In summarizing my telephone conversation with you regarding
the
above
I
would
like
to make
comments
the following
1
I do not believe it would be too easy to secure the
customer's signature on such an agreement
a 2 I find no fault with the content of the which and I particularly like the flexibiliw that first page gives regarding the
might be performed
agrements agreements eam : .
which benefits to 3 As you know we in this department the middle on this matter The benefits
our de-
nonexistent partment are practically
We perform
these duties merely as a service to the operating
divisions While we are happy to
operating
customers
divisions it does
as a favor
occasionally
them to them raise
this for the
andet havoc with
our scheduling of our normal house work load
I would suggest that since the operating divisions
are the direct benefactors it might be a good idea
to discuss with them the effects on such an indemni-
fication
policy
Fs
Lied
I am sending a copy of this memo as well as a copy of your
draft to Monroe Harris since that is the division which
makes the largest number of requests Asbestos Fibre Division and Filtration and Minerals We also do have
some involvement with the divisions which market asbestos
cement pipe and board

The attached letter with pamphlets was sent to Crowle
Fittings Limited approximately one year ago due to theenvironmetal
concern that we had about the unfavourable environmental
conditions existing in that plant at the time Crowle
fabricates fittings from asbestos cement pipe purchased from Manville While their operations are not large
:
they are a substantial customer I recently visited the
plant again and found that the environmental conditions
are still far from satisfactory I am prepared to assign
our Environmental Engineer from the visit Crowle with the objective of towards correcting their situation
Toronto Plant to making recommendations
am however con-
that corne shod uld some years from now a lawsuit develop
on b~ h^lfof the employees that the company take the
attitude that they did everything that Manville
;
told us to do
I would like your recommendation as to how I should handle
this situation which presumably would be a letter outlining the conditions under which our Environmental Engineer
would provide them assistance

J. H. Lonnquist is an attorney in the Legal Department I met with he and Jeff Brown last Thursday and we discussed
this memo vin speaker phone with Bill Reitze
Our insurance carrier thru Walt Curtner apparently raised
the issue of our performing advisory services to customers
in
the Asbestos
and
Health area
and

liability
It is his opinion that we need to protect ourselves with a
hold harmless type contract
We currently provide a professional
type service thru
thru Reitze's group and Joe Goldfield and a professional
service thru M.D. Webb's group our salesmen and the
Headquarters staff It was agreed that Reitze's group and
Goldfield should be covered because they run tests make
they recommendations etc. repres ree pren set nt themselves as
professionals In the work that the rest of us do is along
the same line that our Field Service Representatives did in
Fipe We undoubtedly accept some risk in providing this
service It is suggested that we continue to accept this risk
as a risk of doing business
,
_ If this approach is acceptable to you I will review the
in situation with those concerned our group to make certain
we are using procedures that will minimize our

S ject INDUSTRIAL HYGIENE SERVICES PERFORMED FOR OUTSIDE PARTIES
Attached are cover letters which accompany the industrial
hygiene reports On three of these outside jobs you will note our method for handling is different In some our correspondence is directed to the person in charge of the operation that was surveyed and in other cases it is directed to one of our own sales personnel who then
conveys the information to the proper persons
I must admit that I am less enthusiastic about other than
a direct contact with the person in charge of the operation surveyed If we communicate through our marketing personnel
I am not always sure that we have done all we can to make
he the individual conscious of whether
Do you have any advice
has a problem or not
