Alaska WATER APDES Permit/Domestic Wastewater Treatment Works Alaska WATER Notice of the Department of Environmental Conservation announces the proposed issuance of an Alaska Pollutant Discharge Elimination System (APDES) general permit to small publicly and privately owned treatment works providing secondary treatment of domestic wastewater up to 1 million gallons per day to fresh or marine surface water. The permit establishes effluent limits for ammonia, five-day biochemical oxygen demand, dissolved oxygen, enterococci bacteria, fecal coliform bacteria, pH, total residual chlorine, and total suspended solids. The permit also allows applicants to request modified effluent limits and facility specific mixing zones for dissolved oxygen, fecal coliform bacteria, pH, or total residual chlorine. EPA, 1:17-cv-01906 ED_001523_00002834-00001 mobile automotive repair and that do not operate a currently registered place of business where the diagnosis or repair of motor vehicles is performed. The OAL disapproved the rule because it did not meet Administrative Procedure Act procedural requirements. The action is dated June 6, 2017. The rule requires rest platforms when hook-on and attachable ladders are used on supported scaffolds that are more than 35 feet high. The rule also establishes a maximum height of 24 inches for the bottom rung of ladders from the scaffold supporting level to prevent employee slips and falls while transitioning between the support level and the ladder. The rule is effective June 5, 2017. The rule incorporates federal standards under 29 CFR 1910.38 to require emergency evacuation procedures to identify escape procedures and exit route assignments specific to the type of evacuation. The rule also specifies that provisions cover employees performing rescue and/or medical duties. The rule is effective June 5, 2017. The petitioner claims that the agency did follow procedural requirements in the adoption by Sierra Club v. EPA, 1:17-cv-01906 ED_001523_00002834-00002 incorporation by reference of the form. The petition is denied because the agency finds that the regulation was exempt from Administrative Procedures Act formal rulemaking provisions at the time of adoption and because the agency held hearings prior to the initial adoption and amendment of the regulation. The rule revises the water system replacement fee (WSRF) to establish procedures for a multi-family WSRF adjustment. The rule also revises the customer classifications and associated definitions. The rule updates the incorporation by reference of federal motor carriers safety standards under 49 CFR 373 through 399, as of Feb. 17, 2017, and requires certain commercial vehicles to be equipped with electronic logging devices to record hours-of-service of drivers. The rule also updates the incorporation by reference of federal standards under 49 CFR 107,171,172,173,177,178, and 180, as of Feb. 17, 2017, regarding transportation of hazardous materials. In addition, the rule updates the incorporation by reference of the Commercial Vehicle Safety Alliance North American Standard Out-of-Service Criteria as of April 1, 2017. The rule incorporates by reference the June 2017 version of the Nutrient Standards Variances document (Department Circular DEQ-12B). The rule is effective June 24, 2017. Case-by-case exceptions may be allowed for owners and operators who demonstrate to the applicable regional office that the requirement would pose an undue burden. The revisions address significant contribution to nonattainment and interference with maintenance requirements under the good neighbor provision. Hearings are scheduled for July 18, 2017, in Harrisburg, Norristown and Pittsburgh. Comments are due July 20, 2017. EPA, 1:17-cv-01906 ED_001523_00002834-00004 AIR SIP Revision/Lebanon County PM-2.5 Nonattainment Area Pennsylvania AIR Notice of the Department of Environmental Protection announces a proposed revision to the state implementation plan (SIP) regarding the Lebanon County nonattainment area for 2012 annual fine particulate matter (PM-2.5) national ambient air quality standard. The SIP revision contains the 2011 comprehensive base year inventory to conform with a Jan. 15, 2015, clean data determination by the EPA. The revision will be submitted to the EPA for approval. A hearing is scheduled for July 19, 2017, in Harrisburg. Comments are due July 20, 2017.
