T h is p r e s e n t a t i o n wa3 v e r y b r i e f and co u ld n o t be c o n s id e re d a s a vigorous defense o r ju s ti f ic a t io n fo r Imposing the ban. Dow th e n p re s e n te d t h e i r c a se on why th e ban sh o u ld be l i f t e d on EC-7 . Dow*3 argum ents were In fo u r c a te g o r ie s : T oxicology; A n a ly tic a l; Use Technology; and Economic Consequences. They had s e p a ra te w itn e sse s p re s e n t in each o f th e se fo u r a r e a s . Dr. Gehring then re la te d the observed e ffe c ts noted in the LeMunyon h e rd to known e f f e c t s o f d io x in s . T h is p a r t o f h i s p r e s e n ta tio n was s t r i c t l y second hand, most o btained from d iscu ssio n s w ith th e s ta te in v e s tig a tin g group who o b serv ed th e LeMunyon h e r d . The o v e r a l l t h r u s t o f t h i s p r e s e n ta tio n was th a t p en ta w ith m inim al le v e ls o f d io x in would e lim in a te the problem s observed in M ichigan cows. D r. G eh rin g a l s o rem arked t h a t th e LeMunyon s i t u a t i o n a p p ea red to be an u n u su al case in th a t th e re was ev id en ce o f an o ily f ilm exuding from the t r e a t e d wood and I n d ic a te d t h a t t h i s i s n o t ty p i c a l p e n ta t r e a t e d wood. ECONOMIC CONSEQUENCES Mr. M arvin E . W ln q u is t, Dow's B u sin ess Manager f o r P e n ta , r e p o r te d t h a t Dow sto p p e d producing Dowicide 7 in December *75, and sin c e th a t tim e have only produced Dowicide EC-7. He s t a t e d t h a t an a d d i tio n a l s te p was needed to produce th e EC-7 m a te r ia l and t h a t t h i s added a p p ro x im a te ly 10 to 15Z to th e c o s t o f p e n ta . He a l s o s a id th a t very few people had been w illin g to pay e x tra fo r the p u rifie d p ro d u ct. Both b e fo re and a f t e r th e h e a rin g , he contended i t was in a p p ro p ria te f o r th e S ta te to a c t on the p e titio n o f one producer, but th a t according to th e s ta tu e s under which th e S ta te suspended penta on an emergency b a s is , th ey were re q u ire d to hold a p u b lic h earin g to p resen t the reasons fo r imposing th e .b a n .
