S. District Court at Dayton dismissed and our best information is that the decision of the court v/as that they were covered b y the Workmen *s Compensation Law and that they had no remedy at common law. As you know, we have been paying Ross something right along and do not intend taking any arbitrary stand just because of this favorable decision, although we do rather strongly feel that we are being imposed upon b y 4 H t and that he could work if he wanted to. However, you will note tffi.t Mr. Cowden has thought it advisable to have an examination of him made b y you and Dr. Brower. Mr. McEvoy, who is, in addition to the title referred to in the letter, also the General Attorney for General Motors, is agreeable to such examination and wanted to know my viewpoint. I wired him and also Mr. Cowden that I thought it was a good plan in order that we might have the best and uptodate information as to his physical condition.
