On January 20, 2025 President Donald J. Trump signed Executive Order (EO) 14154, Unleashing American Energy. The EO directs the Council on Environmental Quality (CEQ) to:
Provide guidance on implementing the National Environmental Policy Act (NEPA ) to expedite and simplify the permitting process; and Propose rescinding CEQ's NEPA regulations found at 40 CFR 1500 et seq.
CEQ submitted the Interim Final Rule to the Federal Register to rescind CEQ's NEPA regulations and issued guidance to agencies on NEPA implementation moving forward. Furthermore, CEQ is directed by the EO to convene a working group to assist agencies in revising their agency-specific NEPA procedures.
DOI should not delay pending, ongoing, or initiating new NEPA analyses while undertaking these revisions. Agencies should rely on their existing practices and procedures for NEPA consistent with the text of NEPA, EO 14154, and CEQ's guidance.
