These companies ensure timely and safe drug supply for all patients across the EU and globally. With successful companies, qualified employees, high productivity, innovative products and good working conditions, we are helping to secure Germany's longterm competitiveness as a pharmaceutical industry location. Polymeric perfluorinated and polyfluorinated alkyl substances (PFAS) are indispensable for pharmaceutical production plants and the manufacture of drugs Polymeric PFAS are used in the pharmaceutical production due to their chemical properties (high resistance to mechanical stress, temperature and aggressive substances like acids and alkalis, very low chemical reactivity). The great advantage is they do not react, or react only to a negligible extent, with potential reaction partners under the given conditions. This makes them the ideal and not exchangeable material for Seals, valves, coatings, hoses, rotor plates, lubricating oils, membranes, sterile filters, films or film distributors - summarized everywhere there is contact with the product in the production facilities or with consumables. For the foreseeable future the pharmaceutical industry is dependent on these materials in their production facilities. For instance, PFAS encounter the following gases and substances without any chemical reactions taking place: Ozone (important component in production for high quality water for drugs) Pure steam and plant steam (temperature 140-1200 C) Sodium hydroxide (Purification) Citric acid (Purification) PFAS are used per se as active ingredients, but also as important raw material, precursor, additive (f. e. in metered-dose inhalers for the treatment of asthma and COPD) and in medicinal products (f. e. eyedrops). Substitution is not trivial Currently there are no alternative substances despite intensive research. It is also unknown whether manufactures of the individual plant components will be able to develop PFAS- free alternatives at all, that meet the requirements of current PFAS-containing plant components. However, there is no doubt that plant components with precisely these "PFAS properties" are urgently needed for the construction and operation of safe and process-optimized industrial plants - so as things stand today, there is still no substitute. Environment and Sustainability Friedrichstraf3e 148 10117 Berlin I www.bpi.de Telefon: +49 30 27 09-124 b i.de Therefore, substitutions in chemical-pharmaceutical production plants are not trivial either, which will be exemplified by the following example "alternative membranes": PFAS are resistant to hot (>60C) and thus particularly aggressive acids. Alternatives, for example membranes made of ethylene-propylene-diene-monomer rubber (EDPM) would decompose in a very short time, although they are said to be largely resistant to chemicals. In addition, the alternative use of EPDM membranes would involve the risk of EPDM particles getting into the product, which must definitely be ruled out in the pharmaceutical industry. Furthermore, during steam generation EDPM-membranes would very quickly become brittle, dissolve, and become dispersed in the system. In addition, the use of EPDM materials would cause valve seals to leak quickly, posing a significant product risk as well as a high safety risk. In additiona PFAS play an important role in connection with excipients in drugs. The medical propellants HFC 134a and HFC 227ea and hydrofluorocarbons (HFCs) are used for example in metered-dose inhalers. It is not possible to simply use an alternative medical propellant. To do this, it must be compatible with the product components and formulation and support the required particle size distributions as well as the uniformity of the administered dose. Polymeric PFAS, first and foremost PTFE, are used due to their reaction inertia. Therefore, they are a component of material that is in direct contact with the active drug. This not only guarantees the greatest possible safety of the drug, but also the occupational safety of the medical staff, especially when administering highly effective drugs (e.g., immunotherapeutics). Consequences of any substitutions Even if a successful substitution of used and established PFASs were to succeed, it would pose major challenges to manufacturers: Suitability testing of alternative materials: Pharmaceutical entrepreneurs must meet regulatory requirements for the materials in contact with the product or components of excipient or the product itself. These various requirements are very specific to produce drugs and active ingredients based medicinal products (GxP; ICH; MDR). New Materials have to undergo a very lengthy proficiency test. In addition, new materials may not be used in production until the dossiers for marketing authorization or registration documents have been approved by the authorities or notified bodies. Pharmaceuticals are also subject to extensive clinical trials. It must be ensured that the drug with, for example, a modified excipient is safe, effective, and pharmaceutically harmless for patients. Validation of the use of alternative materials PFASs are used, for example, as adhesive protection on the inside of tubes used to fill liquids into primary packaging, as well as in mass production. When replacing the tubes material, it would then have to be demonstrated that no contamination of the new tube material diffuses into the liquid and vice versa. Environment and Sustainability Friedrichstraf3e 148 10117 Berlin I www.bpi.de Telefon: +49 30 27 09-124 b i.de and bureaucratic effort for new validations and analyses would be enormous, very costly and disproportionate. Consequences of any prohibition PFAS are used as active ingredients, but also as important raw material, precursor, additive, and excipient during production of active ingredients, as well as in medicinal products. Both the production and use as well as plant engineering aspects must be considered. Without clearly described exceptions, the situation could arise where substances excluded from the restriction or prohibition are permitted but their manufacture within the EU is prohibited. This would mean that relevant substances could only be imported from non-European countries. Examples include active pharmaceutical ingredients that are essential and critical to the treatment of diabetes, cancer, multiple sclerosis and rheumatism, among others, and that are currently still manufactured in the EU or in Germany and serve to supply the European healthcare system. This would then no longer be possible. The consequence would be that the relevant production facilities would be closed, jobs in the EU would be lost, currently planned investments in the EU could not be realized, and the active pharmaceutical ingredients would have to be imported from non-EU countries - here in particular from Asia (especially China and India) - which would further increase the critical dependence of the European healthcare system on these imports. Furthermore, a comprehensive and radical prohibition of PFASs in production facilities and productions equipment and consumables, there is an immediate and real risk that the manufacturers of such PFAS-containing equipment (e.g., sealing rings, sterile filters, liquid distributors in short-path distillation, product-contacting filter membranes in active ingredient production, mechanical seals on the rotors of liquid-liquid chromatography in the purification of active ingredients) would no longer produce and sell in the usual quantities. Production would also be discontinued for economic reasons. In case of maintenance, for example, these components would no longer be available. If there are (then) also no alternatives, there would be a standstill of the production facilities. The high risk of discontinuing production and all the consequences described above would also affect the PFAS-containing excipients (e.g., membranes, liners) or also packing material from drugs (e.g., blister foil). Thus, the manufacture and availability of pharmaceuticals, and thus patient care, would be directly affected, even though an exemption is provided per se for the active ingredients themselves in the restriction proposal. It should also be noted that the proposed exemptions should be considered on a case-by-case basis. For example, medicinal propellants ((HFC 134c and HFC 227ea), the proposed 18-month period is neither technically nor economically feasible for affected companies and would equally jeopardize patient care in Europe and beyond. It should also be considered that the radical nature of the Restriction Proposal hinders innovation. It cannot be ruled out that highly effective active pharmaceutical ingredients containing two or three fluorine atoms (i.e. a fluorinated methylene group or a fluorinated methyl group) will be developed in the future. The ban is therefore a relevant interference in the free economic development of companies in the European Union and a preferential treatment of companies outside the EU. It is almost paradoxical that the substances then declared as active pharmaceutical ingredients would be allowed to be imported back into the EU. Environment and Sustainability Friedrichstraf3e 148 10117 Berlin I www.bpi.de Telefon: +49 30 27 09-124 b i.de In summary, the proposed restriction increases the risk of a migration of the pharmaceutical industry to less strictly regulated regions and existing products (drugs or combination products) with long-standing approvals disappear from the market (without replacement). Admissibility of the scope of the Restriction Proposal It is seriously doubted that polymeric PFAS may be banned in the same way as other (small molecule) PFAS. Polymers such as polytetrafluoroethylene (PTFE) are not only used because of their exceptional technological position but also because of their toxicological harmlessness. It therefore seems in no way justified to ban them on the basis of toxicological properties of other - only distantly related - molecules. The fact of slow biotic degradation and the resulting concerns about accumulation in biological systems such as soils also does not justify this. It should be noted that there are also no data deposited in annexes of the restriction proposal indicating that PTFE accumulates in biological systems. Also in other European reports, such as HBM4EU or the data on PFAS in waters, PTFE is not listed as a substance group. It is therefore doubtful whether PTFE, like other PFAS subgroups, accumulates in biological systems. The mobility in water mentioned in the justification of the Restriction Proposal does not apply to polymeric PFAS anyway. If, despite these considerations, PTFE and other fluorine-containing polymers were to be banned, we believe that a permanent exemption would be possible if a take-back system for the polymers used in industrial plants prevented them from entering the environment. These considerations also apply to the other end of the scope of the Restriction Proposal: It is seriously doubted that molecules containing two or three fluorine atoms (with a possible molecular weight of several 100 daltons) have the same (environmental) toxicological properties as, for example, a perfluorooctanoic acid, the use of which is already rightly restricted today. In general, it will have to be clarified whether properties of individual molecules may lead to a ban of an arbitrarily defined group of substances to the extent now planned. We fear that if the Restriction Proposal is implemented, there will be legal uncertainty for many years due to ongoing lawsuits. It is precisely this kind of legal uncertainty that poses a risk to mediumsized companies, as they cannot relocate production to other EU countries in the same way as multinational corporations and, if necessary, bring it back after clarification. Reference is made here to the current legal uncertainty surrounding the use of titanium dioxide in pharmaceuticals. It must also be ensured that existing ordinances and regulations are observed in order to rule out overregulation. The existing European F-Gas Regulation (517/2014) already comprehensively regulates HFCs. Currently, this regulation is under revision. This will ensure that HFC 134a and HFC 227ea are phased down (in line with the Kigali Amendment to the Montreal Protocol). Currently, two next-generation propellants are under development: HFC 152a and HFO 1234ze. HFC 152a is not subject of the PFAS consultation. It is important that any PFAS restrictions are consistent with the F-Gas Regulation. Environment and Sustainability Friedrichstraf3e 148 10117 Berlin I www.bpi.de Telefon: +49 30 27 09-124 b i.de BPI demands: Adjustment of the restriction proposal In order to maintain the security of supply of medicinal products and substancerelated medical devices from European production and manufacture, targeted openended exemptions from the restriction should be provided for the uses listed above: In the event that polymeric PFASs are not generally removed from the Restriction Proposal due to their toxicological harmlessness, PFAS-containing equipment parts in industrial plants including the necessary supply chain should be excluded. Pharmaceutical production plants contain countless components containing PFAS (spare parts, wear parts, used parts), which cannot simply be replaced for the above reasons. It is therefore imperative to implement unlimited exemptions for all PFAScontaining components in pharmaceutical production facilities. Consumables for the production of pharmaceuticals The production of pharmaceuticals requires, among other things, a wide variety of consumables (e.g., sterile filters). These are currently also manufactured in Europe. It is therefore imperative to implement unlimited exemptions for all PFAS-containing consumables that are mandatory to produce pharmaceuticals. This also serves the sustainability and economic viability of industrial plants. Intermediates and precursors for the manufacture of pharmaceuticals The indefinite exemptions proposed in the restriction proposal relate to the active ingredients themselves and do not cover their manufacturing process. It is therefore imperative that exemptions be implemented for all PFAS-containing substances, their intermediates and processing aids required in the manufacturing process of medicinal products. Excipients as components of medicinal products and combination products In some medicinal products or combination products, PFAS-containing coatings are considered excipients as part of the medicinal product or combination product itself, even if they are partially removed before use (e.g. protective films in transdermal systems). Likewise, PFAS-containing coatings are used in primary packaging materials. It is therefore imperative to implement open-ended exemptions for all PFAS-containing components in pharmaceutical products or their primary packaging. Sufficient time must be allowed for exemptions. After all, if the need for an exemption is seen but then defined to an insufficient degree in terms of time, the goal of ensuring patient care cannot be achieved. Companies need sufficient time to develop substitute products, including approval by the drug authorities and a seamless and safe transition in patient care. (BPI) vertritt die gemeinsamen wirtschaftlichen Interessen seiner Mitgliedsunternehmen vor allem in den Bereichen Gesundheits- wie Standortpolitik, Versorgungssicherheit und Arzneimittelgesetzgebung auf Landes- und Bundesebene sowie in Europa. Wir wirken mit erfolgreichen Unternehmen, qualifizierten Mitarbeiterinnen und Mitarbeitern, hoher Produktivitt, innovativen Produkten und guten Arbeitsbedingungen daran mit, den Pharma-Standort Deutschland langfristig und wettbewerbsfhig zu sichern. Polymere per- und polyfluorierte Alkylsubstanzen (PFAS) sind fr pharmazeutische Produktionsanlagen und die Herstellung von Arzneimitteln unverzichtbar Polymere PFAS finden in pharmazeutischen Produktionsanlagen aufgrund ihrer Eigenschaften (hohe Bestndigkeit gegen mechanische Belastung, Temperatur und aggressive Stoffe wie Suren und Laugen, ganz geringe chemische Reaktivitt) Verwendung. Der groe Vorteil ist, dass sie unter den gegebenen Bedingungen nicht oder nur in vernachlssigbarem Umfang mit potenziellen Reaktionspartnern reagieren. Das macht sie zum idealen und nicht austauschbaren Werkstoff fr Dichtungen, Ventile, Beschichtungen, Schluche, Rotorplatten, Schmierle, Membranen, Sterilfilter, Folien oder Folienverteiler - also berall dort, wo in den Produktionsanlagen oder mit Verbrauchsmaterialien Kontakt mit dem Produkt besteht. Die pharmazeutische Industrie ist somit auch auf absehbare Zeit weiterhin auf den Einsatz von PFAS in Produktionsanlagen angewiesen. Beispielsweise kommen PFAS mit folgenden Gasen und Substanzen in Kontakt, ohne dass es dabei zu chemischen Reaktionen kommt: Ozon (wichtiger Bestandteil in der Produktion von hochwertigem Wasser fr die Herstellung von Arzneimitteln) Reindampf und Schwarzdampf (Temperatur 140-1200 C) Natriumhydroxid (Reinigung) Zitronensure (Reinigung) PFAS werden per se als Wirkstoffe eingesetzt. Sie kommen aber auch als wichtige Roh-, Vor-, Zwischen-, Hilfsstoffe (z.B. in Dosieraerosolen, beispielsweise Asthmasprays und Sprays zur Behandlung von COPD) und in Medizinprodukten (z.B. Substitution ist nicht trivial Umwelt und Nachhaltigkeit Friedrichstrae 148 1 10117 Berlin 1 www.bpi.de Telefon: +49 lj7 909-0 Mabpi.de Alternative Materialien sind trotz intensiver Forschung derzeit nicht bekannt und es ist auch nicht bekannt, ob die Hersteller der einzelnen Anlagenteile in der Lage sein werden, berhaupt PFAS-freie Alternativen zu entwickeln, die den Anforderungen der aktuellen PFAS-haltigen Anlagenteile entsprechen. Zweifelsohne werden aber gerade Anlagenteile mit genau diesen ,,PFAS-Eigenschaften" dringend fr den Bau und Betrieb sicherer und prozessoptimierter Industrieanlagen bentigt -- es gibt also nach heutigem Stand noch keinen Ersatz. Daher sind auch die Substitutionen in chemisch-pharmazeutischen Produktionsanlagen nicht trivial, was exemplarisch am nachfolgenden Beispiel ,,alternative Membranen" verdeutlicht werden soll: PFAS sind gegenber heier (> 60 C) und somit besonders aggressiver Suren und Laugen resistent. Alternative Materialien, wie beispielsweise Membranen aus Ethylen-Propylen-Dien-Monomer-Kautschuk (EPDM), denen ebenfalls eine weitgehende Chemikalienbestndigkeit nachgesagt wird, wrden sich innerhalb krzester Zeit zersetzen. Zudem bestnde bei der alternativen Verwendung von EPDM-Membranen die Gefahr, dass EPDM-Partikel in das Produkt gelangen, was in der pharmazeutischen Industrie definitiv auszuschlieen ist. Weiterhin wrden EPDM-Membranen bei der Dampferzeugung sehr schnell sprde werden, sich auflsen und im System verteilt werden. Auerdem wrde die Verwendung von EPDM-Materialien dazu fhren, dass Ventildichtungen schnell undicht werden, was neben einem erheblichen Produktauch ein hohes Sicherheitsrisiko darstellen wrde. Des Weiteren spielen PFAS im Zusammenhang mit Hilfsstoffen in Arzneimitteln eine wichtige Rolle. In Dosieraerosolen werden beispielsweise die medizinischen Treibmittel HFC 134a und HFC 227ea, Fluorkohlenwasserstoffe (HFKW), verwendet. Es ist nicht mglich, einfach ein alternatives medizinisches Treibmittel in Dosieraerosole zu "geben". Es muss dafr mit den Produktkomponenten und der Formulierung kompatibel sein und die erforderlichen Partikelgrenverteilungen sowie die Gleichmigkeit der abgegebenen Dosis untersttzen. Polymere PFAS, allen voran PTFE, werden aufgrund ihrer Reaktionstrgheit, vermehrt als Material eingesetzt, welches direkt mit dem Arzneimittel in Berhrung steht. Dadurch wird nicht nur die grtmgliche Unbedenklichkeit des Arzneimittels garantiert, sondern gerade bei der Verabreichung von hochwirksamen Arzneistoffen (z. B. Immuntherapeutika), auch der Arbeitsschutz des medizinischen Fachpersonals. Konsequenzen etwaiger Substitutionen Umwelt und Nachhaltigkeit Friedrichstrae 148 1 10117 Berlin 1 www.bpi.de Telefon: +49 l0j7 909-0 MPbpi.de Selbst, wenn eine erfolgreiche Substitution verwendeter und etablierter PFAS gelingen wrde, wrde diese die Hersteller vor groe Herausforderungen stellen: Eignungsprfung alternativer Materialien: Pharmazeutische Unternehmen unterliegen aufgrund der verschiedenen spezifischen regulatorischen Anforderungen fr die Herstellung von Arzneimitteln und wirkstoffbasierten Medizinprodukten (GxP, ICH, MDR usw.) strengen Prfanforderungen bezglich der Eignung der bei der Herstellung verwendeten Materialien, die mit dem Produkt in Kontakt kommen bzw. Bestandteil der Hilfsstoffe des Produktes oder des Produktes selbst sind. Neue Materialien werden daher einer langwierigen Eignungsprfung unterzogen. Darber hinaus drfen neue Materialien erst dann in der Produktion eingesetzt werden, wenn die Zulassungsdossiers oder Registrierungsunterlagen von den Behrden oder benannten Stellen genehmigt wurden. Arzneimittel unterliegen zudem einer umfangreichen klinischen Prfung. Es muss sichergestellt werden, dass das Arzneimittel mit zum Beispiel einem vernderten Hilfsstoff fr Patienten sicher, wirksam und pharmazeutisch unbedenklich sind. Validierung des Einsatzes alternativer Materialien: PFAS werden beispielsweise als Haftschutz auf der Innenseite von Schluchen verwendet, mit denen Flssigkeiten in Primrverpackungen abgefllt werden, sowie in der Massenproduktion. Beim Austausch des Schlauchmaterials msste dann nachgewiesen werden, dass keine Kontamination des neuen Schlauchmaterials in die Flssigkeit diffundiert und umgekehrt. Der daraus resultierende sehr langwierige und brokratische Aufwand fr neue Validierungen und Analysen wre enorm, sehr kostenintensiv und unverhltnismig. Konsequenzen etwaiger Verbote PFAS sind wichtige Wirkstoffe und werden zudem als Roh-, Vor-, Zwischen- und Hilfsstoffe fr verschiedene Endprodukte bei der Herstellung von Wirkstoffen, sowie in Medizinprodukten eingesetzt. Dabei mssen sowohl die Herstellung und Verwendung als auch anlagentechnische Aspekte bercksichtigt werden. Ohne klar beschriebene Ausnahmen knnte die Situation entstehen, dass Stoffe, die vom Anwendungsbereich ausgeschlossen sind, zwar erlaubt sind, aber die Herstellung innerhalb der EU aufgrund eines Verbots von Vorprodukten verboten ist. Dies wrde bedeuten, dass entsprechende Stoffe nur aus auereuropischen Lndern importiert werden knnten. Beispiele sind vom nationalen Gesetz bestimmte versorgungsnotwendige und versorgungskritische pharmazeutische Wirkstoffe u.a. zur Behandlung von Diabetes, Krebs, Multipler Sklerose und Rheuma, die derzeit noch in der EU oder in Deutschland hergestellt werden und der Versorgung des europischen Gesundheitssystems dienen. Dies wre dann nicht mehr mglich. Die Folge wre, dass die entsprechenden Produktionssttten geschlossen wrden, Arbeitspltze in der EU verloren gingen, derzeit geplante Investitionen in der EU nicht realisiert werden knnten und die Sitz des Verbandes - Friedrichstrae 148 - 10117 Berlin - Telefon-Zentral-Nr. +49 30 2 79 09 - 0 Seite 3 BPI Bundesverband der Pharmazeutischen Industrie e.V. Umwelt und Nachhaltigkeit Friedrichstrae 148 1 10117 Berlin 1 www.bpi.de Telefon: +49 l0j7 909-0 MPbpi.de pharmazeutischen Wirkstoffe aus Nicht-EU-Lndern - hier insbesondere aus Asien (vor allem China und Indien) - importiert werden mssten, was die kritische Abhngigkeit des europischen Gesundheitssystems von diesen Importen weiter erhhen wrde. Weiterhin besteht durch ein flchendeckendes und radikales Verbot von PFAS in Produktionsanlagen und Verbrauchsmaterialien die unmittelbare und reelle Gefahr, dass die Hersteller solcher PFAS-haltiger Anlagenteile (z.B. Dichtungsringe, Sterilfilter, Flssigkeitsverteiler in Kurzwegdestillationen, produktberhrende Filtermembranen bei der Wirkstoffherstellung, Gleitringdichtungen an den Rotoren der Flssig-Flssig Chromatographie bei der Wirkstoffaufreinigung) diese nicht mehr in gewohnten Mengen produzieren und verkaufen wrden und somit die Produktion aus wirtschaftlichen Grnden eingestellt werden wrde. Da diese Anlagenteile dann beispielsweise im Fall einer Wartung nicht mehr zur Verfgung stehen und es mglicherweise (noch) keine Alternativen gibt, wrde es mittelbar zu einem Stillstand der Produktionsanlagen kommen. Auch besteht durch selbiges Verbot von PFAS als Bestandteil von Hilfsstoffen oder Arzneimitteln bzw. Kombinationsprodukten (z.B. Membranen, Linern) oder Bestandteil der Packmittel von Arzneimitteln (z.B. Blisterfolien) die unmittelbare und reelle Gefahr, dass die Herstellung der betroffenen Produkte mit PFAS-haltigen Bestandteil (als Hilfsmittel, Excipient oder primres Packmittel) nicht mehr produziert und verkauft wrden und aufgrund fehlenden Alternativen die Produktion und Vermarktung eingestellt werden wrde. Somit wre die Herstellung und Verfgbarkeit von Arzneimitteln und damit die Patientenversorgung direkt betroffen, auch wenn fr die Wirkstoffe selbst im Beschrnkungsvorschlag per se eine Ausnahmegenehmigung vorgesehen ist. Es ist auerdem darauf hinzuweisen, dass die vorgeschlagenen Ausnahmeregelungen im Einzelfall zu betrachten sich. Beispielsweise medizinische Treibmittel (HFC 134c und HFC 227ea), der vorgeschlagene Zeitraum von 18 Monaten ist weder technisch noch wirtschaftlich fr betroffene Unternehmen realisierbar und wrde gleichermaen die Patientenversorgung in Europa und darber hinaus gefhrden. Es ist zudem zu bedenken, dass die Radikalitt des Restriction Proposals Innovationen behindert. Es ist nicht auszuschlieen, dass zuknftig hoch wirksame Arzneimittelwirkstoffe, die zwei oder drei Fluoratome (also eine fluorierte Methylengruppe oder eine fluorierte Methylgruppe) enthalten, entwickelt werden. Das Verbot ist also ein relevanter Einschnitt in die freie wirtschaftliche Entfaltung von Unternehmen in der Europischen Union und eine Bevorteilung von Unternehmen auerhalb der EU. Es ist geradezu paradox, dass die dann als Arzneimittelwirkstoffe deklarierten Substanzen wieder in die EU importiert werden drften. Zusammenfassend lsst sich festhalten, dass mit dem vorgeschlagenen Beschrnkungsvorschlag die Gefahr einer Abwanderung der pharmazeutischen Industrie in weniger streng regulierte Regionen wchst und Bestandsprodukte (Arzneimittel oder Kombinationsprodukt) mit langjhrigen Zulassungen (ohne Ersatz) vom Markt verschwinden. Polymere wie Polytetrafluorethylen (PTFE) sind nicht nur aufgrund ihrer technologischen Ausnahmestellung im Einsatz sondern auch wegen ihrer toxikologischen Unbedenklichkeit. Es erscheint daher keinesfalls berechtigt, sie aufgrund toxikologischer Eigenschaften anderer -- nur entfernt verwandter -- Molekle zu verbieten. Auch die Tatsache eines langsamen biotischen Abbaus und der daraus resultierenden Bedenken hinsichtlich der Anreicherung in biologischen Systemen wie Bden rechtfertigt dies nicht. Es ist darauf hinzuweisen, dass auch in Anhngen des Beschrnkungsvorschlages keine Daten hinterlegt sind, die darauf hindeuten, dass PTFE sich in biologischen Systemen anreichert. Auch in anderen europischen Reporten, wie HBM4EU oder den Daten zu PFAS in Gewssern, wird PTFE als Stoffgruppe nicht aufgefhrt. Es ist somit anzuzweifeln, ob PTFE, sich wie andere PFAS-Untergruppen, in biologischen Systemen anreichert. Die in der Begrndung des Restriction Proposals angefhrte Mobilitt in Wssern trifft fr polymere PFAS ohnehin nicht zu. Sollte es trotz dieser berlegungen zu einem Verbot von PTFE und anderer fluorhaltiger Polymere kommen, wre aus unserer Sicht eine permanente Ausnahme mglich, wenn durch ein Rcknahmesystem der in Industrieanlagen verwendeten Polymere der Eintrag in die Natur ausgeschlossen ist. Auch fr das andere Ende des Scope des Restriction Proposal gelten diese berlegungen: Es wird ernsthaft bezweifelt, dass Molekle, die zwei oder drei Fluoratome enthalten (bei einem mglichen Molekulargewicht von evtl. mehreren 100 dalton) die gleichen (umwelt-) toxikologischen Eigenschaften besitzen wie beispielsweise eine Perfluoroctansure, deren Verwendung zu Recht bereits heute beschrnkt ist. Generell wird zu klren sein, ob Eigenschaften einzelner Molekle in dem jetzt geplanten Umfang zu einem Verbot einer willkrlich definierten Substanzgruppe fhren drfen. Wir befrchten, dass im Falle eines Vollzugs des Restriction Proposals fr lange Jahre Rechtsunsicherheit wegen laufender Klageverfahren besteht. Gerade solche Rechtsunsicherheit ist fr Unternehmen mittlerer Gre eine Gefahr, da sie nicht wie multinationale Konzerne Produktionsverlagerungen in das EU-Ausland vornehmen knnen und ggf. nach Klrung wieder zurckholen. Hier wird auf die aktuelle Rechtsunsicherheit bei der Verwendung von Titandioxid in Arzneimitteln verwiesen. Es ist auerdem sicherzustellen, dass bereits bestehende Verordnungen und Regelungen beachtet werden, um eine berregulierung auszuschlieen. So regelt die bestehende europische F-Gase-Verordnung (517/2014) HFKW bereits umfassend. Aktuell befindet sich diese Verordnung in Revision. Damit wird sichergestellt werden, dass HFKW 134a und HFC 227ea (im Einklang mit der Kigali-nderung des Montrealer Protokolls) schrittweise heruntergefahren werden. Derzeit befinden sich zwei Treibmittel der nchsten Generation in der Entwicklung: HFC 152a und HFO 1234ze. HFC 152a ist nicht Gegenstand der PFASKonsultation. Es ist wichtig, dass alle PFAS-Beschrnkungen mit der F-Gase-Verordnung kohrent sind. Umwelt und Nachhaltigkeit Friedrichstrae 148 1 10117 Berlin 1 www.bpi.de Telefon: +49 l0j7 909-0 Mabpi.de Forderungen des BPI: Anpassung des Beschrnkungsvorschlags Zur Wahrung der Versorgungssicherheit mit Arzneimitteln und stoffgebundenen Medizinprodukten aus europischer Produktion und Herstellung, sollten fr die oben nachfolgenden Verwendungen gezielt unbefristete Ausnahmeregelungen von der Beschrnkung vorgesehen werden: Fr den Fall, dass polymere PFAS aufgrund ihrer toxikologischen Unbedenklichkeit nicht generell aus dem Restriction Proposal gestrichen werden, sollten PFAS-haltige Anlagenteile in Industrieanlagen inklusive der dafr ntigen Lieferkette ausgenommen werden Pharmazeutische Produktionsanlagen enthalten unzhlige PFAS-haltige Komponenten (Ersatzteile, Verschleiteile, Gebrauchtteile), die aus o. g Grnden nicht einfach ausgetauscht werden knnen. Es mssen daher zwingend unbefristete Ausnahmeregelungen fr alle PFAS-haltigen Komponenten in pharmazeutischen Produktionsanlagen implementiert werden. Verbrauchsmaterialien fr die Herstellung von Arzneimitteln Fr die Produktion von Arzneimitteln werden u.a. verschiedenste Verbrauchsmaterialien bentigt (z.B. Sterilfilter). Diese werden aktuell auch in Europa hergestellt. Es mssen daher zwingend unbefristete Ausnahmeregelungen fr alle PFAS-haltigen Verbrauchsmaterialien implementiert werden, die fr die Herstellung von Arzneimitteln obligatorisch sind. Dies dient auch der Nachhaltigkeit und Wirtschaftlichkeit industrieller Anlagen. Vor- und Zwischenprodukte fr die Herstellung von Arzneimitteln Die im Beschrnkungsvorschlag vorgeschlagenen unbefristeten Ausnahmeregelungen beziehen sich auf die Wirkstoffe selbst und umfassen nicht deren Herstellungsprozess. Es mssen daher zwingend Ausnahmeregelungen fr alle PFAS-haltigen Substanzen, deren Zwischenprodukte und Prozesshilfsmittel, die im Herstellungsprozess von Arzneimitteln bentigt werden, implementiert werden. Hilfsstoffe als Bestandteile von Arzneimitteln und Kombinationsprodukten In einigen Arzneimitteln oder Kombinationsprodukten zhlen PFAS-haltige Beschichtungen zu den Hilfsstoffen als Bestandteil des Arzneimittels oder Kombinationsproduktes selbst, auch wenn diese teilweise vor Anwendung wieder entfernt werden (z.B. Schutzfolien bei transdermalen Systemen). Ebenfalls werden PFAS-haltige Beschichtungen in primren Packmitteln eingesetzt. Es mssen daher zwingend unbefristete Ausnahmeregelungen fr alle PFAS-haltigen Komponenten in pharmazeutischen Produkten oder deren primren Verpackung implementiert werden. Es muss bei Ausnahmeregelungen ausreichend Zeit eingerumt werden. Denn, wenn die Notwendigkeit einer Ausnahmeregelung zwar gesehen, dann aber in einem zeitlich unzureichenden Ma definiert wird, kann das Ziel der Sicherstellung der Patientenversorgung nicht erreicht werden. Fr die Entwicklung von Ersatzprodukten brauchen Unternehmen aus reichend Zeit, dies schliet die Zulassung durch die Arzneimittelbehrden und die nahtlose und sichere Umstellung in der Patientenversorgung mit ein.
