It is in effect for a five years period (starting on Sept. 16, 2016), which is typical for documents of this nature. The first Memorandum of Understanding (MOU) was signed in 2011. The MOU is a voluntary, non-legally binding document used to outline broad areas of cooperation between EPA and the UN Environment Program (UNEP), where there is mutual interest. Our cooperation with other countries, facilitated by UNEP, includes efforts to reduce transboundary air pollution and toxic substances originating from other countries which can impact the health of U.S. citizens and the environment within our borders. EPA's "war on lead" is one example of possible future cooperation through the MOU. Under what authority is the EPA signing MOUs with international and foreign entities? Does EPA believe the Constitution authorizes this? All activities engaged in by the EPA pursuant to the Memorandum are subject to applicable laws and regulations of the United States of America. The EPA entered into this Memorandum pursuant to Section 102(2)(F) of the National Environmental Policy Act, 42 U.S.C. 4332(2)(F); Section 103(a) of the Clean Air Act, 42 U.S.C. 7403(a); Section 8001(a) of the Solid Waste Disposal Act, 42 U.S.C. 6981 (a): Section 1442(a) of the Safe Drinking Water Act, 42 U.S.C. 300j-J; Section 1 O(a) of the Toxic Substances Control Act, 15 U.S.C. 2609(a); and Sections 17(d) and 20(a) of the Federal Insecticide, Fungicide, and Rodenticide Act, 7 U.S.C. 1360(d) and 136r(a).
