The rule reduces the NOx emission limit to 20 parts per million by volume for all units supplied, sold, installed, or modified, effective Jan. 1,2019. The rule also adds an exemption for recreational vehicles, manufactured homes, hot water pressure washers, and portable water heaters used for underwater diving activities. The rule incorporates by reference the 2015 edition of the National Boiler Inspection Code and expands the inspection frequency for vessels exceeding 200 psi of maximum allowable working pressure to every five years. The rule also expands the inspection frequency for hot water storage tanks, sterilizers, and autoclaves to every four years and for pressure vessels for human occupancy and hyperbaric chambers to every two years. The rule incorporates by reference the 2015 edition of the National Boiler Inspection Code and exempts pressure vessels with an American Society of Mechanical Engineers "UM" stamp from the requirement for a manufacturer's data report. The rule also clarifies the hours when inspections are conducted. In addition, the rule requires any new boiler added to an existing boiler room to be connected to an emergency off switch; allows such switches to be located inside or outside of a boiler room; and provides that the boiler must indicate the boiler is disabled when the switch is activated. EPA, 1:17-cv-01906 ED_001523_00001340-00007 Final rule of the Department of the Environment amends regulations under COMAR 26.11.32.01 through .16 (nonconsecutive) and adopts regulations under COMAR 26.11.32.05-1 regarding controlling volatile organic compound (VOC) emissions from consumer products. The rule implements requirements from the 2010 and 2014 Ozone Transport Commission model rules for consumer products to establish VOC standards for 11 consumer products and update VOC standards for 15 consumer products. The rule also prohibits the sale, offer for sale, supply, or manufacturing for use in the state of specified products that contain methylene chloride, perchloroethylene, or trichloroethylene. The rule will be submitted to the EPA as a revision to the state implementation plan. The rule is effective Oct. 9, 2017. The first permit authorizes the discharge of stormwater from storage tank dikes and loading rack areas and hydrostatic test water to surface or groundwaters from petroleum tunnels and sets limits on the concentration of the petroleum product contamination following treatment. The second permit authorizes the discharge of treated groundwater previously contaminated by petroleum products as the result of leaks or spills and sets limits on the effluent concentration of the petroleum production contamination following treatment. The rule establishes requirements for licensing of consultants and revises the categories established for the licensing of pest control personnel and licensed primary principal commercial applicators. The rule also revises the definition of "termiticide" and sets forth registration and labeling requirements for termiticides. In addition, the rule establishes requirements for transport of undiluted pesticide material, revises the term "spot treatment," and adds soil fumigation to the categories for licensing pest control personnel. Finally, the rule addresses prohibited materials and uses of pesticides, updates and expands the schedule of fines, and clarifies language. The changes specify that the licensed consultants may not write or otherwise prepare a plan for the conservation, preservation, or reclamation of property. The rule revises the list of RTAPs and their ambient air limits (AALs) to reflect updates by the American Conference of Governmental Industrial Hygienists and the EPA's Integrated Risk Information System. The rule adds 28 chemical substances to the RTAP list, removes 4 chemical substances, and revises the occupational exposure limit or reference concentration for 20 substances. The rule also adds definitions, adds and clarifies exemptions, aligns chemical classification criteria for health related assessments with EPA requirements, and corrects the table of RTAPs. The rule clarifies provisions concerning electronic filing and service to reflect the electronic registration form. The rule also specifies that when a filing deadline falls on a Saturday, Sunday, or legal holiday, the document filing and motion response deadline is the next business day. In addition, the rule establishes the format and time period for filing requests for certification of interlocutory orders for appeal and addresses filing of requests for certification of such orders. Finally, the rule provides for the institution of appeals filing of a notice of appeal or complaint depending on the underlying statute, eliminates the 20-day time frame for filing a petition for review with the Commonwealth Court, and clarifies that the board makes the determination of a dismissal with or without prejudice on a case-by-case basis. The rule updates standards for sampling, testing, and remediation of quarantined methamphetamine manufacturing sites and addresses qualifications for cleanup professionals. The rule also provides for maintenance of the list of contaminated sites and the list of qualified professionals and establishes listing fees for certified industrial hygienists. In addition, the rule addresses standards for determining whether a space is safe for human use, variances for property owners to preform remediation, and certificates for demolition for disposal of construction or demolition debris. The rule restricts credit generation from inelastic sources and prohibits credit generation from activities that do not result in actual emissions reductions. The rule also requires credited reductions to be certified through federally enforceable documentation procedures.
