Green Senior Litigation Counsel Manville Sales Corporation Denver Colorado 80217 JUN 1 0 1982 DEPARTMENT Re Asbestos discovery of documents from the Southeastern Insulation Contractors Association Dear Jim Some time ago you requested us to subpoena documents from the Southeastern Insulation Contractors Association in Nashville In accordance with your instructions we had a subpoena duces tecum issued in the asbestos lawsuit of William D. Ferrell et ux which is pending in the Circuit Court for Davidson County Tennessee docket number C 3563. I am enclosing a copy of the subpoena duces tecum which was issued and served on Jean Y. Dean the Executive Secretary of the Southeastern Insulation Contractors Association SEICA I had several conversations with Mrs. Dean and with Attorney Gardner Courson in Atlanta who represents SEICA Mr. Courson agreed that the requested documents would be produced on a voluntary basis for our inspection and copying Therefore we notified all counsel in the Ferrell lawsuit that there would be no deposition and no production of documents pursuant to the subpoena duces tecum You advised me that there was no necessity for an immediate review of the documents and it was several weeks before I was able to arrange a convenient time with Mrs. Dean for a review of the documents I went to Nashville on April 23 1982 and reviewed the documents produced at the home of Mrs. Dean Mrs. Dean agreed to copy certain documents which I designated and finally I received copies of the documents a few days ago I am enclosing a separate memorandum concerning the documents produced and comments about information which I obtained from Mrs. Dean Mr. Charles Carver an officer of Breeding Insulation Company and a director for SEICA met with us Both of them were very cooperative and friendly They seemed to have no knowledge of any controversy or pending litigation between the Contractors Association and the asbestos insulation product manufacturers Please review the enlosed memorandum and the documents which are also enclosed I do not feel that any of the documents contain any surprising or very significant information The minutes do establish that the Contractors Association learned about the asbestos hazard back in the late 1960's and that Sheckler did appear at one of the regional meetings I reviewed all of the documents produced but saw no necessity of copying other documents If you have any questions about the other documents or desire that I contact Mrs. Dean for any reason I will Mr. James K. Cagle Jr. RE Documents produced by Southeastern Insulation Contractors Association The subpoena duces produced and this tecum listed ten separate references to documents to be memorandum will consider the documents produced under the ten separate requests 1. Copies of all correspondence from 1964 to date etc. Mrs. Dean has been Secretary of SEICA since October 1978. Her predecessors as Secretary were Mr. J.W. Johnston from January 1977 and Mr. Bob Hume from November 1968 to September 1975. 1976 Mrs. to December Dean had all the correspondence since she before 1978. I found no letters has been or other Secretary documents and some of the correspondence in the correspondence file that related in any way to asbestos or other health problems of employees of the ContractorIs did find one letter Greenville South Carolina to Robert L. from Attorney James Hume the Secretary R. Gilreath of for SEICA dated June 18 1971 a copy of which is enclosed This letter merely affirms that Gilreath sent notes regarding his talk on the new OSHA legislation with the indication that the information could be sent out to the membership I found no letters or brochures which were sent to the membership at that time or later The other correspondence related to routine business of the Association its conventions membership etc. 2 Minutes I made copies of the Minutes of Organizational Meetings of Board of Directors of Associated Asbestos Contractors of the Southeastern States Inc. on June 6 1960 and of all Minutes from October 14 1963 until October 13 I did not have time to review all of these Minutes in detail and decided to 1981 copy all of them even though there is not much information on asbestos hazards Refer to the Minutes concerning the general meeting in the fall of 1966 which has a reference to there being an asbestos Workmans Compensation award of 36,000 to an individual The statement is made that contractors should set up a physical exam- ination program and Ted Brodie was appointed to head up a committee to study this situation Also note in the same Minutes that the Safety Committee report by Bobby Dean husband of was that IDCNA Jean Dean and was starting a that he is now safety program a supervisor for I think that he is the Young Sales in Nashville Note in the Minutes of General Meeting on October 21 1968 that the NIMA brochure on Recommended Health Safety Practices for Handling and Applying Thermal Insulation Products Containing Asbestos and Containing Mineral Fibers Bob Dean Also there was a booklet entitled The National Fund distributed to all members present Note the Minutes was passed out by Asbestos Welfare of a General Meeting June 9 and 10 1969 at which Sheckler and John Vyverberg a health and safety Reference was made program was put on by Clifford to pending legislation on asbestos MEMORANDUM Mr. James K. The subsequent seminars all indicate reports on safety standards and occupational health I probably should not have copied all of these programs but I did not have time to review them thoroughly 5. D. Cash Jr. and approved as corrected Jack Smith made the report for the committee on changing the name of the association It was recommended that the name be changed to Southeastern Insulation Contractors Association Inc. and on motion by Mr. C. E. Thurston and duly seconded the recommendation was adopted Three suggestions for a new logo were presented and the number 8 figure was accepted as shown below Attorney Jim Gilreath advised that the latest copy of the Laws is the 1964 Revision plus one admendment He also advised that new Laws would be printed and would include the name change to SEICA as well as IDCNA to NICA Mr. new Harvey Hales reported for the membership member and two good potential members committee and advised that we have one Mr. Jim Gilreath pointed out two specific items that all of us should be aware of 1 He referred to an article on page 22 of the June 1970 issue of the NICA Outlook titled When Do I Get Paid He advised that before signing a contract we should mark out any reference to the contractor being paid when the contractor paid and initial the exclusion in the margin of the contract form Page -2- 2 He called our attention to the fact that time for filing a lien as well as the forms vary from state to state Mr. R. L. Hume asked that Mr. Sam Burns speak concerning the participation of the members in the Arrears List Out of the 60 members in the association only 6 made reports to the list in the last 6 months Twelve to twenty units have reported at various times during the year and the approximate cost of continuing the list amounts to 708.00 per year Mr. Burns stated that he didn't think it advisable to continue with this expenditure with so little participation On a motion made by Herb Mullenix and seconded by John Brennan discontinue the Arrears List it was voted to The Health and Safety Committee report was given by Robert T. Deen He pointed out the contractors in the Western States Association have been quite active in the area of health and safety He stressed the fact that good housekeeping always leads to safer jobs and fewer health hazards from dust The possibility exists that the future insulating cements will be mixed in plastic bags There is also a possibility of a general law being put on the books which will require a man to have a physical examination before working with asbestos materials He stressed the importance of each individual contractor policing his own jobs and areas Safe scaffolding should be insisted upon After this report there was a dess legislation outlawing the discussion conerning some of the states seeking use of glass fiber duct liners and ductboard to Mr. Jim Ormsby gave his report on Apprenticeship ville now has a program under way This program and appears to be having success Training and reported that Jacksonis similiar to the Tampa program The Tampa program has helped accomplish a supply of first and second year improvers as well as helped control the rate of pay of improvers The related study part of the program has started There have been seven Saturday morning meetings which have been organized and run by the Red Cross the Florida Industrial Commission and Omark Industries The Related Study Program has recessed for summer but will start again in September with classes being held on Saturday mornings and in the evenings The test battery has been established for insulation workers and 50 to 60 percent of the men in the local will take the test to establish the norm In the related study program in the Florida Industrial Commission pays for the instructors and the contractors pay for the consummable materials This program will have 144 hours per year and apprentices do not advance in the program unless they have the required number of related study hours per year Jim will be glad to send a copy of the Tampa program as well as forms they are using to anyone requesting them It was remarked that the related study program should include Industrial C Profits and Economics pitalism Mr. Covil reported that the open shop program was not operating at present The program is all set up but they could not get the minimum of 12 people to take part Page -3- They also pre working on an accelerated training orogram A report on the labor activity was given by Jim Ormsby 1 Greenville S. C. signed a three year contract for a wage increase of 1.95 The board allowance will also increase to a total of 8.00 during the three year period Asheville N. C. is a terminal city 2 Richmond Roanoke and Norfolk Virginia contracts run out on June 30 1970. No propress in negotiations at this time 3 Nashville Tenn has 16 items on a list of demands given to the contractors 4 Miami Florida settled for wage increase of 3.70 over three year period Mr. Ted Brodie Vice President of NICA remarks he extended greetings from NICA spoke on the national funds and President Marvin Gibbons In his opening Mr. Brodie outlined some of the problems and advised that NICA Labor Committee is made up of members from each regional These members must have the support of their associations The National Committee acts as a clearing house and there must be effective comm- unication maintained At the annual Spring Meeting the committee meets with its own members and then meets with the International Mr. Brodie pointed out that fair enforcement of labor contracts leads to good labor relations Mr. Brodie then went into short discussion of the three National Funds apprentice- ship industry and health pointed out that no force and safety The would be applied three funds are indivisable to have contracts opened to end it was include these funds He also pointed out that NICA has only set up the machinery whereby these funds can come into being in your prea but only if you so desire it It is a matter of contract negotiation on a local level A discussion followed on labor conditions in the industry and the part NICA can take to help local contractors Mr. Mr. Herb Mullenix expressed thanks to Bob Ross Bob Hume and officers the men responsible for this good meeting President Harrison reported that the association has received letters of appreciation for the past president cuff links from Mr. W. Manville John Houston Manville Knoxville Tenn Page 3 General Meeting Minutes The minutes of the Bay Hill meeting last June were approved as written Spence Royer President President of NICA were of Young Supply Company and Pat Yount introduced as guests of the Association Jack Smith Chairman of the Membership and Entertainment Committee asked for help in getting new members Palmer Covil and Wallace Robbins Delegates to NICA gave a summary of Directors of that Association report is attached hereto both of whom are Director of the meeting of the Board A copy of Wallace Robbins John Brennan gave a report on the activities of apprentice training having attended a conference in Fort Worth on this phase of the industry He pointed out that a motion had passed to establish regional training centers but no action had been taken Pat Yount reported on his conference with Andy Hass who is opposed to all three funds The International is against the health fund because they do not want contractors sitting on the committee Their opposition to the apprentice fund is based on the fact that through this fund the contractors have a say so in who the apprentices are The industry fund is looked on by the Union as a vehicle with which to fight them Pat forcefully pointed out the fact that if these funds are in a contract neither side by itself can do away with them As with any contract it takes both parties to change it Mr. Yount also emphasized the never dictate to the Regional fact that he believes or City Associations NICA His should belief is to the contrary the leadership should come up from the City to the Regionals to the National Spence Royer Chairman of the history of NICA's interest in insurance His Committee has NICA Insurance Committee gave a workman's compensation and come up with a specific insurance policy from three different companies who are willing to issue workman's compensation insurance on a nation basis to insulation workers Participation in such a program would of course be on a voluntary basis with each contractor Mr. Royer further stated that a decision would be made at the up coming Greenbrier NICA meeting as to which insurance company would be carrying the insurance He also reported on a meeting with OSHA officials In answer to a question concerning the ability Page 4 General Meeting Minutes of the employer to force the examination the OSHA answer employee was No to have one can a medical force them but we recommend that a waiver be obtained when a man refuses an examination Mr. Royer also pointed out the fact that much needs to be done by the industry to comply with OSHA regulations NICA could do this job and spread the cost among all contractors much cheaper than if each contractor did it individually However the money is not available to NICA for this job Tuesday October 3 The meeting was reconvened at 8:30 A.M. Mr. Wayne Killion called on some of the members to cite their experiences with OSHA inspectors Mr. Spence Royer Mr. Warren Jones and Mr. Chuck Watson recounted their experience with these people Dick Madigan Chairman of the Occupational Health Committee advised everyone to read the book put out by NICA on this subject He pointed out that the manufacturers probably would not be ready with asbestos free materials until sometime the latter part of 1973. In year when the insulation the meantime there will be almost a contractor will have to monitor his job for asbestos fibers This is a rather expensive procedure with a cost of about 150 per job as a rough estimate Lack of trained people to do this job was pointed out Mr. J. Mullenix Page 5 General Meeting Minutes There were no nominations from the floor and listed above were accepted by acclimation the nominees Herbert Mullenix Chairman of the NICA Labor Committee had nothing to report on meetings with the Union Executive Committee as none had been held due to the death of Union President Hutchinson The Union has been resisting such meetings for sometime Mr. Mullenix stated that they would probably be meeting in the future with the Regional Vice- Presidents Mr. Mullenix also gave a report on activities of the Wage Dispute Board The last meeting was August 30 with the next one scheduled for October 11. He pointed out that the work load was very heavy and as such took a lot of time for the members The highest wage rate approved within the last several months was 6.1 with the lowest around % The Union was continuing its policy of voting to approve any wage rate that came to the Dispute Board in a contract He read a letter of appeal to an adverse decision of the Board and told the members that any time such a letter was written the very least the contractors could do was to write a letter refuting some of the Mr. Hass is stated that arguments put forth in the Union letter Apparently fighting the Board in every way possible Mullenix in his opinion the Board had done as heavy a job as was possible Mr. Mullenix plead for a broader base for SEICA and stated that in his opinion the Association was oriented too much towards problems with Union labor The meeting broke up into open and closed shop groups for group labor discussions The open shop contractors in their report to the Association agreed to pay their share of Craft Dispute Board's expenses They also stated they had agreed to pay into an industry fund the amount of one cent per hour worked starting January 1 1973 providing of course that NICA makes a way available to do this There was some discussion on District 50's merger Steel Workers Union and the effect this will have who have a contract with District 50 with the on shops Pat Yount remarked NICA activities do tors that he realized that many if not most of not offer much help to open shop contrac- Page 6 General Meeting Minutes A motion was made by Bill DeMeritt to put the record as favoring a 20 per hour contribution fund The motion passed Association on to an industry Pat Yount discussed some of the details of the obstacles thrown into the road of the funds by the Union He pointed out that Mr. Hass goal was to take the per hour now being paid into the funds and put it on the Union member's pay check then make a deduction of 6 and send it to the Union for use in their own funds He also pointed out some of the resolutions passed at the Las Vegas Union meeting such as prohibiting traveling of apprentices charging for emergency permits paying tional all and seven Vice many other Presidents as employees of the Interna- resolutions that would hamper the contractor to the benefit of the Union Mr. Mullenix challenged all the educational programs as had been officers to done in the put on past more Bob Dean made a motion to pledge the full amount billed by NICA for Craft Board Expenses in each area providing full payment is not made by the area contractors This seconded by Pete Thurston and passed unanimously motion was The meeting adjourned at 12:15 P.M. Gilray Attorney Melvin Bott of Carday Associates The minutes of the Spring Meeting held at the Wm Hilton Inn was distributed The reading of the minutes for the Spring Meeting was dispensed with by motion and was approved as written with one exception The Minutes read as follows Our Attorney Mr. Robert A. Dobson had said that we cannot hire permanent replacement employees during an economic strike This is incorrect have read Mr. Dobson stated that we can hire The Minutes should permanent replacement employees during an unfair labor strike The treasurers report was given by J. T. Hunter followed by a motion to approve as read which was carried unanimously It was agreed there would be no registration fee for the visiting charter members The question was raised As a profit organization are reports that must be filed by us to either the City State or Federal Government Answer by Mr. Dobson our Attorney Dobson will check on our status and advise there County Mr. The report on the arrears list was given by Mr. Sam Burns Sam reports handling costs of approximately 350.00 per year and made a strong appeal for the continuation of the arrears list It was noted that out of 47 members in the association only 28 members participated during the year Out of these 28 members only 14 members participated each month during the year -2- Following about the Sam's report advisability there was a lengthy discussion of continuing the arrears list from the floor and if continued how it could be improved and changed to better serve the entire association The following motion was made by Joe Hoffman The arrears list program depends on the participation of a majority of our membership And whereas over the past four years a majority of our membership has decided not to participate in our arrears list be it resolved that the arrears list program be discontinued program effective this date After more discussion from the floor Mr. Hotfman's motion died for the lack of a 2nd so it was decided that the arrears list would be continued Mr. Robert Dobson III our Attorney again instructed the association that misuse of the arrears list could subject the association to some serious is on a legal problems voluntary basis There is no and that we problem so long as as an association the use recording the report for information only The entertainment report was given by John Brennan and Charlie McDaniel The nomination committee report was given President John H. Co. in Spartanburg and Frank Smith of Insulation Applicators in Atlanta A Standards and Specifications report by Jim Ennis Jim reports that our new manual entitled Thermal Insulation will be ready for publication by March 1969. Jim promises this to be an excellent publication that will sell to our association members for about 15.00 per copy A report on safety and health was given by Bob Dean during which publications from NIMA were passed out These publications are entitled Recommended Health Safety Practices for Handling and Applying Thermal Insulation Products containing Asbesto ansd Containing Mineral Fibers Bob Dean introduced Mr. Melvin A. Bott Jr. who is the Administrative President of Carday Assoc Inc. Mr. Botts reports that the South Eastern States and Central States Welfare funds have merged as of August 1 1968. Booklets entitled The National Asbestos Welfare Fund were distributed to all members present Mr. Botts reports three prime reasons for this merger of the Southeastern States and Central States Welfare Fund are 1. To provide a larger area for the individual to work in and still remain eligible 2 To lessen the administrative cost in general 3. A report on Apprentice Training Programs was given by Jim Ormsby Tampa Florida now has an approved program patterned after the Jacksonville Florida program in part The related study portion of the program is in the process of being set up and will consist of 144 hours of work The state of Florida will give aid to the program and the Red Cross and Industrial Commission will be used in the Safety and Scaffolding instruction Fourth Year Improvers are given a Pipe Rack test before turning out as mechanics Jim also reported that Tampa had just extended their labor contract which was to expire on June 30 1969 for a three year period for a package of 1.50 John Brennan announced that Shook and Fletcher Insulation Company had given notice of their intent to withdraw from the Association as had the Birmingham Branch of Breeding Insulation Company -2- A Health and Safety Program was put on by Mr. Cliff Sheckler and Mr. John Vyverberg representing the National Insulation Manufacturers Association NIMA Particular attention was called to two pieces of legislation pending in The Congress 1 Revision of Walsh Healy Act to establish the Threshold limit values of toxic dusts on Government work to 2.0 MPPCF 2 House Bill No. 2503 - Asbestos Workers Health Protection Act It was pointed out that neighborhood cases of Asbestosis were appearing brought up by people living in the surrounding areas of plants processing or fabricating materials using asbestos The proper control of dust on jobs and good housekeeping on jobs will help to prevent Asbestosis Contractors should keep good records of the various jobs men work on and should strive for employment Physical Examinations including Ray of Lungs for Asbestos Workers The Meeting was recessed at 12:05 P. M.
