The rule exempts certain Group E occupancies, including public schools and occupancies accessory to places of religious worship, from the requirement to construct storm shelters where the shelter design wind speed for tornadoes is at its highest (250 miles per hour). The rule makes permanent provisions of a July 1,2017, emergency rule that expires Dec. 13, 2017. A hearing is scheduled for Aug. 24, 2017, in Lansing. Comments are due Aug. 24, 2017. EPA, 1:17-cv-01906 ED_001523_00001524-00003 Regulatory Update Pennsylvania WATER Environmental Laboratory Accreditation Pennsylvania WATER Final rule of the Environmental Quality Board amends regulations under 25 PAC 252.1 through .708 (nonconsecutive) concerning accreditation of environmental laboratories. The rule establishes requirements concerning development and maintenance of instructions for sample collection, preservation, and sample receipt. The rule also updates accreditation requirements, provides for designation of temporary laboratory supervisors, requires deficiencies to be corrected within 120 calendar days, and addresses personnel certification and qualification requirements. In addition, the rule requires laboratories to notify customers of an expiration of accreditation and removes requirements for onsite assessments, except for onsite assessments for initial accreditation. Finally, the rule provides for receipt of electronic applications and fee payment, increases fees, modifies the fee schedule, and requires laboratories to check the pH of each sample container. The rule is effective July 29, 2017. The rule also revises requirements for hearings and enforcement actions and updates definitions. The final rule includes numerous changes and clarifications to the rule as proposed. For example, the final rule allows the executive director to use past grandfathering determinations and allows the commission to waive certain registration information if a project is relying on a past grandfathering determination. The final rule does not finalize proposed changes to the consumptive use mitigation policy. The commission plans to reevaluate its policies and procedures for consumptive use and consumptive use mitigation in a more comprehensive fashion. The rule is effective July 1,2017. Provisions concerning registration of grandfathered projects and grandfathered consumptive use are effective Jan. 1, 2018.
