The proposal is in response to the agency's 12-month finding on a petition to list three freshwater fish, the holiday darter, the trispot darter, and the bridled darter, found in Alabama, Georgia, and Tennessee, as threatened or endangered. The proposed listing is based on the agency's determination that hybridization with the variegate darter is the primary threat to the candy darter. The agency has prepared a species status assessment report that provides a compilation and assessment of the best scientific and commercial information available concerning the status of the candy darter, including the past, present, and future factors influencing the species. The agency seeks information not already included in the SSA Report regarding the species' biology, range, and population trends; factors affecting continued existence; the potential for additional introductions of the variegate darter into unaffected watersheds; and potential prohibitions and instream and bank habitat restoration activities to benefit the species. The EPA seeks additional comments concerning ways to determine the 2018 and 2019 volume requirements for biomass based diesel (BBD). The project involves the construction and operation of three separate but interconnected pipeline systems totaling approximately 685 miles, including the Sabal Trail Project in Alabama, Florida, and Georgia; the Florida Southeast Sierra Club v. EPA, 1:17-cv-01906 ED_001523_00001364-00005 Connection Project in Florida; and the Hillabee Expansion Project in Alabama. The SEIS is being prepared in response to a 2017 court opinion regarding FERC's environmental review of the project. The draft SEIS estimates the greenhouse gas emissions generated by the project's customers' downstream facilities, describes the methodology used to determine these estimates, addresses the magnitude of the emissions, and addresses the value of using the social cost of carbon tool. The draft SEIS also provides FERC's conclusion that with the applicants' implementation of impact avoidance, minimization, and mitigation measures, the project would not result in a significant impact on the environment. The applicant requests a new major license to continue operation of the project, install an automatic pond level control system, and develop a minimum flow monitoring plan. The project also would include construction and maintenance of a new carry-in boat access trail downstream of the tailrace, a bank fishing area, and a parking area outside the project gates. Lyndonville operates the existing project in a run-of-river mode with an annual average generation of approximately 3,960 megawatt-hours and is not proposing any changes in project operation. United States (Civil Action No. 15-cv-411), lodged on Sept. 22, 2017, with the U.S. District Court for the District of New Mexico. The consent decree resolves claims and counterclaims under CERCLA for contamination associated with past uranium mining operations conducted by United Nuclear Corp., El Paso Natural Gas Co., and Homestake Mining Co. of California at the San Mateo Uranium Mine Site in Cibola County, N.M. The consent decree requires the U.S. to pay $1,595 million to the mining companies and requires the mining companies to pay $25,000 to the Superfund. The U.S. and the mining companies covenant not to sue or bring claims for past and future work concerning implementation of the unilateral administrative order or response costs, and the mining companies will be protected from contribution actions or claims. The consent decree addresses alleged violations of the Clean Water Act, federal pretreatment standards requirements, the terms of the city's NPDES permit, federal pretreatment requirements, and state water pollution control law. The consent decree requires the city to pay a $385,000 civil penalty and to comply with its NPDES permit, federal pretreatment requirements, and state law. The act requires certain vessels providing transportation of merchandise by water or by water and land between points in the U.S. to have a coastwise endorsement, or the vessel to have been built in and documented under U.S. laws and to be wholly owned by U.S. citizens. The waiver, which was requested by the Defense Department, is being provided due to severe damage to Puerto Rico's infrastructure by Hurricane Maria.
