Circuit Court of Appeals today said it will keep lawsuits challenging the Obama administration's carbon emissions rule for future power plants on hold indefinitely. The suspension comes on the heels of the court's Tuesday order freezing litigation over the Clean Power Plan for another 60 days. That order came with a note from two judges indicating they are growing impatient with the Trump administration's lack of action in that case. In today's one-page order, the court directed EPA to provide updates on its progress in reviewing the rule for future plants every 90 days. Unlike the Clean Power Plan, the new plant rule is in effect, although other regulatory and market challenges mean no new coal-fired power plants are actively being planned.
