PPG Industries, et al. usKftai. JAM 1 o 1S2 IrRrDHEI Dear Peter: Enclosed please find a copy of plaintiff's Interrogatories addressed to Union Carbide and Vista Chemical in this matter. As you may recall from our telephone conversation in late December, these Interrogatories in place of the earlier Interrogatories served by are the plaintiff, which were stricken by Judge Mandak at the hearing of various discovery motions on December 19. Under the Court's order, the defendants are required to respond to these Interrogatories within 30 days of service; therefore. Union Carbide's answers will be due on February 4, 1987. Please note that these Interrogatories may be changed, but you should begin compiling information nonetheless. At the hearing on December 19, Judge Mandak directed the plaintiffs to serve the defendants with ten (10) single questions (no subsections). (See the enclosed proposed Order). The Interrogatories which are enclosed are clearly in violation of that directive and have been challenged by the defense counsel (see the enclosed letters of January 8, 1987 from John Ridley, Esq.) privileged and "CONFIDENTIAL MATERIAL SUBJECT TO PROTECTIVE ORDER" UCC 076780 ditney, Hardin, Kipp & Szuch Peter F. Davey, Esq. January 13, 1987 Page Two My best guess is that the plaintiff's counsel will not voluntarily withdraw any questions and Judge Mandak will have to rule on Mr. Ridley's objection. Until we hear that the objection is upheld, however, we probably should assume that we will have to answer all the subsections. Please call if you have any questions. PPG Industries, et al Docket No. L-20509-86 Dear Judge Mandak: Your Honor may recall that on Friday, December 19th, numerous counsel in the above-referenced matter appeared before Your Honor in connection with motions relating to both the untimeliness and the overbreadth of plaintiff*s Interrogatories in this matter. At that time, Your Honor struck the Interroga tories which plaintiff had served (containing several hundred questions) and directed that plaintiff's counsel specifically serve a maximum of ten single-question interrogatories directed solely to the purpose of determining the propriety of the inclu sion of the numerous defendants in this litigation. You directed that these interrogatories be served within ten days, i.e., by December 29th, and be answered within thirty (30) days thereafter. In response to my request at the conclusion of the hearing. Your Honor agreed to hear any application relating to the impropriety of the interrogatories on short notice. On January 5th I received plaintiff's set of Interrogatories which I believe to be substantially at variance with the direc tive of the Court. However, in an effort to obviate the need to reappear . before Your Honor on this matter, I am undertaking to attempt to reconcile these differences with plaintiff's counsel. In the meantime, I am enclosing herewith a form of Order reflecting Your Honor's decisions on December 19th, with the request that, unless an objection is noted, it be executed and filed after five days.
