Proposed rule of the Department of Environmental Quality, Pollution Control and Ecology Commission, amends Regulation 12 regarding storage tanks. The rule removes the 1,000-foot limitation for secondary containment and monitoring for all new or replaced underground storage tanks (USTs), secondary containment, and monitoring and for all new or replaced piping connected to any UST and for under-dispenser spill containment for all new or replacement motor fuel dispenser systems. The rule also makes registration of aboveground storage tanks (ASTs) optional and allows the owner or operator of an AST containing petroleum to be potentially eligible for reimbursement under the Petroleum Storage Tank Trust Fund Act if the tank is registered and all required fees are paid. In addition, the rule incorporates by reference federal standards under 40 CFR 280 and 281 relating to airport hydrant fuel distribution systems and field construction tanks. regulations under 16 CCR 3303 through 3371 (nonconsecutive), adopts regulations under 16 CCR 3353.1 and 3353.2, and repeals regulations under 16 CCR 3356.1 and 3359 regarding automotive repair dealers. The rule allows the use of electronic technologies in disclosing information to and obtaining information from consumers before, during, and after repair transactions. The rule also clarifies that estimates must be provided to and authorized by customers before diagnosis or repair begins and specifies content requirements for estimates. In addition, the rule addresses requirements for recording initial authorization in the context of unusual circumstances, authorization of work that exceeds or changes what was originally estimated, and the return of replaced parts. Finally, the rule addresses sublet disclosures, updates recordkeeping requirements, and revises and adds definitions. A hearing is scheduled for Sept. 26, 2017, in Rancho Cordova. Final rule of the Pollution Control Financing Authority adopts regulations under 4 CCR 8078.15 through 8078.21 regarding the Seismic Safety Capital Access Loan Program. The rule establishes an alternate procedure for qualified residential properties and small business owners to obtain loans to finance the costs of seismically retrofitting residences and small businesses. The rule also provides a credit enhancement to support private bank loans to qualified residential and commercial property owners to make improvements to mitigate seismic damage. California HAZARDOUS WASTE MANAGEMENT
Proposed rule of the Department of Toxic Substances Control adopts regulations under 22 CCR 68400.5, 69020, 69021, and 69022 to establish a narrative cleanup performance standard and toxicity criteria for use in human health risk assessments and to set risk-based screening levels and remediation goals. The rule establishes toxicity criteria that are more protective than federal requirements and sets forth requirements for environmental justice and children's health protection goals. The rule also defines the protective risk-based screening level as one in a million for cancer risk and a hazard quotient of one for noncancer risk for all screening level risk assessments and requires use of best available science. In addition, the rule applies toxicity criteria to risk-based cleanups at all hazardous substances release sites and requires use of the risk-based cleanup screening levels and remediation goals at federal hazardous substance cleanup sites in the state. The criteria will be used in corrective actions under the Hazardous Waste Control Law, response actions under the Hazardous Substances Account Act, and actions under the California Land Reuse and Revitalization Act. Workshops are scheduled for Aug. 28 and 31, 2017, in Sacramento and Cypress, respectively, and via webcast. A hearing is scheduled for Sept. 20, 2017, in Sacramento and via webcast. Notice of the Department of Resources Recycling and Recovery announces the readoption of a Sept. 4, 2015, emergency rule that amended regulations under 14 CCR 18660.5 through 18660,24 (nonconsecutive) to revise criteria and conditions regarding the disposition of cathode ray tube (CRT) glass derived from the processing of certain covered electronic waste. The rule removes existing prohibitions on the disposal of treatment residual CRT glass and allows for all otherwise legal dispositions. The rule also revises documentation requirements and sets forth time limits on the ultimate disposition of treatment residual CRT glass. The rule is effective Aug. 21, 2017, and expires Aug. 21,2019. Notice of the Office of Environmental Health Hazard Assessment announces the availability of a draft technical support document and a workshop concerning updates to the public health goals for cis-1,2-dichloroethylene and trans-1,2-dichloroethylene in drinking water. An updated public health goal of 13 parts per billion (ppb) is proposed for cis-1,2-dichloroethylene, and an updated public health goal of 50 ppb is proposed for trans-1,2-dichloroethylene. After the workshop, the agency will submit a draft risk assessment for external scientific peer review, revise the technical support document to address comments, and provide an additional comment period. Water Quality Monitoring and Assessment Report

Notice of the Department of Environmental Protection announces the availability of the final 2016 integrated water quality monitoring and assessment report as required by Sections 303(d) and 305(b) of the Clean Water Act. The final report, which includes a description of water quality management programs and water body-specific lists of surface waters, lists seven waters as high priority for total maximum daily load (TMDL) development and 17 waters selected to be restored through alternatives to TMDLs.
