ANSWER: Defendant C.L. Zimmerman Co. was incorporated in Ohio on April 11, 1968 to operate the business acquired by Browning Middleton from Courtney L. Zimmerman, which was a sole proprietorship doing business as C.L. Zimmerman Co. The sole proprietorship was formed in 1927. Thereafter Defendant C.L. Zimmerman Co. was a manufacturers' representative and sold its business and assets to C.L. Zimmerman Co., a Delaware corporation, in May of 1999. Defendant C.L. Zimmerman Co. and its predecessor acted as a broker of asbestos from 1939 until 1976, serving as a manufacturer's representative for-Asbestos Corporation Ltd., a Canadian mining company. Under this arrangement, Defendant C.L. Zimmerman Co. and its predecessor solicited orders for asbestos which were forwarded to Asbestos Corporation Ltd., for acceptance. If Asbestos Corporation Ltd. accepted an order, it then shipped raw asbestos to the purchaser, billed the purchaser, and later remitted commissions to Defendant C.L. Zimmerman Co. and its predecessor. Neither Defendant C.L. Zimmerman Co. nor its predecessor took title to, or possession of, the asbestos. 4. ANSWER: Yes. (a) C.L. Zimmerman Company and its predecessor acted as a manufacturer's representative for Asbestos Corporation Ltd., a Canadian Mining Corporation. (b)(1) Asbestos. (b)(2) None. Zimmerman Co. solicited orders from Delco Moraine ( a division or subsidiary of General Motors Corporation) in Dayton, Ohio and Inland Manufacturing Company in Dayton, Ohio. Defendant C.L. Zimmerman did not sell any product but merely solicited orders for acceptance by Asbestos Corporation Ltd. (b) Defendant C.L. Zimmerman Co. solicited orders for'chrysolite from the Co-defendants named in answer (a) above. (c) Defendant C.L. Zimmerman Co. cannot confirm the sale of any products on any specific dates. (e) None in possession of Defendant. 8.3 If you do not know any business that may have marketed, distributed, installed, and/or sold the products listed in response to Interrogatory No. 5 to any of the job sites listed on Exhibit A, please state the names and last known addresses of those companies who Defendant knows marketed, distributed, installed and/or sold their asbestos:containing products in Ohio from 1950 to 1974. For each of those companies, please state the following: (a) Name and address of each such company; (b) The dates of each sale from Defendant to such other company; (c) The name of the person at each other company with whom Defendant primarily dealt; (d) The names of the asbestos-containing products that Defendant marketed, distributed, and/or sold to each such company from 1950 to 1974. Did Defendant or any of Defendant's distributors, as listed in response to Interrogatory Nos. 8.1, 8.2, and/or 8.3 have sales representatives who specifically called on the sites listed on Exhibit A, attached hereto, from 1945 to 1975? If your response is yes, as to each site listed on Exhibit A, please state the following: (a) The name and last known address of each such representative and whether they are still employed by Defendant; (b) The period of time they acted as your representative; (c) Their general responsibility as to each facility; (d) Whether that person is still alive; and (e) Any documents relating, referring or pertaining thereto. ANSWER: Yes. (a) Defendant C.L. Zimmerman Co. has not acted as a manufacturer's representative soliciting orders for asbestos since 1976. The ownership of Defendant C.L. Zimmerman Co. has changed since that date and the corporation ceased business operations in May of 1999. Most of PLAINTIFF'S MASTER SET OF INTERROGATORIES PROPOUNDED TO C. L. Zimmerman Co. were delivered to the purchaser of the business and assets of Defendant C.L. Zimmerman Co. in May of 1999 (23 years after Defendant C.L. Zimmerman Co. had ceased all involvement with sales of asbestos). The information sought in Question 9 is very old and the remaining officer of Defendant C.L. Zimmerman Co. is providing the following answers to the best of his memory. Defendant C.L. Zimmerman Co. acted as a manufacturer's representative regarding asbestos sales and was not a large organization. The individuals listed below were, at various times, the owners and chief executive officers of Defendant C.L. Zimmerman Co. and its predecessor, made sale calls, and would have had ultimate responsibility for the solicitation of orders for asbestos from the customers and at the sites listed in Answer No. 8.04. Defendant C.L. Zimmerman Co. does not know the address of said individuals and believes that each of them is deceased. None of them is currently employed by Defendant C.L. Zimmerman Co. Courtney L.
