The time has come for the EPA to deliver on that promise. This letter is to inform you that the EPA is reconsidering the claim you submitted under the Federal Tort Claims Act for damages in connection with the Gold King Mine incident. Although your claim was previously denied, the agency has reexamined the applicable law and facts pertaining to your claim and has decided to move forward analyzing additional aspects of your claim. In accordance with the EPA's regulations implementing the Federal Tort Claims Act at 40 C.F.R. 10.4, the EPA will base its review on the documentation accompanying your claim as well as any additional documentation you may provide in response to this letter. In order for the EPA to fully evaluate your claim and conclude this new review in a timely manner, please submit the following documentation that is relevant to your claim within three months of the date of this letter if you have not already submitted it to the agency: If you are claiming personal injury, submit (1) a written report by an attending physician setting forth the nature and extent of the injury, nature and extent of treatment, any degree of temporary or permanent disability, the prognosis, period of hospitalization and any diminished earning capacity: (2) itemized bills or receipts for medical expenses; (3) a statement of expected duration of and expenses for any necessary future treatment; (4) a written statement from your employer showing actual time lost from employment, whether you are a full- or part-time employee and wages or salary actually lost; and/or (5) in the case of self-employment, documentary evidence show ing the amount of earnings actually lost. 1200 Pennsylvania Avt.
