We will work with your staff to reschedule our meeting as soon as possible, but ask that you delay finalizing th^Problem Formulation Document for asbestos until we have had an opportunity to express our views and present new evidence to you and your staff. We are deeply concerned that the Problem Formulation Document will follow EPA 's June 2017 Scope of the Risk Evaluationfor Asbestos by excluding ongoing exposure from legacy asbestos products that remain in use and installed attic insulation containing Libby Amphibole asbestos from the EPA risk evaluation. We and several other groups opposed these exclusions in comments on the scoping document and Administrator Pruitt agreed to reexamine them in recent Congressional testimony. To exclude these important sources o f exposure and risk would not only be contrary to TSCA, but would also result in an incomplete risk evaluation that would fail to address serious threats to public health. In addition to these exclusions, the PIPA should include chlor-alkali industry asbestos diaphragms used during the chlor-alkali manufacturing process in its risk evaluation. In 2016, the chlor-alkali industry imported 702 metric tons o f raw asbestos rather than the 340 tons the U.S. Geological Survey previously estimated. There are numerous pathways o f asbestos exposure for those mining, transporting, handling, repairing, removing, and disposing o f asbestos for the chlor-alkali industry. Safer substitute materials are commercially available and have been adopted by numerous companies in the industry. This use is the last remaining application for which bulk asbestos is being imported into the United States. The EPA should include chlor-alkali use in its risk evaluation, conclude that it presents an unreasonable risk o f injury,and ban this obsolete hazardous technology7. Sierra Club v.
