FIRST AMENDED RESPONSE TO REQUEST FOR RULE 194 DISCLOSURES
(a) The correct names of the parties to the lawsuit;
RESPONSE: This Defendant does not know the correct names of all parties to this lawsuit. The proper name of the entity responding to these requests is CITGO Petroleum Corporation.
(b) The name, address, and telephone number of any potential parties;
RESPONSE: At this stage of the case and discovery, CITGO believes other potential parties include Plaintiffs prior employers.
(c) The legal theories and, in general, the factual bases of your claims or defenses;
RESPONSE: 1.
Defendant did not purchase, own, occupy or operate the premises where Plaintiff claims to have been exposed to asbestos. The Defendant is, therefore, not liable in the capacity in which it has been sued and is not a proper party to this action.
2. No act, omission, or condition of a premise belonging to this Defendant, proximately caused the Plaintiff to suffer the exposure or injuries alleged in this suit.
3. The Plaintiffs claims, if any, against this Defendant are barred in whole, or in part, by the applicable statute of limitations or laches.
4. If the Plaintiffwas exposed and injured as alleged, the said exposure was proximately caused by the negligence ofthe Plaintiff, his employers or co-workers, or any of them.
5. Plaintiffknew or should have known, through his employers or unions, of the risks of exposure he claims Defendant knew or should have known about.
6. Plaintiff claimed exposures occurred entirely at premises owned, occupied or operated by third parties.

Plaintiffs employers who did not carry worker's compensation insurance for those periods Plaintiff claims he was exposed may have been negligent in not furnishing the equipment Plaintiff claims should have been furnished to avoid exposure and are liable for the Plaintiffs injuries, if any.

(g) Any discoverable indemnity and insuring agreements;
RESPONSE: At this stage of the case and discovery, Defendant's inquiries into such agreements are ongoing.
(i) Any discoverable witness statements;
RESPONSE: Statements by the Plaintiff may be found in his medical records and deposition..
(j) Ali medical records and bills that are reasonably related to the injuries or damages asserted or, in lieu thereof, an authorization permitting the disclosure of such medical records and bills;
RESPONSE: Plaintiff has produced medical records in discovery. This material will be made available for inspection on July 5,2001 at 9:00 a.m. at the offices of Royston, Rayzor, Vickery & Williams, L.L.P., 1700 Wilson Plaza West, 606 N. Carancahua, Corpus Christi, Texas, 78476.
