The rule updates definitions for radiation control to reflect a concurrent final rule that updates regulations under 6 CCR 1007-1, Part 17, concerning transportation of radioactive materials. The rule expands exemptions for transportation of certain low-level radioactive materials, clarifies that the state is responsible for review of certain packagerelated quality assurance programs for use of Type B packages under a general license, and incorporates federal requirements for package quality assurance. The rule also expands recordkeeping requirements for irradiated fissile material shipments, adds package and conveyance equations used for calculating limits for mixtures or unknown quantities of radioactive materials, and revises and adds package limits for certain isotopes. In addition, the rule revises definitions and updates contact information for notifications for shipments of nuclear waste. The rule is effective Nov. 14, 2017. EPA, 1:17-cv-01906 ED_001523_00000730-00001 --Colorado Register (10/25/2017) Regulatory Update PESTICIDES Administration and Enforcement of the Pesticide Act Colorado PESTICIDES Final rule of the Department of Agriculture, Plant Industry Division, amends regulations under 8 CCR 1203-1 regarding the administration and enforcement of the Pesticide Act. The rule updates the incorporation by reference of federal standards under 40 CFR 152,153,156, and 167 as of 2016, including provisions of a Feb. 26, 2016, final rule that clarified active and inert ingredients that are permitted in products eligible for the minimum risk pesticide exemption. I ove r@state. co. us --Colorado Register (10/25/2017) Regulatory Update PESTICIDES Administration and Enforcement of the Pesticide Applicator's Act Colorado PESTICIDES Final rule of the Department of Agriculture, Plant Industry Division, amends regulations under 8 CCR 1203-2 regarding the administration and enforcement of the Pesticide Applicators' Act. The rule revises criteria for determining which pesticides may be used in the cultivation of cannabis to allow for the use of unregistered pesticides only during research and demonstration activities. The rule also updates commercial applicator storage signage requirements to permit the use of other types of standardized pesticide storage signage, maintains current emergency contact information requirements and storage marking provisions, and requires any applicator who obtains a waiver of sign requirement from a local fire department to maintain a copy of that waiver in their files. In addition, the rule adds a new post-harvest potato pest control category. The rule is effective Nov. 30, 2017. Contact: Thomas Izzo; DBPR; 850-488-0062 --Florida Administrative Weekly (10/25/2017) Regulatory Update Iowa OCCUPATIONAL SAFETY AND HEALTH Fire Safety Requirements for Hospitals and Health Care Facilities Iowa OCCUPATIONAL SAFETY AND HEALTH Proposed rule of the Department of Public Safety, State Fire Marshal Division, amends regulations under 661 IAC 205.1, .5, .10, .15, .20, and .25 regarding fire safety requirements for hospitals and health care facilities. The rule updates the incorporation by reference of the National Fire Protection Association's Life Safety Code to reflect the 2012 edition. The code addresses safety standards and requirements for hospitals, nursing facilities, hospices, intermediate care facilities for persons with intellectual disabilities or mental illness, ambulatory care facilities, and religious nonmedical facilities. The rule also removes certain state-specific Sierra Club v. EPA, 1:17-cv-01906 ED_001523_00000730-00003 standards. A hearing is scheduled for Nov. 14, 2017, in Des Moines. The rule addresses requirements for surface conditions, ladders, step bolts and manhole steps, stairways, dockboards, scaffolds and rope descent systems, and fall protection.
