Ballentine, EPA, Washington, to determine the status of activities relating to PCB effluent standards. He informs me that very little has transpired during the past three months, with most of the EPA activity apparently centering in their legal department. Mr. Ballentine gave me the following information: (1) The Environmental Defense Fund has filed for a summary Judgment relating to thelrlawsuits filed in Chicago and Washington. This action has apparently caused considerable concern with the EPA legal staff. (2) The "basis and purpose" document, which contains the technical information upon which the standards are to be based,is being completely rewritten. At present a draft is not available. (3) The EPA, on legal advice, has abandoned the idea of publishing "Advance Notice of Proposed Regulation." (4) The current thinking within EPA is to publish separate effluent standards for smaller categories of point sources. For example, the PCB standards could be published separately for the producer, capacitor and transformer manufacturer, and the user of the capacitors and transformers.
