Article 6 under Academic Freedom and Responsibilitv the following: 6.1 The University and United Academics agree that academic freedom is essential to the mission of the University and that providing an environment of free and honest inquiry is essential to its functioning Nothing contained in this Agreement shall be construed to limit or abridge any individual's right to free speech or to infringe upon the academic freedom of any member of the l mversity community And 6.3 The University of Alaska and United Academics endorse the " 1940 Statement of Principles on Academic Freedom and Tenure with 1970 Interpretive Comments," issued by the American Association of University Professors and the Association o f American Colleges, . Furthermore, the American Association o f University Professors (AAUP) the " 1940 statement o f Principles on Academic Freedom and Tenure, is the following. P 14, 1st column: Also there have been relevant developments in the law itself reflected a growing insistence by the courts on due process within the academic community which parallels the essential concepts o f the 1940 "Statement" particularly relevant is the identification o f the supreme court o f academic freedom as a right protected by the first amendment As the Supreme Court said in Keyishian v board o f regents, 385, U S 589 ( 1967), "Our nation is deeply committed to safeguarding academic freedom, which is o f transcendent value to all o f us and not merely to the teachers concerned That freedom is therefore a special concern o f the First Amendment, which does not tolerate I cast a pall o f orthodoxy over the classroom ' U N I V E R S I T Y OF A L A S K A F A I R B A N K S
