SAL 0CQ02C9S1 CLASSIFICATION OF VIOLATION (In Order of Seriousness) IMMINENT DANGER Section 13(a) of the Act defines imminent danger as "... any conditions or practices in any place of employment which are such that a danger exists which could reasonably be expected to cause death or serious physical harm immediately or before the imminence of such danger can be eliminated through the enforcement procedures otherwise provided by this Act." SERIOUS Section 17(k) of the Act provides: "... a serious violation shall be deemed to exist in a place of employment if there is a substantial probability that death or serious physical harm could result from a condition which exists, or,from one or more practices, means, methods, operations, or processes which have been adopted or are in use, in such place of employment unless the employer did not, and could not with the exercise of reasonable diligence, know of the presence of the violation," NON SERIOUS This type of citation shall be issued in situations where an incident or occupational illness resulting from violation of a standard would probably not cause death or serious physical harm but which have a direct or immediate relationship to the safety or health of employees. DE MINIMIS No citation shall be issued where a violation of a standard had no immediate or direct relationship to safety or health. In such situations, a notice of de minimis violation shall be issued, with no proposed penalty. Lack of partitions in sanitary toilet facilities would be a de minimis violation. SPECIAL TYPE WILLFUL A ''willful" violation may exist under the Act where the evidence shows (1) that the employer committed an intentional and knowing violation of the Act and the employer is conscious of the fact that what he is doing constitutes a violation of the Act, or (2) even though the employer was not consciously violating the Act, he was aware that a hazardous condition existed and made no rea sonable effort to eliminate the condition. It is not necessary that the violation be committed with a bad purpose, or an evil intent, to be deemed "willful" under the Act. It is sufficient that the act was deliberate, "Voluntary or intentional as distin guished from those which were inadvertent, accidental or ordinarily negligent.
