OSHA ASBESTOS STANDARD LAWSUITS
Enclosed is information on the recent ruling on the asbestos suits filed against OSHA's standard. Darrell has done a good job of summarizing the major points of the ruling. Needless to say, OSHA is going to have to reconsider some of the issues that the court has referred back to them.

Enclosed is a copy of a write-up on Florio's latest effort on asbestos. The state of Michigan is presently laboring with the AHERA law to implement in Michigan. Note that Florio indicated that this new law he is proposing which controls asbestos in federal, state, and local government buildings is just an interim step towards requiring control in all buildings.
As I've indicated in the past, we're just a step away from regulations which would require Dow to remove asbestos from all of its buildings. Because of this it is important for us to remove asbestos whenever we can during renovation operations, including those carried out in the Abbott Road Buildings and other Dow administration buildings.
The licensing and certification procedures in AHERA have been extended into the Hazardous Waste Operations and Emergency Response 0SHA Standard. This was done during the budget reauthorization in 1986. Unions carried it out because they felt that better training of the trainers is needed. In essence, based on what has happened in AHERA they have managed to slow down the procedure of certification of

RE: OSHA REVISED ASBESTOS REGULATION
1. In order to assure compliance to the revised OSHA asbestos > regulation, it is necessary to distinguish those tasks with exposure to asbestos which fall under the "General Industry" (the manufacture of asbestos products) provisions versus the "construction industry" (the manipulation, installation, removal of asbestos products) provisions. Please refer to the regulation for more precise definitions of each.
2. The medical surveillance requirements for these two industries are different, so we must be able to identify which regulation applies to each employee's tasks with asbestos exposure.

At the last Industrial Hygiene Managers' meeting, all managers indicated that all Dow employees' exposure would fall within the construction industry. If so, this will considerably simplify our procedures. Please review all tasks with asbestos exposure for Dow employees and report the number, the tasks, and the plant that fall within the definition of "general industry", if any.

4. Please estimate the number of Dow employees in your division by plant who may be exposed to asbestos above the action level (per construction industry regulation) for 30 or more days or whose tasks with asbestos require the use of a negative pressure respirator.

requires that more extensive exposure and personal protection data be provided to the physician doing health surveillance. I have discussed this with Larry Rampy, Sam Norwood, and Gordy Engdahl. A common method to assemble and provide this information may be discussed at the September 28 or 29 meeting for Industrial Hygiene. Receipt of this report by 7 September 1987 will signifi cantly facilitate preparation for that meeting.
