March 21, 1979 Pursuant to notice, a meeting of the Board of Directors was held March 21, 1979, at the Dulles Marriott Hotel, Dulles International Airport, Washington, D.C. Minutes On motion, the minutes of the previous meeting, December 13, 1978, were approved as submitted. CAPCO JEN 0018624 Page 2 Financial Report The financial statement for the period ending February 28, 1979, was reviewed by the Executive Director and accepted on motion. Staff Report OSHA - Consideration is being given by OSHA officials to release of the RTI-CONSAD consolidated report. Purported reasons being the dated nature of information contained in the report, and the fact that it does not fulfill the requirements of a regulatory analysis as described in Executive Order 12044. Release of the report will not initiate the regulatory process. There is no change in status of draft proposal for the construction industry from that reported at last meeting. The above factors, and other OSHA priorities, combine to make it unclear when public hearing on revision to the asbestos standard(s) will occur. EPA - The asbestos review within the Office of Toxic Substances (OTS) is now in its fourth draft. While no date has been scheduled for its review by the priorities committee, such may be scheduled during April. OTS, in coordination with OSHA, is also preparing a development plan for a proposed generic labeling rule. Attention of project officer has been invited to labeling requirements for the asbes tos industry already contained in OSHA and EPA standards. EPA is expected to schedule informal public meetings on a generic labeling proposal in the near future. Administrator Douglas M. Costle announced March 16 the voluntary EPA program to provide technical assistance to state and local school officials for the prevention of exposure of children to hazardous asbestos-containing materials in some schools. The program includes a guidance document containing a step-by-step procedure for identifying and correcting asbestos exposure problems in a building. It will be distributed to all school districts in the U.S. The program also includes a toll-free telephone (800-424-9065) to answer questions about asbestos in schools and to fill requests for guidance packages. DOT - The Department of Transportation is expected to publish wTthin two weeks its response to petitions regarding the Decem ber 4, 1978 final rule on the transportation of asbestos. The rule restricts the way in which commercial asbestos may be packaged for transport and requires a designation to be placed on each package. (Note: The DOT amended its final rule on the transportation of asbestos and postponed its effective date by publication of an amendment in the Federal Register, March 29, 1979.) CPSC - The final subtask of the Battelle work order on consumer products for the Consumer Product Safety Commission has been received by the Commission. The study concerns asbestos cement products (pipe, sheet, related products and their household uses), "millboard" products and lumber related products (plywood patch, filler or composition board). The study will be released within one week according to a CPSC spokesman. (Note: Study was forwarded to Executive Committee on March 30.) CAPCO JEN 0018625 Page 3 NIEHS - Attention was invited to recent news clip in folders on status of ingestion study being conducted under direction of National Institute for Environmental Health Sciences. Report was given on a conference to be held at the National Institutes of Health campus on March 29. The conference is titled "Sci entific Basis for Public Health Control of Environmental Asbestos Hazards." U.S. Navy - Meetings between industry and Navy representatives occurred on February 22, March 7 and March 8 regarding the Navy's substitute policy for asbestos-containing products. Two letters of interest were included in folders. A further meeting involving technical representatives to discuss details of recommended work practices is anticipated in the near future. (Note: This meeting is scheduled for May 10.) Congressional Activities - H.R. 1524, "The Asbestos School Hazard Detection and Control Act of 1979," with its requirement of con tribution into an Asbestos Hazards Detection Fund from "any company which was engaged, during the period 1946 through 1972, in the mining, refining or importation of asbestos" passed the Subcommittee on Elementary, Secondary and Vocational Education March 7. Markup in full Committee on Education and Labor is scheduled for March 29. (Note: The Committee debated the bill but did not take action on March 29. A rescheduled markup session is not expected before May 1.) The House Education and Labor Subcommittee on Labor standards under chairmanship Rep. Edward P. Beard (D-RI) has scheduled seven days of hearings on asbestos in the next six months. These are part of a set of "information and oversight" hearings on several occupational diseases including byssinosis (brown lung disease) from exposure to cotton dust and dermatosis. The asbestos segment of the hearings begins on May 1 with medical testimony on asbestosis scheduled to be given by representatives of Department of Health, Education and Welfare and National Institute of Occupational Safety and Health, Dr. Irving J. Selikoff, Director, Environmental Sciences Laboratory, Mount Sinai School of Medicine, and Dr. Leon Condor, Chief of Internal Medicine, University of Pennsylvania. The hearing on asbestosis will continue on May 2 with testimony offered by union officials. In addition. Dr. Hans Weill will testify. On May 8 hearings will feature testimony from various representatives of industry and government on issue of liability. Dr. Paul Kotin, J-M Corp., will also testify. Asbestosis and other occupational diseases are the subjects of two days of hearings in Long Beach, CA, July 6 and 7. In addi tion, Providence, RI, will be the site of hearings on Oct. 1 and 2 on asbestos, lacquer and other occupational hazards. Connecticut - Asbestos regulatory proposalfor an ambient air standard has a low priority as it was not part of a non-attain ment area for the State Implementation Pla_n. __ A spokesman in the State Department of Environmental Protection stated that most likely the proposal on asbestos would not be acted" on for the foreseeable future. CAPCO JEN 0018626 Page -4- Virginia - A hearing was held in Richmond on March 8 on the Board of Health proposed reporting requirement for organizations using/manufacturing more than 1000 kg/year of asbestos. AIA/NA participated in the hearing. Further Association comments for the record which closes April 6 were circulated for approval. The Board of Health plans to act on the proposal in late May. (Note: AIA/NA comments were submitted on April 2.) Kentucky - AIA/NA was represented at a hearing in Frankfort in January on a proposed State Implementation Plan. Included in the proposed plan were regulations for asbestos identical to those of the U.S. Environmental Protection Agency's (EPA) National Emissions Standards for Hazardous Air Pollutants (NESHAPS) for asbestos. The asbestos proposal has not been altered as a result of the hearing. Approval of the State Implementation Plan must be given by the EPA by July 1, 1979. Resolutions Adopted 1. Membership dues structure for fiscal 1979 was approved on motion (see enclosure). 2. Draft Association response to OSHA regarding recent release (Labor Press - Column 11) was approved. 3. A financial contribution of $5,000 in support of an asbestos study by the National Academy of Sciences was approved on motion Miscellaneous Other reports and discussions in accordance with agenda. Dr. Hans Weill was luncheon speaker. Other Business The next meeting of the Board of Directors will be held June 13, 1979, at the Ramada Inn, 901 N. Fairfax Street, Alexandria, VA.
