threshold extrapolation applied to exposure data at higher concentrations The calculated risk is designated hypothetical risk The risk may or may not be real but it serves as the basis for prudent public health policy There is increasing evidence that the 1986 OSHA asbestos QRA over estimates the risk from inhaled airbome asbestos In addition since the 1990's a substantial and growing body of scientific evidence has developed that differentiates the particular health issues associated with a specific chemically and structurally distinct asbestos fiber type Hodgson J.T. and Darnton A. Final Draft Technical Support Document For A Protocol to Assess Asbestos Risk Prepared for Office of Solid Waste and Emergency Response U.S. Environmental Protection Agency Wash D.C. 2004 Industrial Hygiene Concepts An essential concept in understanding the control of potentially toxic airborne contaminants in the workplace is the Threshold Limit Value TLV It is the 8hour Time Weighted Average Concentration TWA of the agent in air which can be inhaled by a worker for 8 hours a day 40 hours a week 50 weeks per year for 45 years with minimal or no risk of adverse health effects The TLV was defined by the American Conference of Governmental Industrial Hygienists ACGIH and OSHA utilizes TLV's in its enforcement of workplace standards to this day The meaning of an acceptable concentration in this same sense was reiterated by the American National Standards Institute 37 Committee in 1967 The Meaning of Acceptable Concentrations ANSI 37 Committee 1967 The acceptable U.S. concentration from 1938 until 1971 was 5 mppcf 30 cc The appearance of visible dust in the workplace cannot be cycballed to derive an equivalent airborne concentration What the human eye sees is dependent on numerous physical factors including the refractive index of the dust the particle size distribution of the dust the shape of the dust particles the dust concentration and the position of the observer relative to the dust cloud and the source of light The airborne asbestos concentration of 5 mppcf 30 cc was not associated with industrial operations using asbestos products Measurements of dust concentrations in the late 1970's and 1980's measurements associated with product usage confirmed that 30 cc was seldom exceeded with the exceptions of asbestos mining milling manufacturing and remediation activities It is very difficult to make airborne that dust which settles on horizontal surfaces It is particularly difficult to make airborne those particles which are respirable i.e. particles less than 10 microns Aerodynamic Equivalent Diameter Thus while it is good health and safety practice to maintain facilities as free of settled dust as possible the presence of settled dust cannot be equated with the presence of an inhalation hazard Dust concentrations in the workplace fluctuate There may be short duration high concentrations but it is the hour TWA that is of significance for estimation of inhalation risk e Current OSHA standards require the use of respiratory protection when airborne asbestos concentrations exceed the PEL Prior to OSHA the usual practice in many industries was to make respirators available to workers who desired to use them while performing dusty work Respirator programs as we understand them today include selection for protection factor fit testing and scheduled maintenance None of this existed before OSHA fi The concentration of airbome dust decreases with distance from the source This is the reason worker exposure to dust must be measured with an air sampler worn by the worker it samples at each location the worker occupies Dust emitted from a source in a large building will usually not be detectable 40 or 50 feet from the source C. Chronology of the Georgia Company's Approach to Asbestos in Joint Compound Products In general U.S. companies belong to industry associations in their Standard Industrial Classification SIC Information of a competitive nature i.e. safety pollution standards are addressed in member committees information is shared Georgia belonged to the Gypsum Association and had representation on its Safety Committee In September 1967 it is stated that one member noted a recent problem involving the asbestos industry where a number of lung carcinoma cases had been reported by inhabitants of the neighborhood surrounding an asbestos plant Gypsum Association Safety Committee Minutes Sept. 19 1967 This is the carliest mention of asbestos in the Safety Committee Minutes I reviewed In 1968 there is reference to a U.S. House of Representatives Bill to promote the safety of workers engaged in working asbestos for shipment in commerce In May 1970 before passage of the Federal Occupational Safety and Health Act in the U.S. Dept. of Labor Glen E. Wilson Executive Vice President of the Bestwall Division and of the Gypsum Division wrote a memorandum indicating we should examine our joint system formulas to determine if we can use some material other than asbestos if this would become necessary some time in the future G Memo G.E. Wilson to C.W. Lehnert May 7 1970 Thus Georgia initiated efforts to find a substitute for the asbestos component of its joint compounds before any government standard or scientific study had suggested or much less concluded that either the manufacture or use of joint compound posed a risk of asbestos related disease in manufacturing workers or end users of the products This memo preceded the Occupational Safety and Health Act and the first OSHA effort to control exposure of asbestos workers to asbestos 1971 A memo dated June 3 1970 from E.F. Fatz of the G Portland office to M.F. Fink Safety Director for Bestwall called attention to a reported spot on the lung of a dry wall worker in New York and that this information might be of interest to the Gypsum Association Safety Committee It should be noted that specific pathology or even identification did not accompany this report Mr. Fink on June 9 1970 wrote a memorandum to E.F. Rogers Secretary Gypsum Association Safety Committee in which he indicated we question whether the percentages used in a formula after it is mixed in a batch could be considered harmful He also expressed his opinion that the contractor would be held accountable for workers wearing respirators and dust masks when sanding The language used by Mr. Fink that the entire blame can be placed on the contractor was technically incorrect The technically correct word for blame is responsibility The employer is responsible for providing a safe and healthful work environment for his employees Section 5A of the Federal Occupational Safety and Health Act A memo on Mica Asbestos controls by Mr. Fink dated July 27 1971 was sent to all plant managers it focused on mixing and the use of respirators On Sept. 24 1971 Albert M. Fay Vice President of Research and Marketing National Gypsum wrote to W.H. Hunt President of Georgia stating Our tests indicate that sanding of joint treatment products and particularly the spraying of wall finishes offers some substantial potential hazards On Oct. 7 1971 a memorandum from C.W. Lehnert to W.H. Hunt indicates that Glen Wilson has asked that he try to eliminate asbestos in these products and that we have been moderately successful in as much as were are in the process of reducing or climinating the asbestos from our texture linc We had felt that the presence of asbestos in the textures could be more critical because they are spray applied and there would be more danger of inhaling the fibers any event we will expedite our efforts to get rid of the asbestos in the joint compounds This will be far more difficult because the asbestos controls the working properties which are essential to acceptance by the contractors This last sentence was prophetic as substitution for asbestos in joint compound proved to be a very difficult process of testing new formulations in the field to achieve contractor acceptance in different regions of the country each with different temperature conditions which affect acceptance of the product during application and after drying While pursuing asbestos substitutes in textured and joint compounds there were continuing efforts to comply with the initial OSHA standards for asbestos control which focused on production of products and asbestos workers as contrasted to users of asbestos products M.F. Fink Safety Director in a memorandum dated January 6 1972 to all Plant Managers called attention to the first OSIIA asbestos standard an Emergency Temporary Standard and the need to wear a respirator and have a medical program for employees exposed to asbestos in the plants A January 20 1972 memorandum from M.F. Fink to all plant managers called attention to some criteria that have been established in the first six months of operating under OSHA All employees working with asbestos limestone micas and talc shall be furnished an approved type respirator and it must be worn in the proper manner while exposed to the above mentioned dusts On January 24 1972 a memo from J.D. Rauch of the Akron plant to E.B. Hollingsworth of the Portland plant indicates what is being done to comply with the new OSHA requirement Dust masks and chest rays are being undertaken for asbestos control Other controls for other potential hazards include hearing tests for each employee installing an exit door roll bars for machines lighted exit signs and rearrangement of materials in storage among others A February 11 1972 memorandum from M.F. Fink updates his notification to all plant managers by bringing them up to date as regards recent changes in the OSHA program also proposed changes On Sept. 8 1972 the Texas Dept. of Health inspected the Acme plant at Quinah Texas Improvements were needed in housekeeping control equipment and the respirator program Letter dated Sept. 22 1972 from M.C. Wukasch Texas Health Dept. to K.W. K.W. Brown Plant Manager Also in August and September 1972 inspections were conducted by the N. State Inspector for dust and noise testing in the Joint Systems and Plaster Packing Departments These inspections reflect what was occurring throughout U.S. industry with the startup of OSHA Inspections found deficiencies in control programs the facilities were notified and cited and in the overwhelming majority of cases improvements were implemented by those at the facilities Pacific's already underway efforts to find a suitable replacement for asbestos were beginning to show some success By November , 1972 plans called for replacement of asbestos from Ready Mix which would eliminate asbestos from approximately 50 of our production thereafter the bagged products will be changed Memo from E.D. O'Neill O'Neill to T.W. Richards and E.B. Hollingsworth dated Nov. 1 1972 A Nov. 20 memorandum from W.M. Gettel to C.W. Lehnert discusses the results of a field test of the new asbestos substituted product in the Oklahoma City area and illustrates the kind of field trial effort required to substitute for asbestos in joint compound Tests for dust exposure by G and Union Carbide Corporation personnel indicated high short exposures to asbestos in air from a loading hopper leading to a bagging machine Asbestos Fiber Counts by M. Palmowski E.J. Kleber and T.P. Norris Dec. 29 1972 An indicator of the leaming period for employers developing an asbestos control program is the Jan. 22 1973 information package sent by the OSHA Seattle office to employers using asbestos It is a digest or simplification of the OSIIA rule Results ofa Feb. 7 1973 OSHA inspection of the Akron N.Y. plant were discussed in a Feb. 9 1973 memo from J.D. Rauch to E.B. Hollingsworth During this same period when G was devoting efforts to substitute for asbestos in textured products and in joint compound it was also working with the Technical and Safety Committees of the Gypsum Association In the February 14 15 16 1973 meeting of the Technical Committee the committee proposed the pooling of information on the health and safety of asbestos in joint compounds as a result of sanding and dry mixing They also requested staff to develop a list of testing agencies qualified to conduct tests of dust environments containing asbestos determine estimated costs of test programs and report on methods used It also requested that the Safety Committee recommend what is needed to protect the applicator working in these conditions Minutes of the Ninetieth Meeting of the Technical Committee Gypsum Association Feb. 14 15 16 1973 Airborne fiber counts in the Akron N.Y. plant were measured Report by Schifferle D.E. Lehnert The memo states it is my understanding that our competitors will begin marking their bags shortly The labeling of bags was in compliance with the 1972 OSHA asbestos regulation Efforts to comply with regulatory requirements in the Akron N.Y. facility are documented throughout 1973. Efforts were also in progress at the Acme plant Field testing of joint compound without asbestos also continued Sec Memorandum dated Feb. 23 1973 from C.W. Lehnert to L.E. Winter on All Purpose Memphis A rubber stamp for warning was used to label bags commencing in May 1973 See Memoranda dated May 10 1973 and May 14 1973 from J.D. Rauch to C.W. Lehnert and C.W. Lehnert to J.D. Rauch respectively The Manufacturing and Mining Committee of the Gypsum Association at its April 3 1973 meeting recommended to the Board of Directors that an evaluative study be made of asbestos content in mixing and application operations after the study objectives are clearly defined At the April 4 1973 Membership meeting it was recommended that a Testing Committee be appointed The Board of Directors on April 5 1973 approved a fire and sound testing program The asbestos hazard warning label on bags was incorporated into the bag manufacturer's printing plates at the Akron N.Y. plant Memorandum from Ed Anson to J.B. Moss dated May 2 1973. Also May 8 1973 letter from E.L. Anson of G to Hal Berven of the bag supplier The label on bags fulfilled what was required by OSHA and all plants were requested to use this label Memorandum from W.N. Gettel to K.W. Brown dated May 25 1973 A June 19 1973 Memorandum from Gene Wilson to J.D. Rauch indicates GeorgiaPacific is intent to comply with new government regulations instructing Mr. Rauch Plant Manager to proceed as rapidly as possible on an emergency basis to correct our deficiencies A letter from H.B. Carlsen Secretary Technical Committee of the Gypsum Association outlined an approach to underwriting a test program for monitoring of dust conditions for asbestos as well as for mica silica quartz tale and total dust The approach outlined was encouraged by OSHA if they could show that Association procedures to mix and sand joint compound had been followed It was definitely stated that if the proposed program was finalized and developed it would certainly show good faith on the part of the manufacturer and the contractors who adhered to it Thus the Gypsum Association discussed its planned testing effort with OSHA the regulatory agency a rare procedure for U.S. industry The effort of the Association to work with OSHA concerning asbestos and joint treatment compound was supported by Glenn H. Wilson Vice President G Letter dated June 21 1973 from Glenn H. Wilson to II.B. Carlsen Secretary Technical Committec Gypsum Association On July 6 1973 II.B. Carlson wrote to all members of the Technical Committee indicating the Directors support the testing program for joint compound He recommended the subcommittee meet in August 1973 to begin the work Memo dated July 6 1973 to All Members of the Technical Committee from H.B. Carlsen Secretary The George D. Clayton and Associates firm was contracted to perform the industrial hygiene survey of joint compound operations George D. Clayton Associates issued a report to the Gypsum Association titled Evaluation of Exposure to Asbestos During Mixing and Sanding of Joint Compounds dated November 19 1973. The report indicated that If it is true that as reported by workers used during this test it would be unlikely for an individual to mix or sand on the joint compounds for greater than two hours per work day than the weighted average exposure of such worker to asbestos likely would be within acceptable limits However the short term exposure limit would still be excccded R.D. Soulc the author of the report recommended substitution of asbestos in joint compound as The most effective means of eliminating the asbestos problem if this is feasible Additional engineering controls were recommended as the OSHA Permissible Exposure Limit would be reduced from 5 cc to 2 cc in July 1976 OSHA compliance efforts were continued by G in 1974. The Akron plant permanent engineering controls were to be ready by February 11 1974 and the plant would be reinspected on that date or shortly thereafter The plant manager was confident of passing the inspection Memmorandum J.D. Rauch to E.B. Hollingsworth on OSHA Asbestos Reinspection dated February 8 1974 On or about April 1974 OSIIA issued an asbestos hazard warning for wall spackling It was received by G on April 26 1974. The basis for the warning a study of 17 members of a New York City painters local was reported in the May 1974 issue of Walls and Ceilings Magazine A memo from O.E. Burch to G.E. Wilson dated May 17 1974 states This is the first time I have seen actual cases reported This was the first government statement re the potential hazard of wall spackling As part of the OSHA Medical Surveillance requirements G performed Chest ray examination of workers at the Akron N.Y. plant Results revealed chronic obstructive airway disease on certain employees a condition not specifically related to asbestos inhalation G Intracompany Memo L. Ryder to R.L. McCallister on Akron N.Y. Chest rays and Ventilation Study dated April 26 1974 In June 1974 the type size for Caution on labels was doubled in size and the word was underlined Memo to D.C. Corkill from O.E. Burch titled Warning Labels Joint Cement Products dated June 4 1974 Internal concerns regarding possible impact on sales apparently existed but were overruled Memorandum J.R. Hurd to W.A. Nalbone titled Asbestos Caution Labels dated June 7 1974 On June 14 1974 M.M. Brenner Assistant Secretary of the Gypsum Association Safety Committee sent a booklet to all plant managers It contained recommended guidelines for compliance with existing OSHA Asbestos Standards See Gypsum Association Booklet Occupational Safety and Health Standards Compliance Procedures June 25 1974 Evidently this was issued to assist plant managers in their efforts to comply with OSHA standards before and after OSHA inspections which as noted above wcrc occurring in G facilities during 1973 and 1974 and were undoubtedly occurring in other association member plants as well An evaluation report of the asbestos control efforts at the G Portland plant was prepared by Dr. Marvin Amdur Intracompany memo R.L. McCallister to L. Ryder dated July 1 1974 The program undertaken to control asbestos was extensive In July 1975 the Marietta Georgia G plant was inspected by OSHA Several citations were for asbestos control Conditions were corrected and reinspection was scheduled 7/31/75 Handwritten sheet of corrections attached to citations The first published reviewed scientific article on the subject of exposure in the use of consumer spackling patching and taping compounds appeared on Aug. 15 1975 Rohl A.N. Langer A.M. Selikoff I.J. and Nicholson W.J Exposure to asbestos in the use of consumer spackling patching and taping compounds Science 189. 551-553 1975 The results of asbestos exposure monitoring cxcccded the OSHA short term 15 minutes excursion limit of 10 cc The authors believe the hr OSHA standard is inappropriate due to the discontinuous nature of the exposure These exposure results concur with the findings reported to the Gypsum Association by the George D. Clayton Associates organization in their study In August 1975 the Akron plant was producing some asbestos free joint compound Acme plant Ready was not yet ready as of Nov. 17 1975. The difficulties experienced in this substitution by G as well as other manufacturers is noted Memorandum W.D. Brooks to Dave Corkill dated Nov. 17 1975 re asbestos free The A June 24 1976 memo from G.F. Baitinger to Branch Managers indicates that the plants are meeting the new OSHA 2 cc standard However he also states that there are no regulations for asbestos on construction sites which is incorrect On August 18 1976 G.E. Wilson indicates that all products designed for the do yourself trade i.e. the pound package of dry products and gallon Ready will contain asbestos formulas if any plant has an inventory of these products that contains asbestos it should be scrapped Also effective immediately the only dry powder products in 25 pound or larger bags that will be sold will be casein products produced at Akron and Chicago If you are producing any other bag goods with asbestos you will eliminate this formula from your product line and have Tigard issue you an asbestos replacement formula We will continue to produce both asbestos and asbestos applicators and work toward improvement of the asbestos product Memorandum from G.E. Wilson to plants and others dated Aug. 18 1976 and titled Joint Cement Products A letter from O.E. Burch Sales Manager Gypsum Division to Craig Burningham who wrote him on January 14 1977 seeking information on asbestos in joint compound represents an expression of Mr. Burch's own beliefs Re asbestos is in joint cement but is in my opinion an unfortunate choice of words I did not locate any other replies of this nature to customers Shipments of asbestos free and asbestos joint compounds by plant are contained in an April 21 1977 memo from C.W. Lehnert to G.E. Wilson On April 23 1977 the Consumer Product Safety Commission CPSC announced a ban on the use of asbestos in joint system compounds On 4/23/77 G plants were told do not run asbestos formulas after today Memo from E.B. Hollingsworth to plants and to others Actually the CPSC allowed 4-6 months for producers to make the transition G used its remaining asbestos inventory before conversion to asbestos product Memo from D.C. Corkill to Regional Gypsum Managers dated 5/2/77 This message was transmitted by E.B Hollingsworth to plant managers Memo from E.B. Hollingsworth to plant managers dated 5/2/77 A clarifying memo from W.D. Brooks to Branch Managers indicated asbestos formula ready mix will be sold only to contractors and dealers selling to contractors Asbestos free formula is not to be sold to retail outlets for consumer use Memorandum from W.D. Brooks to Branch Managers dated 5/3/77 The manufacture of products containing asbestos stopped on May 4 1977 Memorandum from E.B. Summary G was ahead of or moving with the curve of control of asbestos in joint compound in the U.S. In 1970 before OSHA existed and before any scientific study or governmental finding had associated the use of joint compound with any asbestos health related risk G.E. Wilson Vice President of Pacific's Bestwall Joint Compound Manufacturing Division indicated the direction to be taken Georgia decided to remove asbestos from its products Initially asbestos was removed from spray texturizing products an easier and more urgent task than removing it from joint compound Elimination of and substitution for crysotile asbestos in joint compound required years of effort at reformulating product for different markets and gaining user particularly contractor acceptance G also worked through the Gypsum Association Safety Committee to undertake tests to evaluate exposure to asbestos during product production and end uses such as sanding During the 1973-74 period when OSHA was enforcing its new asbestos standard at production plants throughout the country G responded to inadequacies found on inspection in a timely and cooperative manner Plants were brought into compliance The G efforts at replacing asbestos in joint compound in many markets preceded the Consumer Product Safety Commission CPSC ban in 1977.
