The rule also increases Title V annual operating permit renewal and permit processing fees by an additional 16 percent above the CPI for the next two fiscal years. In addition, the rule increases annual operating permit renewal, permit processing and plan fees for non-Title V facilities by 4 percent above the CPI for the next two fiscal years. Finally, the rule updates and clarifies references, removes obsolete provisions, makes technical corrections, and extends certain due dates. The rule is effective July 1, 2017. EPA, 1:17-cv-01906 ED_001523_00003493-00002 Notice announces the intention of the Department of Health, Division of Environmental Health, to amend regulations under MNR 4720.0030 regarding public water supplies. The amendments would reduce the minimum, maximum, and average fluoride levels in municipal public water systems to 0.5 milligrams per liter (mg/L), 0.9 mg/L, and 0.7 mg/L, respectively, based on recommendations from the Centers for Disease Control and Prevention. The rule discontinues t-butyl acetate emissions reporting requirements for the air permitting and gasoline transfer operations standards and deletes related penalties to reflect Feb. 25, 2016, EPA amendments to 40 CFR 51.100. The rule will be submitted to the EPA as a revision to the state implementation plan. A hearing is scheduled for Aug. 24, 2017, in Trenton. Comments are due Sept. 1,2017. The department has determined that the manuals no longer satisfy applicable requirements under NJAC 7:27-8.12 for preconstruction permits for minor facilities and NJAC 7:27-22.35 for operating permits for major facilities. The department also is updating the effective dates for five other state-of-the-art technical manuals for the control of air contaminant emissions. Comments are due Aug. 2, 2017. The rule removes the requirement for visual inspection of elevator devices at six-month intervals and removes the associated fee. The rule also specifies that building owners are responsible for performing required maintenance under national standards and to record maintenance on a checklist. The rule is effective July 3, 2017. EPA, 1:17-cv-01906 ED_001523_00003493-00004 Proposed rule of the Department of Labor and Workforce Development, Division of Public Safety and Occupational Safety and Health, readopts with amendments regulations under NJAC 12:121 2.1, -3.1, -4.2, -4.8, and -7.1 concerning licensing of crane operators. The rule specifies that an application for renewal must be submitted at least 45 days prior to the permit's expiration date, updates the definition of "approved," and replaces outdated agency titles. The rule also removes obsolete provisions concerning the Crane Operators License Advisory Board and license expiration and renewal. A hearing is scheduled for Aug. 1, 2017, in Trenton. EPA, 1:17-cv-01906 ED_001523_00003493-00005 Notice of the Department of Environmental Protection announces a proposed revision to the state implementation plan (SIP) regarding the Warren County nonattainment area for the 2010 onehour sulfur dioxide national ambient air quality standards (NAAQS). The SIP revision sets forth a base-year emission inventory, reasonable further progress toward attainment, reasonably available control measures/technology, dispersion modeling demonstrating attainment in 2018, an approved new source review program, and contingency measures. The department has drafted a consent order and agreement with United Refining Co. to incorporate control measures, emission limits, and contingency measures applicable to its facility into a federally enforceable vehicle. The revision will be submitted to the EPA for approval. A hearing is scheduled for Aug. 2, 2017, in North Warren. Comments are due Aug. 4, 2017.
