This is just a short note on the status of this
I have called Claire Barile, who is Bill McGuire's
partner, several
times regarding the plans for a defense
counsel meeting.
She advised me yesterday that there are
still no plans for one, but Mr. McGuire has been speaking
to David Gross (representing Ethyl Corporation) and Ray
Tierney (representing Borden Inc.) to set one up.
Claire also informed me that several of the
defendants have not yet been served with either the Amended
Complaint or' the
Second Amended Complaint.
As you know,
we have answered the Amended Complaint for Carbide. I assume
that Carbide has not yet been served with the Second Amended
Complaint and that you will send it to me if and when service
is effected.
Until such time as there is a defense counsel discussion on the subject, I continue to believe that

crossclaims should not be filed.
This is the standard
approach which Carbide has approved in prior multi-defendant
toxic tort cases. If counsel cannot agree on how to handle
crossclaims, we can obtain leave of court, if necessary,
to file same. If you disagree or wish to discuss the issue
in more detail, please call me. -
Please also note that I am not preparing
Interrogatories at this time, since the Court will generally
only permit a uniform set on behalf of all defendants in
a case like this.
Because many of the defendants have
retained Mr. McGuire, they can share his fee in preparing
same.
I will contact you when the defense counsel meeting is scheduled so we can discuss the agenda.
