No facility representatives were present at the time of the inspection. The inspection was conducted by the authority of the Clean Water Act (CWA) to determine compliance with Environmental Protection Agency (EPA) regulations. There were no other federal, state, or local agency representatives present at the time of the inspection. FACILITY DESCRIPTION EPA conducted an inspection at the Pharr, Billy W (dba B Pharr Operating, LLC) / Kress City Warnock SWD #1 SWD, which consists of two (2) storage tanks, one (1) separator, and one (1) saltwater disposal (SWD) injection well. An additional two (2) storage tanks at the facility appeared to be "out of service" or "not in use." Section II - OBSERVATIONS I observed the facility, associated signage, the SWD injection well, separator, storage tanks and secondary containment; see Appendix 1 (Photograph Log), Photo No. 1 through No. 5. For additional GPS location and photo metadata, see Appendix 1. I observed two (2) storage tanks that appeared to be "out of service" or "not in use," see Photo No. 5. I observed a secondary containment discharge valve that was capped, see Photo No. 6. I observed another secondary containment discharge valve that was in the closed position but not capped, see Photo No. 7. I observed a flow path from the discharge valve that indicates that the operator discharges fluids from secondary containment, see Photo No. 8. Section III - AREAS OF CONCERN No closing conference was held due to no Pharr, Billy W / B Pharr Operating, LLC staff present during the inspection. Areas of concern at the time of the inspection are: Tanks that appeared "out of service" or "not in use." The uncapped secondary containment discharge valve. If the operator is attempting to permanently close the tanks, then 40 CFR 112.2 of the Spill Prevention Control and Countermeasure (SPCC) rule requires that: "(1) all liquid and sludge have been removed from each container and connecting line; and (2) all connecting lines and piping have been disconnected from the container and blanked off, all valves (except ventilation valves) have been closed and locked, and (3) conspicuous signs have been posted on each container stating that it is a permanently closed container and noting the date of closure." 2 Pharr, Billy W (dba B Pharr Operating, LLC) / Kress City Warnock SWD #1 SWD (ARU002347 / CWA) Inspection Date 01/12/2026 Section IV - FOLLOW UP Inspector will conduct follow-up phone calls with the company representatives over the coming weeks and months to ensure areas of concern are properly addressed.
