The rule establishes penalties for false statements or representations, failure to pay a covered electronic waste recycling fee, and failure to comply with requirements for manufacturers. The rule readopts an Oct. 16, 2015, emergency rule. The rule is effective Oct. 6, 2017, and expires Oct. 7, 2019. The rule adds bacteria water quality standards for enterococcus colonies to align with federal requirements. The rule revises the proposal by changing the description of the affected Sierra Club v. EPA, 1:17-cv-01906 ED_001523_00002577-00002 waterbody to marine coast recreation waters from the Delaware Bay to the Maryland state line, reorganizing information in the primary and secondary contact recreation waters table, and removing references to weekly samples in the table. The rule is effective Sept. 11,2017. Contact: David Wolanski; DNREC; 302-739-9939; David.Wolanski@state.de.us --Delaware Register of Regulations (09/01/2017) Regulatory Update WATER Underground Injection Control Delaware WATER Notice of the Department of Natural Resources and Environmental Control, Division of Water, announces changes to and an extension of the comment period regarding a May 1, 2017, proposed rule to repeal and readopt regulations under 7 DEAC 7102 to align requirements for the construction and use of underground injection wells with federal provisions. The rule specifies six classes of underground injection wells and prohibits four of these classes. The rule also establishes minimum construction and operation requirements for two classes, including wells that inject hazardous waste or fluids beneath the lowermost aquifer containing an underground source of drinking water and shallow wells used to place a variety of fluids directly below the land surface. In addition, the rule addresses permit procedures and adds requirements for multiple water management activities. The changes clarify that "SIC" and "TMDL" mean "standard industrial classification" and "total maximum daily load," respectively. The changes also specify noncompliance notification procedures and revise well abandonment provisions. Comments now are due Oct. 2, 2017. Contact: Lisa Vest; DNREC, Ground Water Discharges Section; 302-739-9042; lisa.vest@state.de.us --Delaware Register of Regulations (09/01/2017) Regulatory Update Texas WATER Surface Water Quality Standards Texas WATER Proposed rule of the Texas Commission on Environmental Quality amends regulations under 30 TAC 307.2, .3, .6, .7, .9, and .10 regarding surface water quality standards. The rule updates toxic criteria to incorporate new data on toxicity effects, clarifies how water quality standards are assessed using instream monitoring data for bacteria, and incorporates new data and use attainability analysis results concerning uses and criteria of individual water bodies. The rule also defines "coastal recreation waters," lists numeric criteria for aquatic life protection, and updates human health criteria to add four chemicals and revise 18 noncarcinogens. In addition, the rule changes the saltwater single sample criterion for Enterococci to 130 per 100 milliliters, allows for basing attainment of bacteria standards in coastal recreation waters on both geometric mean and single sample criteria, revises site-specific uses and criteria for classified segments for numerous water sources, and deletes several sources that no longer qualify as sole-source drinking water supplies. Finally, the rule revises descriptions for several water segments, adds Sierra Club v. EPA, 1:17-cv-01906 ED_001523_00002577-00003 eight unclassified water bodies with their designated aquatic life uses and dissolved oxygen criteria, specifies site-specific copper and aluminum water-effect ratios for several segments, and revises the presumed use of primary contact recreation for numerous water bodies.
