Previous Enforcement Actions: None III. Type and Purpose of Inspection The U.S. Environmental Protection Agency (EPA) conducted this inspection to evaluate compliance with the 2017 Construction General Permit. IV. Facility Description Strawberry Hill Subdivison is located east of Rt. 137 in Harwich, MA. The development will be comprised of ten single family residential homes, each on a one - acre lot. The site is approximately thirteen acres. At the time of the inspection, the site had been cleared and stripped. The site slopes upward, east of Rt. 137, and then curves south. The homes will be located along the south side of the site, and the new road will be constructed on the north edge of the site. The soil is sandy throughout the site. V. Inspection I announced the inspection to the facility on Monday, August 2, 2021 with a voicemail to Mr. Don Poyant, site operator. I received a call back from Mr. Bill Marsh, the developer of the site and owner of Eastward Homes Business Trust. Mr. Marsh requested that I come inspect August 5th instead of August 3rd so he could have someone on site with me. I obliged and agreed to inspect on August 5th at 10AM. I arrived at approximately 10AM on August 5th. A. Opening Conference Mr. Bryan Barrows was already on site; he also works for Eastward Homes Business Trust and is conducting the excavating. Shortly after, Mr. Don Poyant arrived. I asked if Mr. Marsh would be joining us, and he said it would just be the three of us. I presented my credentials, provided a copy of the Small Business Resources Information Sheet, and explained the purpose of the inspection. I asked them to tell me a about the timeline of the site construction. Mr. Poyant said that they began clearing the site mid - June and planned to begin building the third week of August. The site, prior to the beginning of construction, was forested. B. Facility Tour We began the facility tour by walking to the location of the Stormwater Pollution Prevention Plan (SWPPP). The SWPPP, along with the permit number, was located in a box attached to the company sign (IMG_0503). I skimmed the SWPPP and located the 2 ED_019088A_00020641-00002 pages that were authorized with signatures (IMG_0506, IMG_0507), and asked Mr. Poyant to email me a copy of the SWPPP and inspection reports for offsite review. I asked how often Mr. Poyant does inspections, and he said he does them after every major rainfall. I asked if he felt he was qualified to conduct the inspections of the stormwater controls, and he said he has been in the business for over 20 years and understands stormwater controls and knows what to look for. We then walked eastward, towards the back of the site. On the north side by the entrance, a retention pond had been constructed (IMG_0509). Mr. Barrows said that this pond would be a permanent pond. I observed stockpiles (IMG_513). I asked if the piles were actively being worked on, which Mr. Barrows responded yes. I reminded them that if the piles go inactive for fourteen days or more, they need to stabilize them. Mr. Barrows said they would likely hydroseed. The site appeared to be graded to a little below the surrounding terrain. As we walked towards the back of the site, I observed silt fences along the north edge (IMG_0508). I asked Mr. Poyant what he has observed in terms of flow patterns during a storm event. Mr. Poyant said that the water infiltrates, and that he usually only sees a few puddles. During my site walk, I did not observe any flow offsite. We reached the eastward end of the site, before it curves southward. Mr. Barrows pointed to a downslope area where they plan to install silt fences once they begin the road construction because the road will be at a higher elevation than the existing grade (IMG_0521). Mr. Barrows also pointed to the area where there will be a depression dug for stormwater control. As we walked back towards the entrance, I asked about on site catch basins that they plan to install. Mr. Poyant explained that all the catch basins will drain to leeching basins or ponds on site. I asked which entity would be responsible for ensuring the appropriate stormwater controls as they build the homes. Mr. Poyant stated that they are the exclusive home builders, and they will be responsible. C. Closing Conference I explained to Mr. Poyant and Mr. Barrows that I would write a report and send them a copy and follow up with any additional concerns. Mr. Poyant said he would email me a copy of the SWPPP and inspection reports. I thanked them for their time, and I departed at approximately 10:45 AM.
