Final rule of the EPA partially approves and partially disapproves a revision to the Texas SIP for regional haze and the Texas federal implementation plan (FIP). The partial approval addresses the state's determination that its electric generating units (EGUs) are not subject to best available retrofit technology (BART) for particulate matter (PM). The partial disapproval addresses the finding that the BART alternatives to address sulfur dioxide (SO2) and nitrogen dioxide BART at state EGUs meet the interstate visibility transport requirements for 1997 eight-hour ozone, 1997 24-hour and annual PM-2.5, 2006 24-hour PM-2.5, 2008 eight-hour ozone, 2010 one-hour nitrogen dioxide, and 2010 one-hour SO2 NAAQS. The rule is in response to the remand of certain Cross State Air Pollution Rule emission budgets. The rule is effective Nov. 16, 2017. California/Lake Elsinore Advanced Pumped Storage Project GENERAL ENVIRONMENT AND SAFETY
Notice of FERC announces the filing of a major unconstructed project license application by Nevada Hydro Co., of Vista, Calif., for the Lake Elsinore Advanced Pumped Storage Project on Lake Elsinore and San Juan Creek in Riverside and San Diego counties in California. The project, which would occupy 845 acres of federal land, would create a new upper reservoir in the mountains west of Lake Elsinore formed in a natural canyon by constructing a 200-foot high dam. The project also would include an underground powerhouse with two reversible pump-turbine units with a total installed capacity of 500 megawatts and about 32 miles of transmission line connecting to existing transmission lines. The lake and reservoir would be interconnected by one or two large pipes to generate hydroelectricity to be transmitted to the state's power grid and to store electricity produced during off-peak hours. Notice of the U.S. Section of the International Boundary and Water Commission announces the availability of a draft environmental assessment and finding of no significant impact for sediment control alternatives for the Rio Grande Canalization Project at Thurman I and II Arroyos in Hatch, N.M. The proposed project involves sediment control at two ephemeral tributaries of the Rio Grande within a portion of the Rio Grande Canalization Project protective levee system to control the inflow of sediment into the Rio Grande mainstem. The EA evaluates the no action alternative of routine sediment excavation, the construction of mesh-based sediment traps, and the preferred alternative of the construction of sediment basins at each arroyo. Notice of the NRC announces the availability of a draft regulatory analysis for a final rule addressing low-level radioactive waste (LLRW) disposal facilities. The rule, originally proposed March 26, 2015 (80 FR 16081), would require new and revised site-specific technical analyses and allow the development of site-specific criteria for LLRW based on the results of such analyses. A draft final rule package was developed in September 2016, and the NRC currently is preparing a supplemental proposed rule planned for 2018. The changes would establish a compliance period of 1,000 years, independent of radionuclide content, and address when the new requirements would apply to currently operating LLRW disposal facilities. Comments are requested on how to improve the approach/methodology and actual cost data used in the draft final rule regulatory analysis in light of the changes. The NRC will hold a meeting during the comment period. Comments are due Nov. 16, 2017.
