DEFENDANT KERR-McGEE CORPORATION'S FIRST SUPPLEMENTAL RESPONSE TO PLAINTIFF WELDON R. MOAKE'S REQUEST FOR DISCLOSURE
REQUEST FOR DISCLOSURE (c): the legal theories and, in general, the factual bases of the responding party's claims or defenses (the responding party need not marshal all evidence that may be offered at trial).
SUPPLEMENTAL RESPONSE:
8. Defendant, Kerr-McGee is not responsible for any alleged injury claimed by Plaintiffs because, to the extent Mr. Moake was at the Southwestern oil refinery, he was not exposed in sufficient concentration and for sufficient duration to have caused or contributed to the development of any disease. Therefore, any exposure was neither a cause in fact nor proximate cause of the Plaintiffs alleged injuries.
9. As a matter of law and fact, Mr. Moake is an expert in the field of industrial insulation products and he as well as his employer have or are presumed to have knowledge of the dangers inherent in the products he sold, thus Kerr Mc-Gee had no duty to warn Mr. Moake of the dangers of asbestos insulation products.
10. The illnesses and damages of Plaintiffs, if any, are due solely to other causes and matters which are not related to this Defendant's acts or conduct in that Plaintiffs illnesses, if any, are the result of natural health processes and would have occurred just as they did irrespective of this Defendant's actions and conduct.
11. Plaintiffs' claims are barred by the doctrine of laches.
