Beck, Deputy Assistant Adm inistrator Office o f Chemical Safety and Pollution Prevention Dear Nancy, O n behalf o f Asbestos Disease Awareness Organization, American Federation of Labor and Congress o f Industrial Organizations, Occupational Health & Safety Section o f the American Public Health Association, International Association o f H eat and Frost Insulators and Allied W orkers, and Safer Chemicals, H ealthy Families, w e are disappointed that w e w7ere unable to have our im portant March 21 joint m eeting due to the inclem ent w eather. We will work w ith your staff to reschedule our m eeting as soon as possible, b u t ask that you delay finalizing the Problem Formulation Document for asbestos until we have had an opportunity to express our views and present new7evidence to you and your staff. W e are deeply concerned that the Problem Formulation Document will follow E P A 's June 2017 Scope of the Risk F valuationfo r Asbestos by excluding ongoing exposure from legacy asbestos products that remain in use and installed attic insulation containing Libby Amphibole asbestos from the E PA risk evaluation. We and several other groups opposed these exclusions in comments on the scoping docum ent and A dm inistrator Pruitt agreed to reexamine them in recent Congressional testimony. To exclude these im portant sources o f exposure and risk would not only be contrary to TSCA, but w ould also result in an incom plete risk evaluation that w ould fail to address serious threats to public health. In addition to these exclusions, the E PA should include chlor-alkali industry asbestos diaphragms used during the chlor-alkali m anufacturing process in its risk evaluation. In 2016, the chlor-alkali industry im ported 702 m etric tons o f raw asbestos rather than the 340 tons the U.S. Geological Survey previously estimated. There are numerous pathways o f asbestos exposure for those mining, transporting, handling, repairing, removing, and disposing o f asbestos for the chlor-alkali industry. Safer substitute materials are commercially available and have been adopted by numerous com panies in the industry. This use is the last rem aining application for w hich bulk asbestos is being im ported into the U nited States. T he E PA should include chlor-alkali use in its risk evaluation, conclude that it presents an unreasonable risk o f injury, and ban this obsolete hazardous technology. Lastly, during our m eeting, we w ould also like to discuss new evidence o f asbestos-contam inated products that are being distributed in comm erce and the need to include them in the E PA risk evaluation. Thank you for attention to this urgent m atter and we look forward to meeting you soon. Linda Linda Reinstein, CEO/Co-Founder, Asbestos Disease Awareness Organization (ADAO) Sierra Club v.
