Proposed rule of the EPA would approve a revision to the Arizona SIP concerning the second 10year maintenance plan for the San Manuel area in Arizona for the 1971 sulfur dioxide (SO2) NAAQS. The plan demonstrates the area's continued maintenance of the NAAQS, in part, by showing that future emissions of SO2 will not exceed the level of the attainment inventory. The plan includes emissions inventories representing current emissions for 2014 for area sources, projected emissions for two interim years during the second maintenance period, and projected emissions for the tenth year of the second maintenance period. Final rule of the EPA approves revisions to the Utah SIP concerning ozone offset requirements for major sources in Davis and Salt Lake counties. The revisions update definitions and applicability and address offset provisions of the nonattainment area new source review permitting program after the area is redesignated to attainment for ozone. The revisions also establish more stringent offset requirements for nitrogen oxides that may be triggered as a contingency measure under the ozone maintenance plan. AIR Voluntary Criteria for Radon Credentialing Organizations AIR
Notice of the EPA announces the extension of the comment period for an Aug. 23, 2017, notice (82 FR 39993) regarding the establishment of voluntary criteria specifying a standard of competence for organizations that credential radon service providers under the Indoor Radon Abatement Act The EPA intends to establish an ongoing and open evaluation process of the National Radon Proficiency Program, the National Radon Safety Board, and state-run certification programs. The EPA also intends to require the organizations to meet the specified standards of the International Organization of Standardization and the International Electrotechnical Commission, and to incorporate device requirements. The EPA seeks comments regarding three separate scenarios, including the agency's development of a basic framework for credentialing organizations, the agency's support for the development of the initial certification scheme, and the agency's support for the development and maintenance of a certification scheme. Notice of the U.S. Fish and Wildlife Service announces the availability of 12-month findings on petitions to list 25 species as threatened or endangered. The agency has determined that it is not warranted at this time to list 14 Nevada springsnail species, the Barbour's map turtle, Bicknell's thrush, Big Blue Spring cave crayfish, Florida Keys mole skink, Great Sand Dunes tiger beetle, Kirtland's snake, Pacific walrus, or San Felipe gambusia. The agency also has determined that it is not warranted at this time to list certain populations of the black-backed woodpecker, boreal toad, or fisher. The waiver requires the fuel transport to be accompanied by law enforcement or military escort; the escort vehicle to have a copy of the Emergency Response Guidebook, Response Guide 128; and drivers to have three years professional experience. The waiver also requires unloading procedures to be overseen by a qualified individual or a driver who has received specified training and for the unloading area to be cleared of all nonessential personnel within 100 feet during driver unloading. Final rule of the Mine Safety and Health Administration delays until June 2, 2018, the effective date of a Jan. 23, 2017, final rule (82 FR 7680) that updated standards for the examination of working places in metal and nonmetal mines. Working place examination standards that were in effect as of Oct. 1, 2017, are reinstated until June 2, 2018. The delayed rule requires operators to promptly notify miners of any conditions found that may adversely affect their safety or health, and requires operators to promptly take corrective action. The rule also requires the examination record to include the name of the examiner, examination date, location of areas examined, a description of adverse conditions found, and the date of corrective action. In addition, the rule requires operators to make the examination record available to authorized representatives of the secretary of Labor and miners' representatives and to provide a copy upon request. MSHA previously delayed the effective date to assure that mine operators and miners affected by the rule have the required training and compliance assistance (82 FR 15173; 03/27/2017) and to allow additional time for the agency to provide stakeholders training and compliance assistance (82 FR 23139; 05/22/2017). The current action allows additional time for MSHA to provide stakeholders training and compliance assistance and provides more time to train inspectors. A Sept. 12, 2017, proposed rule (82 FR 42757) would make limited changes to the delayed rule concerning working place examinations. The rule is effective Oct. 5, 2017. Proposed rule of the Bureau of Land Management would temporarily suspend or delay until Jan. 1, 2019, certain provisions of a Nov. 18, 2016, final rule (81 FR 83008) regarding requirements to reduce waste of natural gas from venting, flaring, and leaks during oil and natural gas production activities on onshore federal and Indian leases. The current action would address drilling applications and plans; gas capture requirements; measuring and reporting of volumes of gas vented and flared from wells; determinations for royalty-free flaring; well drilling, completion, and related activities; equipment requirements for pneumatic controllers, pneumatic diaphragm pumps, and storage vessels; downhole maintenance and liquid unloading; and operator responsibilities. Notice of the EPA announces an extension of the comment period for a Sept. 6, 2017, draft pesticide registration notice (PR Notice 2017-XX) (82 FR 42094) on notifications, non notifications, and minor formulation amendments for ail pesticide products. The Office of Pesticide Programs issues PR notices to inform registrants concerning policies, procedures, and registration-related decisions and to provide guidance for registrants and agency personnel. The draft notice aligns the notification program with the requirements of the Food Quality Protection Act and the Pesticide Registration Improvement Act and clarifies the processes for accepting minor, low-risk registration amendments. The draft notice supersedes PR Notices 95-2 and 98-10 in their entirety. Comments now are due Dec. 5, 2017. Notice of the NRC announces the submission of a continuing information collection request to the OMB regarding notices, instructions, and reports to workers on inspections and investigations. The collection addresses requirements for notices, instructions, and reports on inspections and investigations prepared by licensees and regulated entities for workers participating in NRC-licensed and regulated activities, and options available to such individuals in connection with commission inspection and compliance activities. The collection also addresses the rights and responsibilities of the commission and individuals during subpoenaed interviews as part of inspections or investigations of matters within the commission's jurisdiction.
