This is an effort to provide regulatory certainty to farmers and ranchers. As many of you are aware, the Supreme Court determined last week that the U.S. Courts of Appeals do not have the jurisdiction to implement the nationwide stay of 2015 WOTUS. This action is an effort to preclude litigation uncertainty across court systems as the EPA continues to work with state and local partners to rewrite and implement a final rule at a future date.
