The waiver also addresses temporary waste piles at regulated and nonregulated facilities, temporary surface impoundments at nonregulated facilities, discharges of diseased mass mortality wastes to emergency landfills, and emergency wastes not from emergency-declared disaster areas. The waiver is intended to facilitate prompt disposal of waste generated during the emergency response and cleanup of federally- or governor-declared disaster areas and local state of emergencies. The rule would revise coliform sampling, analyses, treatment technique triggers, and assessment requirements to update references to federal Sierra Club v. EPA, 1:17-cv-01906 ED_001523_00003668-00001 standards. The rule also would update the definition of "clean compliance history" and update reporting requirements. The rule updates provisions concerning requests for adjudicatory hearings, administrative penalties, individual sewage disposal systems, composting and solid waste management facilities, freshwater wetlands, sewage sludge, water quality, and fish and wildlife. The rule is effective July 27, 2017. EPA, 1:17-cv-01906 ED_001523_00003668-00002 14.07, regarding the availability of public records. The rule allows the agency to request customized service charges in the amount of actual cost of service used. The rule also clarifies that members of the public may request records orally or through the agency's website. In addition, the rule provides that the agency may request members of the public to prioritize requests if more than one is submitted within a 30-day period and adds requirements concerning response burden estimates. Finally, the rule updates the list of exemptions applicable to public records and fees. The rule is effective Dec. 1,2017. The rule would allow the notices to be issued regardless of any criminal charges or convictions related to the conduct and allow a civil penalty of $5,000 to be assessed for violations. The rule also would add related definitions. A hearing is scheduled for Dec. 7, 2017, in Spokane. Comments are due Dec. 7, 2017. The rule increases the appeal extension period to up to 45 working days and increases the total reassumption time period to up to 75 working days if all parties agree to the 45-day extension. The rule also allows appeals to be filed electronically. The rule is effective Jan. 1, 2018. EPA, 1:17-cv-01906 ED_001523_00003668-00003 regarding air contaminant standards and permissible exposure limits for respirable crystalline silica. The rule would incorporate June 23, 2016, federal amendments to standards under 29 CFR 1910 and 1926 regarding occupational exposure to respirable crystalline silica for construction, general industry, and maritime workers. The amendments establish workplace exposure limits and requirements for exposure control methods, respiratory protection, hazard communication, and medical surveillance. A hearing is scheduled for Dec. 15, 2017, in Tumwater. Comments are due Dec. 22, 2017.
