Notice of the Office of Environmental Health Hazard Assessment announces the availability of documents summarizing the toxicity and derivation of draft reference exposure levels for hexamethylene diisocyanate (HDI) (CAS. No. 822-06-0) and toluene (CAS No. 108-88-3). HDI is primarily used as a hardener for automobile and airplane polyurethane spray paints, and toluene is produced in petroleum refining and coke oven operations and in automobile emissions. The reference exposure limits are airborne concentrations of a chemical that are not anticipated to result in adverse noncancer health effects for specified exposure durations in the general population, including sensitive subpopulations. Following the comment period, the documents, with any revisions by OEHHA, will be peer reviewed by the state's Scientific Review Panel on Toxic Air Contaminants. The rule revises definitions; clarifies the required format and location of product labels; and clarifies specific exposure warning requirements for restaurant food and beverages, prescription drugs and emergency medical and dental care, furniture products, diesel engines, and vehicles. Final rule of the State Water Resources Control Board amends regulations under 23 CCR 2922 to incorporate revisions to the statewide water quality control policy on the use of coastal and estuarine waters for power plant cooling (Resolution 2017-0047). The policy establishes uniform technology-based standards to implement Section 316 of the Clean Water Act, which requires that the location, design, construction, and capacity of cooling water intake structures use the best technology available for minimizing adverse environmental impact. The revisions extend a compliance deadline for Encina Power Station Units 2 to 5 by one year to Dec. 31, 2018. The rule is effective Nov. 20, 2017. Notice of the Commission on Mineral Resources announces changes to a Nov. 21, 2017, proposed rule to adopt regulations under NAC 534B to establish requirements and fees for dissolved mineral resource exploration. The rule would establish application requirements and procedures and set a $1,000 fee for a two-year permit to drill an exploration well. The rule also would establish responsibilities for exploration borehole and well drillers at a drilling site. In addition, the rule would restrict drilling below 3,000 feet, require continuous temperature monitoring, require plugging of an exploration borehole within 60 days, and require specific sealing for a borehole in which an artesian condition is discovered. Finally, the rule would require the use of and recordkeeping for blowout prevention equipment and water monitoring equipment, require public reporting of certain information, and specify penalties for violations. The changes clarify that if drilling does not commence within 60 days of the approval of a notice of intent to drill, a new notice of intent must be submitted, and specify that dissolved mineral resource exploration well monthly reports are to be submitted to the Division of Minerals. Notice of the State Environmental Commission announces additional changes to a June 23, 2016, proposed rule to amend regulations under NAC 445A regarding water quality standards to conform with EPA numeric criteria for Escherichia coli bacteria for protection of water contact recreation beneficial use. The rule would change the existing reference period from annual geometric mean (AGM) to geometric mean (GM) for all waters that have an existing AGM; replace the unit of measurement from most probable number (MPN) per 100 milliliter (mL) with colony forming-units (CFU) per 100 mL; and remove existing single value (SV) criteria of 235 MPN, 298 MPN and 576 MPN and replaces with a SV of 410 CFU. The rule also would explain frequency and duration limits of the GM and SV criteria and add a definition of "colony-forming-units." The changes specify that the number of E. coli bacteria present in a sample of water may be determined and reported by counting the colony-forming units in the sample or through the use of a statistical testing method to determine the most probable number of bacteria in the sample. Notice of the State Environmental Commission announces additional changes to a Sept. 23, 2016, proposed rule to amend regulations under NAC 445A regarding water quality standards (WQS). The rule would revise the WQS tables to establish numeric criteria for alkalinity, color, and turbidity based on current EPA standards; to remove references to the 95th percentile for total dissolved solids beneficial use numeric criteria; and to remove references to "X" in the beneficial use columns for secondary uses. The rule also would remove references to "natural conditions" and "no adverse effects," reformat how nitrogen species are presented in the WQS tables, and specify the criteria for toxic materials. In addition, the rule would move the ammonia standards tables so they occur after standards applicability discussions and beneficial uses. Final rule of the Department of Environmental Quality, Division of Drinking Water, amends regulations under R309-500 regarding plan review, operation, and maintenance requirements for drinking water projects. The rule removes the requirement for water systems with approved standard installation drawings and specifications to obtain plan submittal waivers from the division for the installation of water lines, and instead allows such water systems to install water lines up to and including 16 inches in diameter for a five-year period without any further interaction with the division. The rule also updates and reorganizes provisions, provides additional examples of public drinking water projects and operation and maintenance, and clarifies plan submittal requirements. WATER Water Supply Operator Certification Utah WATER
Final rule of the Department of Environmental Quality, Division of Drinking Water, amends regulations under R309-300 regarding certification requirements for water supply operators. The rule allows operators who fail an exam to apply for reexamination 30 days after taking the initial exam. The rule also removes provisions regarding the conversion requirement for operators, failure to remain in the waterworks field as a grounds for denial of renewal, and population and continuing education unit requirements for grandparent certificates. In addition, the rule updates applicability, removes the definition and references to "specialist," and adds individuals who passed the certification exam to the definition of "operator."
