SECTION I - INTRODUCTION
Site Entry and Inspection Objectives
U.S. EPA Region 5 (EPA) Lead Inspector, Ted Flatebo, arrived at the City of Chicago Heights (the "City"), located at 1601 Chicago Road, Chicago Heights, Illinois 60411, at 09:00 AM (CT) on September 13, 2022 for an announced inspection. He was accompanied by EPA inspector Keith Middleton. The two inspectors will collectively be referred to as the inspection team. Both members of the inspection team presented their credentials to Mr. Aaron DelValle, City of Chicago Heights Public Works Director, and informed him that this was an EPA inspection to determine compliance as authorized by Clean Water Act (CWA) Section 308 and implementing regulations. This report is based on information supplied by City representatives, direct observations made by EPA inspectors, records and reports maintained by the permittee and other information including: photographs taken by EPA inspectors, physical evidence collected by the EPA inspectors, measurements taken by EPA inspectors, verbal or written statements made by information supplied by City employees or City contractors during or subsequent to the on-site Inspection, and materials, processes, data, photographs, or documents shown, demonstrated, or submitted to EPA inspectors by City of Chicago Heights representatives during or subsequent to the on-site Inspection. In addition, information gathered prior to or subsequent to the Inspection from a review of EPA, State, and/or public records may be included in this report.

Mr. Flatebo confirmed the following facility information:
The City of Chicago Heights operates a small Municipal Separate Storm Sewer System (MS4). The purpose of the inspection was to determine the status of MS4 permit coverage for the City of Chicago Heights, and to review the City's implementation of MS4 permit program requirements.
The Phase II National Pollutant Discharge Elimination System (NPDES) regulations automatically cover, on a nationwide basis, any MS4 "located in an urbanized area as determined by the latest Decennial Census by the Bureau of the Census" (unless the MS4 qualifies for a waiver) 40 CFR 122.32(a)(1). "Urbanized areas," as defined by the Census Bureau when the Phase II regulations were issued, comprise areas "that together have a minimum population of 50,000 people.'' 64 Fed. Reg. 68722, 68751 (December 8, 1999).

The universe of regulated small MS4s in urbanized areas expands every 10 years, according to the 1999 storm water Phase II final rule. A "small MS4" is any MS4 not already covered under Phase I of the NPDES storm water program. The City of Chicago Heights is within the Chicago, IL-IN urbanized area (UACE#16264), as defined by the U.S. Census Bureau, and subject to NPDES storm water regulation as a small MS4.

SECTION II - OBSERVATIONS

The inspection team held the opening conference at the City of Chicago Heights City Hall. They began by asking general questions about how the City complies with MS4 permit requirements. Mr. Delvalle provided the following information:
-The Public Works Department assumes responsibly for most requirements under the MS4 permit. The City's Code Enforcement Department assumes responsibility for 2 Minimum Control Measures: Construction Site Storm Water Runoff Control and Post-Construction Storm Water Management in New Development and Redevelopment;
-The City does not have any MS4 permit co-permittees;
-The City provided the inspection team with a copy of its MS4 annual report covering March 2021 to March 2022. The report was signed by Mr. DelValle on June 14, 2022;
-The City did not complete or submit MS4 annual reports to Illinois EPA for March 2017 to March 2021;
-The City inspects one of its MS4 Outfalls located on Thorn Creek Basin Sanitary District property twice annually;
-A City contractor completed an inspection of its MS4 Outfalls in August 2021; and

-The City has submitted a Notice of Intent (NOI) to Illinois EPA for coverage under the next MS4 permit, which has not been issued yet. The NOI was signed by Mr. DelValle on November 12, 2021.

The inspection team discussed what activities the City was doing to comply with each of the Illinois EPA General Permit for Small MS4 Minimum Control Measure requirements. The Mr. DelValle's responses are provided below.
1) Public Education and Outreach: The City posts educational material on the City's Website.
2) Public Involvement/Participation: The City conducts a Spring and a Fall leaf clean up drive annually.
3) Illicit Discharge and Elimination: The City updates storm and sanitary sewer maps on an annual basis.
4) Construction Site Storm Water Runoff Control: The City's Code Enforcement Department conducts inspections of construction sites to ensure compliance with Watershed Management Permits issued by the Metropolitan Water Reclamation District of Greater Chicago (MWRD).
5) Post-Construction Storm Water Management in New Development and Redevelopment: The City has no Post-Construction Storm Water Management in New Development and Redevelopment program.
6) Pollution Prevention/Good Housekeeping for Municipal Operations: The City has no formal Pollution Prevention/Good Housekeeping program for Municipal Operations.

The inspection team asked Mr. DelValle for a summary of storm sewer or sanitary sewer projects have completed in the past 5 years. Mr. Caruso, the City's contract engineer, provided the following written summaries for past/future projects:
10th Street Culvert Replacement
Completed in 2021, the project consisted of the replacement in kind of two 48" diameter CMP culverts and a 44" x 72" arch CMP culvert at the intersection of 10th Street and Campbell Avenue.
Streambank Maintenance
Completed in 2022, approximately 3,900 linear feet of existing streambank was rehabilitated including removal of non-native species, tree removal, reshaping of side slopes, planting native prairie seed mixes and replacement of 10'W x 4'H concrete box culvert.
Saratoga Farms
Existing residential area bounded by Joe Orr Road on the north, stormwater detention basin to the east, Ranger Drive to the south and Lexington Drive to the west. The existing approximately 5,240 linear feet of storm sewers were televised and cleaned in 2021. A follow-up project, with construction beginning in fall 2022, will construct new 43" x 76" arch pipe on Enterprise Road and into the existing detention basin; and a new 3' x 5' box culvert between 575 and 579 Saratoga Drive to replace a collapsed CMP arch pipe. Chicago Road Culvert Replacement Illinois Department of Transportation (IDOT) recently replaced the existing culvert under Chicago Road at Thorn Creek Tributary adjacent Bloom High School with a new triple 12' x 6' box culvert.

Dixie Highway Culvert Replacement
IDOT is planning a similar culvert replacement project to the Chicago Road Culvert Replacement project on the Thorn Creek Tributary under Dixie Highway adjacent the west side of Bloom High School near Hawthorne Lane. The project is currently being designed by IDOT and is expected to be constructed within the next 3 to 5 years.
Euclid Hill Area Sewer Televising and Cleaning
The City has contracted to clean and televise approximately 37,000 linear feet of storm sewer and 35,000 linear feet of sanitary sewer within the area bounded by East End Avenue to the west, 22nd Street to the north, State Street to the east and 26th Street to the south. Also, storm sewer on 16th Street from Division Street on the west to Chicago Road on the east.
Sewer Collapse Repairs
The City contracted repairs to approximately 60 locations throughout the City of storm sewer or sanitary sewer collapses. Repairs ranging from misaligned frame and grates to pipe and structure (manhole or catch basin) repairs were performed and completed in spring 2022. An additional approximately 25 locations will be bid out in fall 2022 for additional repairs.

The inspection team asked Mr. DelValle if he was familiar with the approved Thorn Creek Watershed Total Maximum Daily Load (TMDL) Report and if the City has taken any actions to address the TMDL waste load allocations assigned to the City. Mr. DelValle stated he was not familiar with the report and the City had not taken any specific actions to address TMDL waste load allocations.

Following the opening conference, EPA inspectors begin the field portion of the inspection. They were accompanied by Mr. DelValle and Mr. Straczek. Mr. Caruso and Ms. Maertens-Pizzo left City Hall and concluded their participation in the inspection.
Within the Streets Department warehouse there are multiple floor drains and a variety of equipment including municipal vehicles, a vacuum truck, and a power washer. Mr. Straczek clarified the following points regarding warehouse activities:
-All the drains within the warehouse are storm drains, they not connected to the sanitary sewer;
-The power washer is used to remove ice and salt from equipment during winter. The wash water is disposed of via the interior flood drains;
-The vacuum truck is only used to remove storm water. If there is sanitary waste that needs to be removed, the City contracts out the work to a company that has their own vacuum truck; and

-No waste oil is generated within the warehouse. The City sends the vehicles out for preventative maintenance.

Mr. DelValle stated that Illinois Environmental Protection Agency (Illinois EPA) representatives were at the facility on September 12, 2022 to remove used tires.
Inspectors observed separate piles for scrap metal, vegetation, and gravel. Mr. DelValle stated that at the end of the year he rents a wood-chipper to chip the accumulated vegetation which is then stored in the lot and used throughout the City as needed.
Inspectors did not observe any pile/material covers that that would prevent the contamination of storm water.

The City Water Department Lot contained an uncovered gas pump for municipal vehicles and separate piles of gravel and scrap metal. Adjacent to the gravel pile was a storm drain and inspectors observed a stream of water flowing through the gravel into the storm drain.
Other than the outdoor materials identified above, all other operations at this facility take place indoors.
The Water Department is not housed within the Public Works Department and has a separate director who did not participate in this inspection.

The City Storage Facility contains a building for road salt storage and an open lot used for out-of-service municipal vehicle storage. The inspection team observed road salt stored within the building. Mr. DelValle stated that he currently had approximately 300 tons of road salt stored and that the building could

accommodate up to 800 tons if needed. He also stated that there is a storm drain under the road salt pile and that it has been caped to prevent the discharge of salt.
Inspectors observed approximately 20 municipal vehicles stored outdoors. Some vehicles appeared to operable while others appeared to be significant damaged.
Vegetation growth around the vehicles that made it difficult to observe if any of the vehicles were leaking fluids.

The inspection team observed a stream bank management project completed by the City in 2022. The stream bank was cleared of vegetation and the banks were stabilized with rocks.
Adjacent to the intersection of Dixie Highway and Hawthorne Lane is a box culvert. Mr. DelValle explained that IDOT is scheduled to complete an expansion project for this culvert in the next 3 to 5 years.

The inspection team observed MS4 Outfall 3, which is a grated manhole. The Outfall was partially covered by tree roots. Mr. Straczek explained that this Outfall is set at a lower elevation than the inlet located on Hamilton Wood and that storm water is intended to discharge out of the top of the grated manhole.

Closing Conference
The EPA inspection team held an inspection closing conference with City personnel at 12:45 PM (CT) on September 13, 2022. During the closing conference, the inspection team discussed the observations and Areas of Concern identified during the inspection. Observations and Areas of Concern have not yet been evaluated for a formal compliance determination. Following the closing conference, EPA inspectors left the City of Chicago Heights.
