The rule sets forth new antidegradation implementation methods for Alaska Pollutant Discharge Elimination System permitted wastewater discharges. The rule also specifies the levels of protection for U.S. waters within the state that conform with the Clean Water Act and adds definitions. A hearing is scheduled for July 20, 2017, in Anchorage. Site California HAZARDOUS WASTE CLEANUP Notice of the Department of Toxic Substances Control announces a proposed lien settlement agreement with Nur Al-Huda Academy regarding the former Gordon Research Co. site in Manteca. The settlement addresses historical contamination of soil with heavy metals, polychlorinated biphenyls, dioxins, and other toxins. The settlement requires the academy to implement a removal action work plan to clean up remaining contamination at the site and to pay certain costs in consideration for a covenant not to sue and contribution protection from DTSC and removal of DTSC's statutory lien on the property. The changes include increases in the oversight portion of the state surcharge to $49 and the underground storage tank program portion of the surcharge to $20. The changes also include a new refinery safety portion of the state surcharge consisting of four tiers based on daily barrel production capacity. The revised surcharges are effective June 2, 2017. Contact: Melinda Blum; Cal-EPA, Unified Program Unit; 916-327-9560; Melinda.Blum@calepa.ca.gov --California Regulatory Notice Register (06/02/2017) Regulatory Update OCCUPATIONAL SAFETY AND HEALTH Occupational Exposure to Beryllium California OCCUPATIONAL SAFETY AND HEALTH Proposed rule of the Department of Industrial Relations, Occupational Safety and Health Standards Board, amends regulations under 8 CCR 5155 and adopts regulations under 8 CCR 1535.1, 5205 and 8359.1 to align state requirements for occupational exposure to beryllium for construction; general industry; and ship building, repairing and breaking with Jan. 9, 2017, federal amendments. The rule reduces the airborne permissible exposure limit to 0,2 micrograms per cubic meter of air as an eight-hour time-weighted average and 2.0 yg/m3 as a short-term exposure limit determined over a sampling period of 15 minutes. The rule also sets forth requirements for exposure assessment, methods for controlling exposure, respiratory protection, personal protective clothing and equipment, medical surveillance, hazard communication, and recordkeeping. In addition, the rule provides a list of nonmandatory control options that employers can use to comply with the rule in a number of specific beryllium operations. Finally, the rule specifies compliance dates for the three industry standards and for change room and engineering control requirements. A hearing is scheduled for July 20, 2017, in San Diego. EPA, 1:17-cv-01906 ED_001523_00004313-00002 regarding the water quality control plan for the Los Angeles Region. The rule incorporates an amendment to the basin plan that revises the total maximum daily load for metals and selenium in Calleguas Creek, its tributaries, and Mugu Lagoon. The rule is effective May 18, 2017. Contact: Thanhloan Nguyen; SWRCB; 213-576-6689 --California Regulatory Notice Register (06/02/2017) Regulatory Update Pennsylvania WATER Chesapeake Bay Watershed Implementation Plan Pennsylvania WATER Notice of the Department of Environmental Protection announces a request for comments to inform development of the commonwealth's Phase 3 Watershed Implementation Plan (WIP) for the Chesapeake Bay. The department is developing the plan in coordination with the EPA and other agencies and shareholders to achieve certain federal total maximum daily load standards in Chesapeake Bay watershed counties by 2025. The EPA is conducting a midpoint assessment of nitrogen, phosphorus and sediment levels this year that will define how the commonwealth designs the Phase 3 WIP. Comments are due July 7, 2017.
