PLAINTIFF'S EXHIBIT 1983-9-12 RE: COMMUNICATIONS INVOLVING EXPOSURE TO ASBESTOS Following is generally heresay evidence involving a supposed large number of our employees. Over the past several years there has been periodic articles in the newspaper (Advocate) about asbestos exposure and litigation (Federal Court, Victoria & Tyler, Texas). No decisions, no awards, etc., just a lot of talk about exposed workers and the asbestos mfg. This A.M. I stopped a "mason" I know well who was working in Bldg. 1 and we talked a minute or two when he said "they" finally got some settlements out of one of the mfg's of asbestos and something about a worker (Pt. Comfort employee dying a year or two ago) pulmonary (cancer?) that got a judge to ok the offer of some $6400.00 and now the word has gone out to inform the industrial work force to determine exposure and possible positive physical exam results for asbestos. Some names I heard were Donald Williams, Juan Salatar. Understand there was a meeting held at Holiday Inn : Port Lavaca last Friday noon. A sitable number (50) salaried and hourly employees attended. /Also there has been meeting (regular Union meeting, but discussed the asbestos situation -- with hand-outs and questionnaire to fill out). If the worker was in the Potrooms prior to 19~4, then they may be scheduled for a physical exam in Marshall, Texas. I understand there were *soue 3-4 hundred signing up .`Alcoa active and retired employees). Only 5 can be physic3'eJ per day so it appears to be a lengthy process. A Ms. Becky Williams from Marshall was the individual signing up people. I called her office this A.M. and she was away in Mississippi on business, but they wanted my name to sign up for a interview. We did find out that the Holiday Inn reservations were made in the name of Jones-Jones 5 Baldwin and one of my legal contacts said this is the legal firm very heavily involved in the asbestos litigation. (I also found out that Commercial Union also has some big legal guns in the area of asbestos litigation). Wratislaw, John Schoenherr, (a retired Alcoan "Warren" was said to be organizing retirees)., Machicek. 1983-9-27 ' I called Ms. Becky Williams again -- still in Mississippi. 1983-9-28 Becky Williams' office called me asking if I wanted to make an appointment I told the lady who I was and she clamed up w/the reply that Mr. Baldwin would call me back later. 1985-9-29 Received a call from Scott Baldwin, Legal Firm of Jones, Jones 8 Baldwin, Marshall, Texas. I told Baldwin who I was and my Department. That I :ad received a number of inquiries from employees as to who to see and wh.ee to sign up for this asbestos thing. I said I thought we deserved to kn what was going on w/our employees who may have been given some false . ipectations, etc. Baldwin apologized saying he would be glad to explain everything to me. He said he is the attorney from Marshall who has led the way in the asbestos litigation initially from Tyler, Texas (for a number of years; 8-10 years). Cont'd from Scott Baldwin; A couple or so years ago Jimmy Smith, local attorney, contacted him (Baldwin) asking if he would represent a number of local workers that he (Smith) had. Baldwin said he would and they did succeed in attaining a small settlement (S6400.00) for those few claimants. Baldwin said that word evidently spread very fast because his office was getting swamped w/phone calls inquiring about a same or similar settlement. Baldwin said the prior claimants were encouraged to accept this settlement since no one knows how long the money will hold out. Also, in accepting this court settlement, future W/C claims on asbestos, cancer, would be offset and also W/C medical coverage would be in question. Baldwin said he lias discouraged any involvement in W/C, up to this point and time. APC2 03743 Baldwin has continued to work very closely w/Jimmy Smith, and since there was such a large number of inquiries, he decided to dispatch one of his employees, Becky Williams, to Port Lavaca, to answer quest ions and sign up people. I mentioned some inquiries I had about exposures to asbestos Cprior to 1974 exposures). - Baldwin said, really 1972 was the year that asbestos sales were outlawed but it took a couple of years to get rid of inventories at industrial sites. ' . _ Generally, Baldwin siad that if a worker was exposed 5-6 years prior to 1972-"4, and if there is a positive asbestos finding via medical exam, then they will likely sign that person up. -- ....... .. Baldwin said, asbestos- litigation is currently underway in Houston, Texas but that court is holding up waiting to see what action is. going to be taken in the John Mansfield bankruptcy proceedings up East. Baldwin said this is a lengthy legal process but may at some future date contact me or someone here about personnel and medical records., I replied that Alcoa has pretty standard procedures on that matter, and that's usually via court subpoena.
