Asbestos discovery of documents from the Southeastern Insulation
Contractors Association
Dear Jim
Some time ago you requested us to subpoena documents from the Southeastern
Insulation Contractors Association in Nashville In accordance with your
instructions we had a subpoena duces tecum issued in the asbestos lawsuit of William D. Ferrell et ux which is pending in the Circuit Court for Davidson County Tennessee docket number C 3563. I am enclosing a copy of the subpoena duces tecum which was issued and served on Jean Y. Dean the Executive Secretary of the Southeastern Insulation Contractors Association SEICA I had several conversations with Mrs. Dean and with Attorney Gardner Courson in Atlanta who represents SEICA Mr. Courson agreed that the requested documents would be produced on a voluntary basis for our inspection and copying Therefore we notified all counsel in the Ferrell lawsuit that there would be no deposition and no production of documents pursuant to the subpoena duces tecum
You advised me that there was no necessity for an immediate review of the documents
and it was several weeks before I was able to arrange a convenient time with
Mrs. Dean for a review of the documents I went to Nashville on April 23 1982 and reviewed the documents produced at the home of Mrs. Dean Mrs. Dean agreed to copy certain documents which I designated and finally I received copies of the documents a few days ago I am enclosing a separate memorandum concerning the documents produced and comments about information which I obtained from Mrs. Dean Mr. Charles Carver an officer of Breeding Insulation Company and a director for SEICA met with us Both of them were very cooperative and friendly They seemed to have no knowledge of any controversy or pending litigation between the Contractors Association and the asbestos insulation product manufacturers
Please review the enlosed memorandum and the documents which are also enclosed
I do not feel that any of the documents contain any surprising or very significant information The minutes do establish that the Contractors Association learned
about the asbestos hazard back in the late 1960's and that Sheckler did appear
at one of the regional meetings I reviewed all of the documents produced but saw no necessity of copying other documents If you have any questions about
the other documents or desire that I contact Mrs. Dean for any reason I will

I made copies of the Minutes of Organizational Meetings of Board of
Directors of Associated Asbestos Contractors of the Southeastern States Inc.
on June 6 1960 and of all Minutes from October 14 1963 until October 13 I did not have time to review all of these Minutes in detail and decided to

Attorney Jim Gilreath advised that the latest copy of the Laws is the 1964 Revision plus one admendment He also advised that new Laws would be printed and would

Hume asked that Mr. Sam Burns speak concerning the participation of the members in the Arrears List Out of the 60 members in the association only 6 made reports to the list in the last 6 months Twelve to twenty units have reported at various times during the year and the approximate cost of continuing the list amounts to 708.00 per year Mr. Burns stated that he didn't think it advisable
to continue with this expenditure with so little participation

Deen He pointed out the contractors in the Western States Association have been quite active in the area of health and safety He stressed the fact that good housekeeping always leads to safer jobs and fewer health hazards from dust The possibility exists that the future insulating cements will be mixed in plastic bags There is also a possibility of a general law being put on the books which will require a man to have a physical examination before working with asbestos materials He stressed the importance of each individual contractor policing his own jobs and areas Safe scaffolding should be insisted upon

The test battery has been established for insulation workers and 50 to 60 percent
of the men in the local will take the test to establish the norm
In the related study program in the Florida Industrial Commission pays for the
instructors and the contractors pay for the consummable materials This program
will have 144 hours per year and apprentices do not advance in the program unless they have the required number of related study hours per year
Jim will be glad to send a copy of the Tampa program as well as forms they are using to anyone requesting them

The National Committee acts as a clearing house and there must be effective comm-

enforcement of labor contracts leads to good labor relations
Mr. Brodie then went into short discussion of the three National Funds apprentice-
ship industry and health pointed out that no force

John Brennan gave a report on the activities of apprentice training having attended a conference in Fort Worth on this phase of the industry He pointed out that a motion had passed to establish regional training centers but no action had been
taken
Pat Yount reported on his conference with Andy Hass who is opposed to all three funds The International is against the health fund because they do not want contractors sitting on
the committee Their opposition to the apprentice fund is
based on the fact that through this fund the contractors have
a say so in who the apprentices are The industry fund is looked on by the Union as a vehicle with which to fight them Pat forcefully pointed out the fact that if these funds are in a contract neither side by itself can do away with them As
with any contract it takes both parties to change it

carrying the insurance He also reported on a meeting with OSHA officials In answer to a question concerning the ability

examination Mr. Royer also pointed out the fact that much needs to be done by the industry to comply with OSHA regulations NICA could do this job and spread the cost among all contractors much cheaper than if each contractor did it individually However the money is not available to NICA for this job

Mr. Wayne Killion called on some of the members to cite their experiences with OSHA inspectors Mr. Spence Royer Mr. Warren Jones and Mr. Chuck Watson recounted their experience with these people
Dick Madigan Chairman of the Occupational Health Committee
advised everyone to read the book put out by NICA on this
subject He pointed out that the manufacturers probably would
not be ready with asbestos free materials until sometime the
latter part of 1973. In

Herbert Mullenix Chairman of the NICA Labor Committee had
nothing to report on meetings with the Union Executive
Committee as none had been held due to the death of Union
President Hutchinson The Union has been resisting such meetings for sometime Mr. Mullenix stated that they would probably be meeting in the future with the Regional Vice-
Presidents
Mr. Mullenix also gave a report on activities of the Wage Dispute Board The last meeting was August 30 with the next one scheduled for October 11. He pointed out that the work
load was very heavy and as such took a lot of time for the members The highest wage rate approved within the last several months was 6.1 with the lowest around % The Union
was continuing its policy of voting to approve any wage rate that came to the Dispute Board in a contract He read a letter of appeal to an adverse decision of the Board and told
the members that any time such a letter was written the very least the contractors could do was to write a letter refuting
some of the Mr. Hass is stated that
arguments put forth in the Union letter Apparently fighting the Board in every way possible Mullenix in his opinion the Board had done as heavy a job
as was possible
Mr. Mullenix plead for a broader base for SEICA and stated that in his opinion the Association was oriented too much
towards problems with Union labor
The meeting broke up into open and closed shop groups for group labor discussions The open shop contractors in their report to the Association agreed to pay their share of Craft Dispute Board's expenses They also stated they had agreed to pay into an industry fund the amount of one cent per hour worked starting January 1 1973 providing of course that

A report on safety and health was given by Bob Dean during which publications from NIMA were passed out These publications are entitled Recommended Health Safety Practices for Handling and Applying Thermal
Insulation Products containing Asbesto ansd Containing Mineral Fibers
Bob Dean introduced Mr. Melvin A. Bott Jr. who is the Administrative
President of Carday Assoc Inc. Mr. Botts reports that the South Eastern States and Central States Welfare funds have merged as of August 1 1968. Booklets entitled The National Asbestos Welfare Fund were distributed to all members present Mr. Botts reports three prime reasons for this merger of the Southeastern States and Central
States Welfare Fund are
1. To provide a larger area for the individual to work in and still remain eligible
2 To lessen the administrative cost in general 3. A savings that would then be available for increased benefits
Mr. Botts then explained in detail the methods of setting up and operating welfare and pension plans Mr. Botts reports that payments to these funds must be made by the contractor by the end of the month following the month in which the hours were worked There will be a penalty on delinquent employers of 10 of the normal monthly amount

Florida now has an approved program patterned after the Jacksonville
Florida program in part The related study portion of the program is in
the process of being set up and will consist of 144 hours of work

Industrial Commission will be used in the Safety and Scaffolding
instruction Fourth Year Improvers are given a Pipe Rack test before

extended their labor contract which was to expire on June 30 1969 for
a three year period for a package of 1.50
John Brennan announced that Shook and Fletcher Insulation Company had
given notice of their intent to withdraw from the Association as had the Birmingham Branch of Breeding Insulation Company

limit values of toxic dusts on Government work to 2.0 MPPCF 2 House Bill No. 2503 - Asbestos Workers Health Protection Act
It was pointed out that neighborhood cases of Asbestosis were appearing brought up by people living in the surrounding areas of plants processing
or fabricating materials using asbestos The proper control of dust on jobs and good housekeeping on jobs will help to prevent Asbestosis
Contractors should keep good records of the various jobs men work on and should strive for employment Physical Examinations including Ray of
Lungs for Asbestos Workers
