This e-mail is being sent to Committee Members of the EPA Chemical Data Reporting (CDR) Inorganic Byproducts Negotiated Rulemaking and people who were interviewed early in the process, observed meetings or asked to be on the communication distribution list.
We are forwarding information below from EPA on the official cancellation of the October meeting and opening of the docket for public input. EPA welcomes input from Committee Members as well as members of the public. While EPA would appreciate input before the end of the month, the docket will be open until December 11. Note that there was a question about our framing of "Stakeholder Reports" in our previous email. This was just meant to refer to comments from individual Committee Members or groups of Committee Members that will be added to the public docket. Attached is a slightly updated meeting summary, in which we clarified this and added Committee Members who were unable to attend the final meeting, as requested. This summary should be added to the docket early next week.

EPA is cancelling the remaining scheduled meeting of the Negotiated Rulemaking Committee to Negotiate a Proposed Rule to Limit Chemical Data Reporting (CDR) Requirements for Certain Inorganic Byproducts. The meeting was scheduled for October 25 to 26, 2017. EPA is cancelling this meeting because the Committee determined that it was not able to reach consensus on regulatory approaches and concluded its discussions, which were required by TSCA and which were conducted in good faith. While the negotiated rulemaking process is concluding and will not be reopened, EPA is providing additional opportunity for the public to offer input for 60 days about approaches that would reduce reporting burden while maintaining the Agency's ability to receive the information it needs to understand exposure.
The objective of the Committee was to negotiate a proposed rule that would limit chemical data reporting requirements, under subsection 8(a) of the Toxic Substances Control Act (TSCA), for manufacturers of any inorganic byproducts when such byproducts are subsequently recycled, reused, or reprocessed. This negotiation process was required by TSCA, as amended by the Frank R. Lautenberg Chemical Safety for the 2 iss Century Act.
The Committee was formally convened as a Federal Advisory Committee in June 2017, following a six-month process of public notification, identification and engagement with potential Committee members, and

development of a balanced membership. It met three times from June through September 2017. These materials, as well as additional materials such as the Committee's charter and meeting summaries, are available in docket EPA-HQ-OPPT-2016-0597 in regulations.gov. The docket established for the negotiated rulemaking public meetings will be open for any additional public input for 60 days following the publication of the Federal Register Notice.
