Notice of the Department of Energy, Office of Energy Efficiency and Renewable Energy, announces the completion of a review and confirmation of the effective date for a Jan. 19, 2017, final rule (82 FR 6826) that amends regulations under 10 CFR 430.32 to revise the energy conservation standards for ceiling fans. The rule establishes standards expressed as the minimum allowable airflow efficiency in terms of cubic feet per minute per watt for each product class as a function of ceiling fan diameter in inches. The rule also adds several related definitions and specifies a compliance date of Jan. 21, 2020. The agency previously delayed the effective date on two occasions to allow it to conduct a substantive review of the rule. On Jan. 31, 2017 (82 FR 8806), the DOE delayed the effective date of the rule until March 21, 2017, in response to a presidential memorandum establishing a regulatory freeze. The current action confirms a March 21,2017, final rule (82 FR 14427), without change, which established an effective date of Sept. 30, 2017. Notice of the Federal Energy Regulatory Commission announces the filing of a prior notice request by Equitrans LP, of Pittsburgh, for authorization to modify Storage Well 8217 at the Rhodes Storage Field Complex and Skin Creek Storage Field in Lewis County, W.Va., and abandon in place associated natural gas storage pipeline. The proposed modification will allow Storage Well 8217 to serve as a single completion well to allow use of high-resolution casing logging tools. The agency will complete an environmental assessment or issue a notice of schedule of environmental review by Aug. 16, 2017. Protests and motions to intervene are due July 17, 2017. Notice of the Department of Energy, Energy Information Administration, announces the submission of a revised information collection request to the OMB regarding the Coal Markets Reporting System. The collection gathers information concerning coal production, consumption, receipts, stocks, sales and prices. The collection consists of the Quarterly Survey of Nonelectric Sector Coal Data (EIA-3), the Annual Survey of Coal Production and Preparation (EIA-7A), and the Annual Survey of Coal Stocks and Coal Exports (EIA-8A). The collection also consists of the Emergency Coal Supply Survey (Standby) (EIA-6) and the Emergency Weekly Coal Monitoring Survey for Coal Burning Power Producers (Standby) (EIA-20). The revisions include modifications to questions, response options and instructions to Forms EIA-3, EIA-7A and EIA8A and a requirement for Forms EIA-3 and EIA-8A to be submitted through the Energy Information Administration's Data xChange Portal. Notice of the EPA announces the receipt of a request from the Washington State Department of Agriculture for a specific emergency exemption to use the herbicide pyridate (CAS No. 55512-33 9) to treat 13,850 acres of double-cut mint to control terbacil-resistant redroot pigweed biotypes, common lambquarters, Powell amaranth, cinquefoil, Russian thistle, marestail and field violet. The notice specifies that the herbicide was voluntarily canceled in 2004 and is now considered to be unregistered under FIFRA. Comments are due June 8, 2017. Direct final rule of the EPA amends regulations under 40 CFR 770.2, 770.3, 770.7, 770.10, 770.12, 77.015 and 770.30 to extend the compliance dates for a Dec. 12, 2016, final rule (81 FR 89674) that established formaldehyde emission standards for composite wood products and finished goods containing these products that are sold, supplied, manufactured or imported, or offered for sale in the U.S., under TSCA Title VI. The December 2016 rule set forth standards for laminated products and products made with no-added formaldehyde-based resins or ultra low-emitting formaldehyde resins and addressed testing requirements, product labeling, chain of custody documentation and recordkeeping, enforcement, import certification, and product inventory sellthrough provisions. The rule also established a third-party certification program, provided procedures for the accreditation of third-party certifiers, and set forth general requirements for accreditation bodies and third-party certifiers. The current rule extends compliance dates for emission standards, recordkeeping and labeling provisions to March 22, 2018; import certification provisions to March 22, 2019; and provisions applicable to producers of laminated products to March 22, 2024. The current rule also extends the transitional period for California Air Resources Board third-party certifiers to March 22, 2019. The rule is effective July 10, 2017, unless adverse comments are received by June 8, 2017. Notice of the Department of Justice announces a proposed consent decree in United States v. James F. Jerge Jr. (Civil No. 1:17-cv-00428), lodged on May 17, 2017, with the U.S. District Court for the Western District of New York. The consent decree resolves claims against the defendant under the Clean Water Act for alleged discharges of pollutants without a permit into waters of the U.S. and failing to comply with the terms and conditions of a permit issued by the Department of the Army. The consent decree requires the defendant to restore impacted areas, to perform mitigation and to pay a civil penalty. Comments are due June 23, 2017.
