Talk about going in two different directions. Just as the EPA moves to implement its "Back to Basics philosophy" that emphasizes regulatory relief and cooperation with States on a number of environmental topics, the Cuomo Administration in New York has petitioned the agency to stretch the boundaries of the Clean Air Act and impose costly controls on the manufacturing and industrial sectors of neighboring states.

Start spreading the news: New York's "Keep it in the Ground" efforts are hitting the road and headed your way.
The Cuomo Administration has asked the Environmental Protection Agency (EPA) to utilize a little known provision of the Clean Air Act known as Section 126 to shut down or directly impose sweeping emissions limitations on 346 facilities across nine states; including Illinois, Indiana, Kentucky, Maryland, Michigan, Ohio, Pennsylvania, Virginia, West Virginia, and New York.
New York claims that "neighboring" states' pipelines, power plants, compressor stations and a wide range of manufacturing facilities--most of which are several hundred miles away--are contributing to air quality problems in New York. The U.S. Chamber joined with a broad coalition of groups to file a response to EPA detailing numerous flaws with New York's petition and the unreasonable economic impacts that could result if it is approved.
