The rule adds definitions, modifies variance procedure, aligns numeric standards with U.S. EPA specified maximum containment levels for pollutants, and revises provisions on technical infeasibility and alternative abatement standards. The rule also adds an exemption for certain facilities and activities under the authority of the Environmental Improvement Board. In addition, the rule revises notice of intent to discharge procedures. A hearing is scheduled for Nov. 14-16, 2017, in Santa Fe. Comments are due Nov. 14, 2017. EPA, 1:17-cv-01906 ED_001523_00002251 -00001 Commission; 505-827-2425 --New Mexico Register (06/27/2017) Regulatory Update OIL AND GAS INDUSTRY Oil and Gas/Horizontal Well Completion Reports, Hydraulic Fracturing Disclosures New Mexico OIL AND GAS INDUSTRY Notice of the Energy, Minerals and Natural Resources Department, Oil Conservation Commission, announces a hearing on a May 30, 2017, proposed rule to amend regulations under 19.15.7.16 and 19.15.16.19 NMAC regarding oil and gas well reporting and disclosures. The rule increases the time frame for reporting completion of horizontal wells to 45 days and requires disclosures concerning hydraulically fractured wells to be made on forms prescribed by the Frac Focus chemical disclosure registry. The hearing is scheduled for July 13, 2017, in Santa Fe. The preliminary agenda will be made available two weeks before the hearing and the final agenda will be available 72 hours prior to the hearing. Comments are due July 6, 2017. The rule specifies that the requirements are obsolete. The rule is effective July 27, 2017, if no objections are received by that date.
