Section I - INTRODUCTION
CapturePoint, LLC / North Burbank Unit 31 Battery Inspection Date 10/10/2023
PURPOSE OF THE INSPECTION
EPA Region 6 inspector Matthew Allen arrived at the CapturePoint, LLC / North Burbank Unit (NBU) 31 Battery (EPA ID No. OKU002129) at 10:15 AM on 10/10/2023 for an announced inspection. This was an EPA inspection in response to a National Response Center Spill Report (NRC No. 1381046) which was received by EPA Region 6. The inspection was conducted by the authority of the Clean Water Act (CWA) to determine compliance with Environmental Protection Agency (EPA) regulations. CapturePoint, LLC representative, Talia Clark participated during the inspection. There was no other federal, state, or local agency representatives present at the time of the inspection.
FACILITY DESCRIPTION
EPA conducted an inspection at the CapturePoint, LLC North Burbank Unit 31 Battery, well # NBU48W16 4" steel flowline, where an equipment failure resulted in the release of a company estimated 75 barrels of produced water and 1 barrel of crude oil. The released fluids migrated east along a braided flowpath approximately 250 feet before spilling into the headwaters of Dry Creek.
Section II - OBSERVATIONS
I observed the release point of the spill. The injection line was underground, and the operator representative stated the line had been isolated to prevent additional release but had not yet been repaired. I observed crude oil on the soil and vegetation in the area around the release point. I observed damp soil along the flowpath travelling away from the release point but was unable to provide photos due to the heavy vegetation along the flowpath. The release point and visible impacts can be seen in photos No. 1 & 2 of Appendix 1 (photo log) which is attached to this report. GPS and additional metadata for each photo observation can also be found in the photo log.
I observed the braided flowpath from the release point, travelling east approximately 250 feet toward the headwaters of Mud Creek. The flowpath was visible at the time of the inspection (wet soil) but heavy vegetation (grass) prevented photo documentation.
I observed the point of entry (POE) into Mud Creek. I also observed an elevated total dissolved solids (TDS) field reading of 14,509 mg/L in the main channel of the impacted creek at the POE. All TDS field readings observed during the inspection were taken with the EPA issued, properly calibrated, YSI Pro 30 conductivity meter. The POE, bed and bank features of the creek and elevated TDS field reading can be seen in photos No. 3 & 4.
Continuing downstream, I observed the bed and bank features of the impacted creek. I also observed an elevated TDS field reading of 66,983 mg/L at the same location. This was the highest TDS field reading observed during the inspection. These observations are documented in photos No. 5 & 6.

Continuing further downstream, I observed additional bed and bank features of the impacted creek. There was no water present in the creek at this location. These observations can be seen in photo No. 7. I observed the temporary containment dam which had been placed by the operator to prevent further downstream migration of impacted waters. At the time of the inspection, no impacted water had reached the dam, nor had any impacted water migrated past the dam. The temporary containment dam can be seen in photo No. 8. Section III - AREAS OF CONCERN The primary areas of concern included the impacted soil and vegetation around the release point, the impacted soil and vegetation across the overland flowpath to the POE and the elevated TDS observations along the impacted waterway. Section IV - FOLLOW UP Inspector will follow up via phone calls and site visits as needed until the impacted area is cleaned to "pre-spill" condition.
