Dear Mr. Kelly,
It was a pleasure to meet you on April 27th. The purpose of this message is to followup on our discussion regarding a site remediation proj ect in California that Boeing is hoping to move forward. We request your assistance in finalizing the Partial Consent Decree for the Dual Site Groundwater Operable Unit of the Montrose Chemical and Del Amo Superfund Sites (the "Dual Site") in Torrance, Los Angeles County, California (EPA Region 9). This Consent Decree specifically addresses the TCE in groundwater at the Dual Site. The settling parties are BP Amoco, The Boeing Company and PACCAR, Inc. Additional background information for the Dual Site is provided as follows:
To facilitate progress, the EPA has identified three separate Work Groups at the Dual Site defined by groundwater contaminant type. Former facilities for which Boeing, PACCAR and British Petroleum (BP) are responsible have been identified by EPA as sources for the TCE groundwater plume (the "TCE Work Group"). The benzene and chlorobenze groundwater contamination areas are being addressed by others under separate EPA consent Orders.
Boeing has been negotiating with PACCAR, BP and EPA since 2012 to finalize a TCE Work Group consent decree, with the objective to investigate and remediate that particular solvent plume. EPA and the TCE Work Group agreed upon the terms of the draft consent decree in 2014, but finalizing the draft document has been delayed due to EPA's focus on the other Dual Site work groups' activities. Boeing is eager to have the document approved by EPA and move forward with the Work Group to complete the remediation design and start the TCE groundwater cleanup.
While we respect that EPA staff have been focused on other aspects of the Dual Site actions, the TCE Work Group Partial Consent Decree should proceed. The final design and TCE groundwater cleanup is not dependent on resolving the issues around the other groundwater

contaminant plumes. It is our understanding that all substantial issues have been resolved by all parties, and we have been awaiting the final version for signature from EPA since January 2015.
We have made significant strides in addressing TCE on our neighboring Boeing property which historically may have contributed to the contamination at the Dual Site and are ready to proceed with the cleanup at the TCE Party Dual Site actions. Your assistance in moving this project towards implementation will better protect the environment by allowing the TCE cleanup actions to proceed. It will also remove some of the uncertainty associated with the Dual Site which will be beneficial from a local economic standpoint.
