ESTMUSHCO 1*02 E. I. du Pont de Nemours 51 Company INCOttPOftATCO Wilmington, Delaware 19898 POLYMER PRODUCTS DEPARTMENT May 20, 1983 PERSONAL AND CONFIDENTIAL TO: E. L. TIMMONS D-11042 FROM: R. D. INGALLS S& OCCUPATIONAL ILLNESS WORKERS' COMPENSATION SETTLEMENTS PPD sites have identified 90 employees and 50 pensioners who have a chest or lung abnormality that could have resulted from exposure to asbestos during their employment with Du Pont. In most of these cases, there has been no significant effect on the person's pulmonary function and his ability to work. However, we have instances (about 10% of the employee cases and 20% of the pensioners) where the abnormality has progressed to the extent that there is impairment or cancer of the lung, or pleura has developed. There have been two deaths from cancer of the pleura. It is these two cases - with the relatively large Workers' Compen sation settlements - that prompted our questions about how these costs are charged to the sites and if you thought the procedure is appropriate or needs modification. The attached memo summarizes one of the cases. Indi cated expense is $300M-$350M depending on the lifespan and marital status of the survivor. Although the more costly cases have been emphasized above, there are states (e.g., Virginia and West Virginia) where Workers' Compensation awards are made for cases with no impairment. Washington Works has a number of these cases that are being processed. Based on awards to date, the total cost could be S275M. Spruance has S70M in awards.
