The collection addresses requirements for manufacturers of heavy-duty highway and nonroad engines to submit DIRs (Form 5900-301) if emission-related defects that may cause the engines' emissions to exceed Clean Air Act standards are found on engines of the same model year. The revisions update the emissions fee for permitted sources as set by Missouri law from $40 to $48 per ton of air pollution emitted annually, effective Jan. 1, 2016. The rule also corrects the Jan. 15, 2016, direct final rule (81 FR 2090) that previously approved the revisions by removing the approval and codification under 40 CFR 52.1320 due to an agency error. In addition, the rule corrects the state effective date to March 30, 2015, under 40 CFR 70, Appendix A. The rule is effective July 31, 2017. Lima Refining Co. (Civil Action No. 3:17-cv-01320-JZ), lodged June 22, 2017, with the U.S. District Court for the Northern District of Ohio. The consent decree would resolve claims regarding alleged Clean Air Act violations at Lima Refining's petroleum refinery located in Lima, Ohio, and claims for stipulated penalties for violations of a 2007 consent decree addendum involving the facility. The consent decree would require the defendant to pay $1 million in penalties and to perform injunctive relief concerning its leak detection and repair program, continuous emissions monitoring system, flare efficiency and minimization, and its sulfur recovery plant. The defendant also would be required to perform a lead paint abatement supplemental environmental project, and to install oxygen enrichment at two of its sulfur recovery units as mitigation. The projects involve the construction and operation of natural gas pipeline facilities by Mountain Valley Pipeline LLC in Virginia and West Virginia and by Equitrans LP in Pennsylvania and West Virginia. The final EIS, which was prepared in cooperation with the EPA, the U.S. Army Corps of Engineers, the Transportation Department, the U.S. Fish and Wildlife Service, and the Bureau of Land Management, concludes that the project would result in some adverse environmental impacts that would be reduced to less than significant levels through the proposed mitigation measures. The rule also revises requirements for hearings and enforcement actions and updates definitions. The final rule includes numerous changes and clarifications to the rule as proposed. For example, the final rule allows the executive director to use past grandfathering determinations and allows the commission to waive certain registration information if a project is relying on a past grandfathering determination. The final rule does not finalize proposed changes to the consumptive use mitigation policy. The commission plans to reevaluate its policies and procedures for consumptive use and consumptive use mitigation in a more comprehensive fashion. The rule is effective July 1, 2017. Provisions concerning registration of grandfathered projects and grandfathered consumptive use are effective Jan. 1, 2018. Facilities are required to submit information upon waiver reapplication or application revision and must continually submit monitoring and toxic control program information. States are required to submit determinations and certify that state water quality laws are satisfied under the waiver. Comments are due Aug. 28, 2017.
