His response was that the intentions of the Industrial Products Division/Industrial Insulations Division were that 352 Cement was specifically "manufactured" and marketed for use as an insulating product and that 7M13 was specifically marketed for use as an asbestos fiber grade. When the "manufacture" of 352 Cement was discontinued, it was not the intent of IPD/IID that grade 7M13 Cement be substituted for 352 Cement. Subsequent to the discontinuance of 352 Cement, some J-M customers learned that the two products were synonymous and began purchasing 7M13 fiber from the Asbestos Fiber Division to use as a substitute for 352 Cement. Any purchases of 7M13 would have been made through the Asbestos Fiber Division. He was not personally aware of what intentions the Asbestos Fiber Division may have had (or whether, in fact, they had any) in marketing 7M13 Cement as a substitute for 352 Cement. Mr. Rushforth further stated that the above information was available to him through heresay only and that he was not qualified and would not testify to it. CRMC-Thermo&Cement-000030 3.
