The rule implements requirements from the 2010 and 2014 Ozone Transport Commission model rules for consumer products to establish VOC standards for 11 consumer products and update VOC standards for 15 consumer products. The rule also prohibits the sale, offer for sale, supply or manufacturing for use in the state of specified products that contain methylene chloride, Sierra Club v. EPA, 1:17-cv-01906 ED_001523_00003395-00001 perchloroethylene or trichloroethylene. The rule will be submitted to the EPA as a revision to the state implementation plan. The rule removes the phase-in provisions for the completion of CPC credits required for licensure renewal. The rule is effective June 5, 2017. The permit requires quarterly visual examinations of stormwater discharges, comprehensive annual inspections and an electronic version of a stormwater pollution prevention plan containing specific control measures. The permit also requires electronic submittal of monitoring reports and additional information regarding permit conditions in the notice of intent. In addition, the permit implements best management practices-based compliance options to comply with chlorine limits for dock washing at marinas. Finally, the permit clarifies eligible discharge types Sierra Club v. EPA, 1:17-cv-01906 ED_001523_00003395-00002 and revises various permit conditions. The agenda also includes rulemakings regarding application requirements, standards for project review, mitigation of consumptive uses, registration of grandfathered projects, and hearings and enforcement actions. In addition, the agenda includes requests by specified parties for project waivers, an amendment to the Comprehensive Plan for the Water Resources of the Susquehanna River Basin, a report on delegated settlements, and regulatory program projects and requests for extension of emergency certificates, including for Susquehanna Nuclear LLC. The meeting is scheduled for June 16, 2017, in Entriken, Pa. Comments on certain agenda items were subject to a prior comment period that closed May 22, 2017. The rule updates the bacteria indicators used for Class I waters, revises the list of Tier II waters, and incorporates corrections to Use Class identifications and Chesapeake Bay boundary units. EPA, 1:17-cv-01906 ED_001523_00003395-00003 Low-Emitting Aviation and Aircraft Painting and Refinishing Sources General Permit Minnesota AIR Notice announces the intention of the Pollution Control Agency to issue an air emission general permit for low-emitting aviation and aircraft painting and refinishing sources. The permit would cover stationary sources required to obtain permits under MNR 7007.0250. The notice specifies that sources for which certain national emission standards for hazardous air pollutants permits exist would not be eligible. Comments are due June 29, 2017. The rule establishes provisions for E15 and Ethanol Flex Fuels and specifies labeling, hose, storage, specification and registration requirements. The rule also incorporates by reference labeling requirements for E15 under 40 CFR 80.1501, the National Institute for Standards and Technology requirements for diesel exhaust fluid and fuel nozzles, and the American Society for Testing and Materials standards for Ethanol Flex Fuels. The rule includes requirements for calculating emissions; installing control technologies; operating control systems; and monitoring, recordkeeping and reporting. The rule will be submitted to the EPA as part of revision to the state plan for implementing the guidelines. The rule is effective May 31, 2017. The rule increases the time frame for reporting completion of horizontal wells to 45 days and requires disclosures concerning hydraulically fractured wells to be made on forms prescribed by the Frac Focus chemical disclosure registry. A hearing is scheduled for June 13, 2017, in Santa Fe. Comments are due June 6, 2017. The rule reduces interest rates for wastewater construction loans and specifies the use of "per capita income" instead of "median household income." The rule is effective May 30, 2017. The permit applies to operators of industrial stormwater discharges and on-site vehicle maintenance area stormwater discharges associated with ready-mixed concrete manufacturing activities and authorized Sierra Club v.
